WORK SESSION
~Present: Supervisor Francis~J. Murphy, Councilman Paul Stoutenburgh, Council-

9:20 A.M. - The Board met with Robert Sansone and his associate, Associal~ion for
the Help of Retarded Children, Suffolk Chapter, concerning the proposed construction
of a nine unit group home (seven units for 14 clients, and two units for~house super-
visors) on the~east side of Horton Lane, Southold, a residential' zone. In accordance
with the NYS Mental Hygiene Law, "a community residence established pursuant to(the
law) and family care homes shall be' deemed a family unit,~ for the purposes 'of local
laws and ordinances. This~provision allows such a "multiple residence" in'a residential
zone. The residence would be a priv~ately ow, ned, non-profit 'facility, licensed by the
Office of Mental Retardation. Mr. Sansone assured the Board that covenants and
restrictions Would be filed' witl~-the Town and the deed, as'they have done in'the
towns of/slipand Brookhaven. He will'submit Health Department.approvalS and have
the covenants 'and restrictions prepared for TQwn Board approval, which will' be sub-
mitt'ed to the TOwn Attorney for an opinion.
10:'45 A.M. - Superintendent of Highways Jacobs discussed the need for engaging the
services of an en~ineerin~ firm for road inspections, site inspections, etc. The Super-
visor will' requests proposals from various engineering firms for the Town-Board's review..
10:50 A.M. - Frands'J. Yakaboskir'Escl., of Counsel to Town Attorney Tasker met
with the Board to discussion (1) the AHRC group home proposal: State law defines
a family unit and such a residence is 'permitted in a residentiai~agricultural district.
(2)~ Ciacia~abando~ed home on the south side Route 25, east of Pipes Neck Road,
Greenport. (3) Possible Special Attorney.to replace former Special Attorney Lark:
suggested the Board wait a few weeks until 'he has had a chance to discuss the
pending matters with the Building Department~ Chief Winters~ etc. (4) Reviewed
the proposed Local Law relative, to amending Chapter 32 of the Code with respect
to Boats, Docks, Wharves and Moorings at West Harbor. He will make necessary
amendments so the Board may proceed with setting a hearing dlate ~at their 7:30 P.M.
regular meeting. (5) Reviewed the William Hein§ complaint (he appeared before ~he
Board at their'4/21 work session) concerning the denial of a variance to divide his
lot in'Orient. (6) Advised the Board that Herbert Mandel, who was denied a variance
by the Board of Appeals to divide a three acre parcel in'three one acre lots, is 'taking
the ZBA to court.
11:00 A.M. - For Discussion Items: (1) Proposed special attorney to replace Richard
Lark. Was discussed with Frank Yakaboski (see above) who recommended the Board
wai~ a few weeks. (2) Letter from J. Kevin'Mcl~aughlin'concerning parking on
Youngs Road, Orient. He requested that a new ordinance be enacted to restrict
parking along Youngs Road from May 1 through September 30 to vehicles displaying
Town of Southold resident permits. Town Clerk was instructed to respond to Mr.
McLaughlin advising him the Town canno~, by law, restrict parking on~a public high:-
way to onl¥~T~oWn oflS~outhold vehicles. (3) Need to create a Waterfront Advisory
Committee under the Local Waterfront Revitalization Program grant. Town Clerk to
advertise for resumes (see resolution no. 20)'. (4) Letter-,from East End Community
Services, Inc. requesting $15,000 support from the Town for fiscal year 1987. Super-
visor Murphy to respond advising provision has not been made in'the Town 1987 Budget
for such an allocation, therefore they should resubmit their request for consideration
at ~he time the~1988 Budget is:being prepared. (5)' Leter from Pebsco of New York
offering a deferred compensation plan. They will be in~ited to the May 19th Work
Session for a presentation to the Board. (6) Letter from CSEA President Christine
Stulskly concerning a salary adjustment for Sylvia Rouse (discussed in'the Executive
Session at 12:25 P.M.). (7) AHRC request for approval of a community home on
Horton Lane, Southold (discussed at 9:20 A.M.). (8) Receipt of proposal fr~m Sidney
B. Bowne & Son, for the design of a computerized information management system for
the ~l'own. This will be held until Councilman Penny h~s made-arrangements for two
other consultants to meet with the Board relative to a similar proposal.
MAY 1, 1987
11:05 A.M. - Planner David:Emilita met with the Board to review changes to the
proposed Local Law to update the Zoning Ordinance' and Zoning Map. Board placed
a resolution on the regular meeting agend~ (no. 23) to declare lead agency on this
proposal and authorize Mr. Emilita to prepare a Generic Draft Environmental Impact
Statement.
11:50 A.M. - Councilwoman Cochran discussed the need to replace a former part-time
Custodian for the Town Hall. Town Clerk will advertise for applicants (see resolution
no. 22).
12:10 P.M. - Board reviewed regular meeting agenda resolutions.
EXECUTIVE SESSION
12:25 P.M. - Board discussed letter from CSEA President Christine Stulsky relative
to a salary adjustment for Sylvia'Rose. This matter.was previously discussed by the
Board at their'December 30, '1986 Executive Session, and it 'was agreed the request
should be denied, based upon the interpretatin of the CSEA Contract.~' In addition,
this interpretation was affirmed by negotiator Charles Graves. The Board reaffired
their decision to deny the request.
12:40 P.M. - Recess for lunch.
2:30 P.M. - Work Session reconvened and the Board audited outstanding vouchers.
2:45 P.M. - Town ~lustice Frederick ,,'Eedeschi and Town Justice Willi'am Price met with
the Board to discuss the increase in the ~number of cases, paper work, and inquiries
which are being handled by the same staff they have had for years, and the Clerks
cannot keep up with the workload. They requested one additional full-time person,
and a part-time person for the summer months. Furt,her, their quarters a~e much too
small now, and they do not feel. it 'fair'to ask their'.sta~f to work in the ba§ement.
The Board discussed several means of increasing space, including renting outside
offices for the .justices and their staff, ancl will' pursue the matter until it 'is ' resolved.
They also created a new full-time Clerk Typist position (see resolution no. 2~), and
will fill'the job as soon as possible.

A Regular Meeting of the Southold Town Board was held on Friday, May 1,
1987, at the Southold Town Hall, Main' Road, Southold, New York. Supervisor
Murphy opened the meeting at 3:00 P.M. with the Pledge of Allegiance to the Flag.

audit of bills of May 1st.
Moved by Councilwoman Cochran, seconded by Councilman Stoutenburgh, it 'was

COUNCILMAN PENNY: You notice we're starting late because we couldn't get all
our work done.
I ~ REPORT'S.
SUPERVISOR MURPHY: Okay, the first item on the agenda is Reports. 'We have
no reports this early in'the month from other departments, except for now the
Councilmen, and I'd like to start on my ~ight with George Penny.
COUNCILMAN PENNY: Yes, on the 23rd I attended a meeting with the Southold
Town Fire Commissioners in Gr~eenport, and it was very interesting and we're hoping
to follow up with some more discussion. On the 29th I went with the Town- Board to
Connecticut where we. visited a recycling plant run by Peter Carter in Groton. An
incinerator in Windom, and the Earth Grow Composting Plant. On the 29th was a meet-
ing of the Commerce and Industry Committee, where we're still entertaining more dis-
cussion on the Master Plan. We're getting into it zone by zoi~e. On the 30th, which
was last night, I attended a meeting of"the Water Advisory Committee, which I'm certain
that the chairman will comment on. Thank you.
SUPERVISOR MURPHY: Thank you, George. Jay?
COUNCILMAN $CHONDEBARE: I had ten beautiful days in Florida, and now I come
back to~-the Town Hall and it was one beautiful day of the trash of Connecticut.. A
wonderful opportunity to see somebody else's garbage for a change, and that's it.
SUPERVISOR MURPHY: Paul?
COUNCILMAN STOUTENBURGH: Yes, we said we had a Water Advisory meeting
last night, and we're just about ready to hand in the report. We don't quite have
everything together, but hopefully we're going to be almost on target. We may be
a little late, but hopefully we'll be on target. We're gettting much better maps now.
George has gotten some good topographic maps and they're working very well. Basically
we're moving very well on this whole project. I had the opportunity, through our
Town Historian, to travel around the Town with the a State Forester to observe and
record historic trees in the Town. You'll hear more on this later. Of course, we all
visited the Islip Landfill, and I'll leave that for you, Frank. That's it.
SUPERVISOR MURPHY: Jean?
COUNCILWOMAN COCHRAN: I also attended the Commerce and Industry Committee
meeting on the 29th, on whi'ch it has been reported. I went to Connecticut, as Jay
reported. On Monday we did go to Islip to view their'Recyclin9 Plant. In comparison
to ~he one in Connecticut, it's a.~much ciearier plant in Islip, and a pretty well

organized operation, and I hope the rest of the Board has an opportunity to go view
that plant, because I think it's something that we can work with very well.' That's
it, Frank.
SUPERVISOR MURPHY: Than~k;you, Jean. Ray?
JUSTICE EDWARDS: On a week ago today Supervisor Murphy, Joe Baier and another
9entleman from the Health Department came over to Fisl~ers island and we had a sit-
down. They're going to write up some guidelines so we can go out to bid on Fishers
Island for starting on our aquifer, and I think it was very informative meel
I'm very glad to see that the County is~getting behind this program,, and il
very interesting to see the end resu t~ of~ this. Also, on our'-jumping ahe;

SUPERVISOR MURPHY: Thank you, Ray. Just to add to Paul--we went and saw the
Islip:Town WRAP Program. That!s where they take out their recyclables before they
loaded them on to the barge and sent it around the world. WE also did see a build-
ing for storage of hazardous waste which would be an on-going STOP Program, and
Harold Berger has asked us to draw up some plans and specs for what we want to do
and submit it. There's a good chance that we'll receive matching funds on this.
II. PUBLIC' NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on the agenda is:Public Notices.
There are six of them. They're on file on the Town Clerk's Bulletin' Board, and any~
one concerned about anyone in particular can read them.
1. As Ray mentioned on the. water, to make comments. NYS-DEC invites you
to public'meetings to discuss water supplies in the Long Island Substate Region,
Tuesday, May 12, 1987, Nassau County Planning Department, Mineola, Wednesday,
May 13, 1987, Stony Brook Union.
2. NYS-DEC, Notice of Complete Application of Orient Mosquito Dist,ric[ to
maintain 4750 linear feet of existing mosquito control ditches and place the excavated¢-,~
material on bOth sides of the ditches, south side Main Road, and east side'of River
Road, Orient. Comments by May 15, 1~87.
3. Suffolk County Department of Department of Health Services announcing
May is ~' National High Blood Pressure Month, with free bl'ood pressure screenings and
Awareness Classes available to the public;
4. NYS-DEC, Notice of Complete Application of Russell E. Planitze'r to construct
a single family dwelling landward of Freshwater Wetlands, install stone deck landward
of the Freshwater Wetlands and place a ma~im'um ,of 6 inches of gravel on proposed drive-
way landward of Freshwater Wetlands, sanitary system and swimming pool, greater than
100 ft. of Freshwater bOundary, Wilderness Point, Fishers Island. Comments by May
22, 1987.
5. NYS-DEC, Notice of Complete Application of the Incorporated Village of
Greenport to construct one storm water outlet including pipe and headwall to provide
discharge which would include 50 leaching rings with total capacity to contain 2 in.
of rainfall, Silver Lake wetlands system, North Street at Kaplan Avenue, Greenport.
Comments by May 22, 1987.
6. Village of Greenport, SEQR Positive Declaration, Notice of Intent to Prepare
a Draft ElS Determination of Significance, relative to the adoption of a Local Waterfront
Revitalization Program pursuant to the NYS Waterfront Revitalization and Coastal Resourc~
Act of 1981.

SUPERVISOR MURPHY: There's two Communications. 1. From CAST on the Substance
Abuse Committee thanking the Town for their help in arranging a program on Ray's
IsTa-~-~-,~sland. So often Fishers Island is forgotten. In fact some Town BoI~
members- even forget the name of the Island, they call it Shelter Island.
COUNCILWOMAN COCHRAN: Watch it, Frank.
JUSTICE EDWARDS: I'll sue.
SUPERVISOR MURPHY: Communication 2. is'from The State Insurance Fund. We've
been 50 ~/ears in their Workers' Compensation pro,ram.

REOSLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Francis J. Murphy to execute an agreement between the County
of Suffolk and the Town of Southold for p'articipation in the' 1985 Affordable 'Home
Ownership grant, as a participating Consortium munidpatity, to undertake the re-
habilitation of residential property owned by Iow and moderate income persons in
designated target areas.

ment and anchoring in West Harbor", now, therefore, be it
RESOLVED that the Town Board hereby sets 8:05 P.M., Tuesday, May 19, 1987,
Southold Town Hall, Main Road, Southold, New York, as time and place for a public.

BE IT ENACTED by the Town Board of the Town of Southold, as follows:

I. Article I11 (Boats) of Chapter 32 of the Code of the Town of Southold, Section
32.31. Definitions. is amended as follows: '

BOATS - Every vessel propelled in any manner. [, except vessels having a valid
marine document issued by the Federal Bureau of Customs or any
foreign government. ]
Article 111, Chapter 32 is amended by adding two new sections thereto, to be
Sections 32-36.1 and Section 32-36.2, to provide as follows:
Section 32-36.1 Equipment. ' ....
A. All pleasure Vessels and uninspected commerdal vessels shall be equipped
and licjhted while, under way or at anchor with any person aboard, as
required under the Federal Boat Safety Act of 1971, as amended, and
the regulations adopted pursuant thereto and contained i'n'Title 46 of the
Code of Federal Rules, Subchapter C, Parts 24, 25 and 26, .aBd pursuant
to the provisions of Section 40 of the Navigation Law of the State of New
York. Failure to comply with the equipment-and licjhtinc, l requirements as
set forth above sba. Il be a violation of this Chapter.
B. The provisions of this section shall not apply to vessels competing in' duly
authorized recjattas and trials preceding such re~lattas.
Section 32-36.2 Boat Operators.
A. No person under the acje of sixteen (16) years shall operate a mechanically
propelled vessel unless:
(1) The operator, who is under the age of sixteen (16) years, .is ~accompanied
therein by a person who is sixteen (16) years of age or older; or
(2) The operator is ten (10) years of age or older and is the holder of a
boating safety certificate~issued to him' by the Commissioner of the
Office of Parks and Recreation of the State of New York, pursuant
to Section 78 of the New York State Navigation Law. '
B. The failure 'ofa person specifi~:l in Section 32-36.2(2) hereof to exhibit

(1) The operator is-sixteen ~6) years of age or older;
(2) The operator, who is'under the age of Sixteen (16) years, is
accompanied therein-by a person sixteen (16) years or older; or
(3) The operator is ten (1,0) years of age or older and is the ho der
of a boating safety certificate issued to him- by the Commissioner
of the Office of ParEs and, Recreation of the ~tate of New York.
D. No person shall operate a vessel' whi:te in an intoxicated condition or
while his ability to operate such a vessel is impaired by thee consumption
of alcohol or by the use of a drug.
I11. Section 32-39.2A (anchoring in:West Harbor) of Article III (Boats) of Chapter
32 of the Code of the Town of Southold is amended as follows:
A. All boats .temporarily anchored in West Harbor. at Fishers Island shall
anchor [north of Goose Island. ] in' an area a~signed by the Harbor
Master or Bay Constable.'
(1) Anchoring shall not be permitted for a continuous period of more
than three (3) days unless authorized by the Harbor Master or
Bay Constable, which authorization may only be granted for
emergency situations.
IV. This :Local Law shall take effect upon its filin9 with the Secretary of State.

SUPERVISOR MURPHY: Number 4 is to authorize the placing of an ad.

RESOLVED that the Town Board of the Town of Southold hereby authorizes Town
Historian Antonia Booth to place a display ad in:The Suffolk Times and the Long
Island Traveler-Watchman Seekin~l volunteers for the Celebration of the Bicentennial
of the Constitution on Septemb er 17, '1987, and the 1990 celebration of the 350th
Anniversary of the Founding of the Town of Southold.

man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 5 is 'to authorize' the renewal of a trailer permit
application for David Horton and Gerry Horton for a single family house trailer,
which expires May 7, 1987. I offer that resolution.
5. Moved by Supervisor Murphy, seconded by Councilman Stoutenburgh, it was
RESOLVED that the application ~f'.David S. Horton and Gerry S. Horton for renewal
of a single family house trailer permit, for trailer located at Kirkup Lane, Mattituck,
New York, which permit expires on May 7, 1987, be and hereby is granted for a
six (6) month period.

SUPERVISOR MURPHY: Number 6 we're going to hold for a little while (place a
display ad in the newspapers for applications for the Southold Town Affordable

because ii shows, thatwe do have a concern for the environment 'here and I know it's
one of the main'critilcisms that we got in:the Master Plan, the fact that we? Were not
doing this~ Now I'm' glad'tO see this 'being C°rrected~ Number two,-iS'l.m very happy
to~.see also that the dredging is :going on Deep Hole Creek; In spite of some of the
reports to the contrary. There were some artici'es in; the papers which all.uded'to the
fact that maybet-it 'would be done, maybe it 'wouldn't be done, maybe the Town I~ad
other prioritieS. I'm sure that by seeing the dredge now all this will' be cteared up.
Deep Hole Creek has been for well over a year a number one priority in Southold Town
and it is now being done. Thank you.

an easier job because it is in place and we hope that they can fill Susan's ~:hoes.
