VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because 3EE REVERSE practical difficulties (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed, FORM ZB4 ~ I, ! ~O~ING BOARD OF APPF~ After investigation and inspection the Board finds that the applicant requests permission to build new one family dwelling with reduced front yard setback. The Board finds that the applicant is the o~mer of waterfront property and much of the lot in question has been lost due to erosion. If the dwelling was to adhere to the established setback it would be located on the beach area of the lot. Thus the dwelling would have to be set on spiles. The Board is willing to all~v a reduction in setback. The front line of the house should not be erected closer than a distance of 24 feet to the edge of the easterly line of the private right of way, t~n9 Street. The Board finds that strict application of the Ordinance would produce practical difficulties or unnece~s~r~ ~ar~s~ip; the hardship created is u~ique and is not shared by all properties alike~ in the immediate ~icinity of this property and in the same use district; and the variance would observe the s~irit of the Ordinance knd would not change the character of the district. THEREFORE, IT ~YA.S RESOLVED that Leo Steedle, 3 Krobel Court, Baldwin, New York, be granted permission to build a new one family dwell~g with reduced front yard setback, as set forth above, on property located~on the west side of private right of way off south side of King Street, Orient, New York.
