Dear Mr. Olsen:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, August 12, 2002:
The public hearing is closed.
WHEREAS, this proposed set-off is to set off a 3.02 acre lot (Lot #1) from a 28.54 acre
parcel; and
WHEREAS, the Town has purchased the Fee Title to the remaining 25.52 acres (Lot
#2) for open space purposes; and
WHEREAS, this property is located within the Low-Density Residential R-80 Zoning
District; and
WHEREAS the Southold Town Planning Board granted sketch plan approval on
November 5, 2001; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a
Negative Declaration on November 5, 2002; and
WHEREAS, all conditions of sketch plan approval have been met; and

WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated December 4, 2001, and authorize the Chairman to endorse the final maps.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and
filed in the Office of the County Clerk. Any map not so filed or recorded within sixty (60)
days of the date of final approvalsh-al~bccomc null and void.

WHEREAS, AGNES D. MCGUNNIGLE, lS the owner of fee

upon, inure to the benefit of and be enforceable by the
Declarant, her heirs, successors and assigns, and the Town
of Southold and its successors and assigns, and the failure
of any of the foregoing to enforce any of such covenants,
conditions and restrictions shall in no event be deemed a
waiver of the right to do so thereafter.
The Declarant grants the continuing right in perpetuity to
the Town of Southold or any of its designated
representatives to enforce the conditions and restrictions
of the covenants. These rights of inspection and
enforcement shall be binding upon declarant, her heirs,
executors, legal representatives, distributees, successors,
assigns and transferees.
In addition to the rights of other parties to enforce the
covenants, the Planning Board shall also have the authority,
through appropriate legal action and after due notice to the
Declarant, her heirs, executors, legal representatives,
distributees, successors and assigns, to enforce the

Dear Mr. Olsen:
The following resolutions were adopted by the Southold Town Planning Board at a meeting held
on Monday, November 5, 2001:
WHEREAS, this proposed set-off is to set off a 3.02 acre lot (Lot #1) from a 28.54 acre parcel;
and
WHEREAS, the Town is in contract to purchase the fee title to the remaining 25.52 acres (Lot
#2) for open space purposes; and
WHEREAS, this property is located within the Low-Density Residential R-80 Zoning District; and
WHEREAS, the Planning Board has reviewed this proposal and has decided that, based on the
fact that the Town is in contract to purchase Lot #2 for open space purposes and the proposed
set-off will be the only development on the original 28.54 acre parcel, thus creating no new
impact, that the Planning Board will not require that the 3.02 acre set-off be clustered, but will
require an increased front yard set-back and a restriction prohibiting any further subdivision; be
it therefore
RESOLVED that the Southold Town Planning Board grant sketch approval on the map, dated
September 6, 2001, with the following conditions:
1. A building envelope must be designated for Lot #1. The building envelope must include a
front yard set-back of at least 100'.
2. It must be noted on both the map, and in a Declaration of Covenants and Restrictions,
that there shall be no further subdivision of Lot #1 in perpetuity.

BE IT FURTHER RESOLVED, that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, do an uncoordinated review of this unlisted action. The
Planning Board establishes itself as lead agency, and as lead agency, makes a determination of
non-significance and grants a Negative Declaration.
Sketch plan approval is conditional upon submission of final maps within six months of the date
of sketch approval, unless an extension of time is requested by the applicant, and granted by
the Planning Board. The final maps (six paper prints and two mylars) must be submitted before
a final public hearing will be set. The final maps must contain a current stamp of Health
Department approval and, if public water is to be provided, a valid water contract from the
Suffolk County Water Authority must be sUbmitted.
The following revisions should be made to the final map in addition to those r~quired as a
condition of sketch approval:
A. A notation should be placed on Lot #2 that the entire area is pending an open
space purchase by the Town of Southold.
B. The map should be labeled as a set-off rather than as a subdivision.
The Planning Board has reviewed the property and has decided that, due to the fact that there is
no new impact, neither a reservation of land for park and playground use nor a park and
playground fee are required.
A Declaration of Covenants and Restrictions in accordance with the conditions of sketch
approval must be submitted. In addition to the conditions noted in the sketch approval, the
Declaration is to include the standard language in regard to modification and enforcem~nt
required by the Planning Board for all Declarations. After the Planning Board's approval of the
document, it must be recorded in the County Clerk's Office prior to any endorsement of the final
plat. A notation is to be placed on the final plat that a Declaration of Covenants and Restrictions
has been filed in accordance with the Planning Board's requirements. The notation is to include
the Iiber and page number of the recorded document.
Enclosed please find a copy of the Negative Declaration for your records.

Please be advised that I will be representing the
applicants, Thomas P. McGunnigle, Jr. , and Jennifer L.
McGunnigle. We are seeking to set-off a 3.02 acre buildable
lot from a 28.54 acre lot. The remaining 25.52 acres are
currently under Contract to be sold to the Town of Southold
pending this set-off. Please forward all corespondence to
my office.
Enclosed herewith please find the following in re the above

1) Check in the sum of $250.00 payable to the Town of
Southold for the application fee.
2) Letter from Craig Turner dated May 14, 2001 indicating
that there will be no park and playground fee levied on the
set-off of one buildable lot.

Dear Mr. Olsen,
The Southold Planning Board discussed the proposed set-off in regard to the park and
playground fee. Since the large majority of the propeny is being sold to the Town for
park and pla.yground purposes, the Planning Board does not believe that there should be
any park and pla.yground fee levied on the set-off of one buildable lot.
