By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Town Board of Appeals After investigation and inspection the Board finds that the applicant requests permission to set off lots with insufficient area. Subject property has two dwellings on it which were built prior ko the Zoning Ordinance. The applicant would !neffect be splitting the property in half. The size of the lots would be 3ust under the min/mum requirement prescribed by the Ordinance, 11,250 sq. ft. of area and 10.028 sq. ft. of area. The Board is in agreement with the f~asoning of the applicant, that this is the best possible disposition of the situation. The Board finds that strict application of the Ordinance will produce parctical difficulties or unnecessary hardship; the har~hip created is unique and would not be shared by all propert ies al/ke in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the district and will observe the spirit of the Ordinance.
