Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result 2 from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. The owner proposes a 9-lot residential subdivision with the removal of 3.3 acres of vegetation for the construction of 8 single family residences which will be located along Laurel Avenue. Lot 9 will be preserved land approximately 32.6 acres. Freshwater wetlands are 580+'from the nearest lot. Innovative/Alternative on-site wastewater treatment systems are proposed for each lot. The project is located on the west side of Laurel Avenue north of LIRR tracks and 140'south of Yennecott Drive. No work is proposed in or within 580' of the freshwater wetlands. The proposed residential lots are more than 100'to wetlands. It is my understanding that the proposed project is exempt under Code Section 275-4.A(1)(k)since all work is greater than 100' from the wetland. Thank you for your assistance.
