9:15 A.M. -The Board met in " Executive Session witl4 Specia~ Attorney Richard L.
Lark and Executive Administrator Victor G. Lessard to discuss Building Department
pending, litigation. FolloWing this discussion personnel matters were discussed with
Mr. Lessard. , , ,
WORK SESSION
10:'00 A.M.-' The Board met with Glenn Moiler, DireCtoi~ of ',Th~. North Fork Early. Learn-
ing.vCenter, MattitU~l~, and his!head teadh'er. The Center h'as been in:operatior~ since
May ':1982,-and. they are ~Ui-ren~ly researching areas of funding to contintJe its operatioh.
Community Development Administrator James McMahon, also present, advised the Board
that this"is :an eligible Community Development Fund expense. Mr. Moiler requested
$18,000 in:support from the Town so the Center may continue t0,,operate. Along with
tuition, foundation 'support and corporate 'support they will' be able to operate full-time
to serve the needs of the community. Letters of 'support have been received from The
North .Fork Banl~ & Trust Company, Eastern Long Island Hospital, North Fork Housing
Alliance, inc., Community Action of Southold Town and members of the community who
use the center for their~children whil~ they are at work. The Board agreed to submit
a ~grant application to HUD for Town funding support of the Center (see resolution no.
45).
10:25 A.M. - For Discussion Items: (1) Reappointment of John Stack and Joseph L.
Townsend, Jr. as members of 'the Landmark Preservation Commission (see resolution
no. 37). (2) North Fork Early Learn Center (see 10:00 A.M.). (3) Amending agree-
ments with Special Town Attorneys Lark, Cron and Yakaboski, 'relative to restricting
them from representing any clients int any matters before boards or agencies of the Town
The Board agreed this would not be a problem with Mr. Cron who represents the Board
in certorari proceedings, but 'wish to add a Clause to, the~ Lark and Yakaboski agree-
ments, and inc~rease:.the~compensation of Mr. Lark to $125~.00, as is-currently being
paid'Mr. Yakaboski (see resOlutioh no. 47). (4) Reappointment of Farmland Committ'ee
members Villa; Orlowsld and Hargrave {see resolution no. 38)'. (.5)' Pending resigt~ation
of Recreation 'SupervisOr Susan Fossett - SupervisOr authorized te call for Civil 'Service
list. (6') Letter Paul Roth, Regional Solid Waste Engineer, NYS-DEC, rescinding his'
letter of March 12, ,1986: with respect to the scavenger waste pits at the Cutchogue
landfill; since it has been brought to his~attention tha hazardous wastes may ha~e
been dumped at the site (later d.is~ussion with Gary Loesch, H2M - Mr. Loesch will~
follow-up with the DEC who may order hydrogeological investigation to determin~ if'
there is'a high level of toxic:pollutants). (7) Discussio~ of Carr property at Mattituck.
Board will wait '-until transcript of the public:hearing on the zo'ning ordinance and maps
is received .and will'then schedule work sessions to discuss implementation of same.
{8) Reviewed bid§ for carpeting areas of the Town Hall (see resolution no. '39). (9)
Discussed interviewsof Building Inspector applicants on civil service list, and appoint-
ment.-.of Gary Fish (see resolution no. 36).. (10) Receipt of change order forconstructio~
of concrete ramp and roadway at the Scavenqe'r Waste Treatment Facility; work to be
accomplished by Ferran Concrete, original g~neral contractor for the plant (see resolutior
no. 40)'.
10:50 A.M. - Community Development Administrator James McMahon submitted the :1986
Hard Clam seed Rafting Planting Program final report to the Board and discussed the
results and the upcoming :1987 program, requesting permission to purchase clams from
the Shinnecock Indian Hatchery, and again engage the services of DaVid Lessard, Marine
Consultant, Project Supervisor (see resolutions no. 5 & 6).
11:00 A.M. - Off Agenda Items- Supervisor Murphy asked Town Attorney Tasker for
an explanation of why he rendered a decision that the Supervisor was not entitled to
indemnification and a Town retained attorney to defend him' in'the Ron Moriz~0' case
concerning the alterations made to his :office in:early :1986. Town Attorney Tasker

advised him that he is ~being sued individually and must retain'his own personal
attorney to defend him'. When asked why Mr.' Tasker did' not advise him of the need
for a personal attorney, or provide a Town attorney, Mr. Tasker advised that he only
represents them in'an officia~ capacity and not an individual capacity~---Discussed the
Clerk Typis~ ~vacancy infO'the Supervis0r's Office. Supervisor Murphy advised that his~
office had obtained the local civil service lis~ and sent letters for interviews with only
one response from an indivi~dbal presently in California:and who~ will not- return for over
a'month. He requested permission to interview willing applicants and appoint provision-
ally, .but was advised he should call for the county lis~ of applicants.---Letter from
Receiver of Taxes George Mellas was received transmitting information for a new system
for receipting and recording unit~ for his 'department. Mr. Mellas will' be requested to
meet .with the Board at theirMarch 10th work session.---Discussed materi~l~ to be ~
received by Youth Services from Planned Parenthood, and implications of same. f~i~i1
Community Dewel_opmen~t Administrator McMahon explained that New York S~ate mand~
certain~topics to I~e coverdd in" the schools, and along this 'line Juvenile A~de Officer
Martin~ Flatley will be conducting seminars at the local schools concerning ~exual abuse
awareness of children. Officer Flatley and~a representative of Planned Parenthood will
be in~ited to the March 10th work session to discuss Other' proposed', prog_ram~ l~hey are
working on.---Letter from Assemblyman Joseph Sawicki,"Jr. c~ncerni~g the Board's
request for the introduction of the "Land Bank Bill" was reviewed. Mr. Sawicki feels
it 'Would be much more realisl~ic to set the limit~ of real property which will' be affected
by the legislation at $200,00'0 improved and $100,000 vacant. Supervisor ~lurphy. will'
b~ing this 'topic ~before the Supervis0r's .Associal~ion for di. scussion with th~ other town-
ships.---Councilman Penny asked that the next Waterfront Revitalization m~eeting be
advertise so there will' be more public :partici'p~tio~.---He requested that'Troop 51
be granted permission to use the dishes of the Nutrition Program for a dinner. He
~vas advised he should check with Venetia~McKeighan, Director of Senior Services.---
He submitted a copy of the :~1987~$8 P~BA'~contract whicl~ is 'now in: final form, and it
will'be subm~tt'ed to the PBA for review.---~ouncilman Penny discussed a ~'equest he
has received for the Town to assume the electric'~harges for a street light at Wendy
D~ive, Laurel. He was advised this~was in§tailed by. the residents when the road
was private, and would~-be~reqUired to meet the criteria'of~being located at a dangerous
intersection for the Town to assume the charges.---Mr. Penny submitt~ed a proposal
-prepared by Larry Tuthill~ Engineer, for the possible solutio~to erosion at. Kenny's
Beach parking area.---Mr~'~Penny presented an elevation map of contour li~e area of
Orient, as in~:orporated in"the master plan map, suggesting that the contour line should
be defined a little better. This ~will: be discussed further when the Board discusses~e
master plan hearing.
12:15 P.M. - Recess for lunch.
2:15 P.M. - Fishers Island Garbage & Refuse District Commissioners Raymond Doye,n
Howard Hancock met with the Board to review their five years of preparation and
study leading to the construction of an incinerator facility on Fishers Island. The
project, presently the subject of an environmental 'impact study, is 'to be located
at the westerly end of the Island near the present 'burning pit~, where they are
allowed by the DEC to. burn once a year. The DEC has advised them they are
looking for them to have a good recycling program and the Commissioners are looking
into the the pu~rchase of a shredding machine. TWo Consumat Model CS-325 incinerators
are proposed to be installed at a cost of. $300,~000 each, and equipped to handle 12 tons
a day. This:model is ~on the DEC approved list for-emission control. The Commissioners
presented the Board with~ a map of the location and architectural drawings of the propose
incinerator building.
2:45 P.M. - Meeting with Bob Henderson, DEC, Albany, was cancelled due to Mr.
Henderson's illness. He will'be rescheduled for March 10th.---Gary Loesch, Holzmacher,
McLendon & Murrell, P.C., in'attendance to hear the discussion with Mr. Henderson,
discussed with the Board the DEC's letter relative to pumping the. lagoons at the Land-
fill area, and advised he Would be following-up on the matter and keep. the Board
up to date on the progress.
- J. Kevin:McLau~hlin:, Attorney for John A. Costello, met with the Boar~~
to discuss the proposed~'Convenants and Restrictions to be submitted with respect t~i.~
Mr. Costello's proposed AHD district. Mr. McLaughlin~will~endeavor to have the ~
document executed by the principals before the Board's 7:30 P.M. re~lular meeting.
3:10 P.M. - Boar~l reviewed resolutions for the regular meeting agenda~--LeWis'Edson,
real estate broker~ appeared before the Board to advise he would be willing to do
appraisals for~ the Town at a cost not to exceed $100.00. Board authorized Mr.
Edson to conduct an appraisal of "Oregon Heights" subdivision so the Board may
determine the amount to be deposited in lieu of land for park and playground (see
resolution no. 4).
4:00 P.M. _ Board audited outstanding vouchers.
4:30 P.M. - Board discussed memo from Town Historian Antonia'Booth concerning
plans and preparation for the celebration of the Bicentennial of the Constitution.
Supervisor Murphy will discuss this ~with Mrs. Booth and suggest she contact

otl~er East End Historians to coordinate the plans.---Council,S)man Cochran reviewed
a memorandum from Mrs. Booth asking for guidance from the Board relative to attend-
ance at a March 2 meeting of Members of SOUTHOLD[2000, sensing the matter might
be political. The Board offered no objection to' her attendances--Proposed actio~
on the Costello change of zone petitibn to AHD was discussed [see resolution no. 46).
4:35 P.M~. -Edward Siegmann, member of CANDO, a group in'oppositibn to the Carr
condominium project at Mattituck, informed the Board he had spent the entire date
in'the audience awaiting discussion of the master plan, and was disappointed to be
told at this point in:time' it Would not be discussed until ~a later date. He verbally
attacked Councilman Penny wi~h respect to prio~ discussions he had had' with him
and his ~opinion he had not cooperated as he had promised.

18. Councilmen's Reports: i'd lik~ to now ask the Councilmen if'they Have
anything special' to report, starting on my right with Councilman Penny.
COUNCILMAN PENNY: Yes, thank you, Frank. On the 5th I attended a meeting
that was established between the Town Board and the Village of Greenport to discuss
some mutual concerns. One being the Scavenger Waste Plant. Two being finalizi'ng
the 7th Street Sewer agreements. Three, the Town Water Management Policy. Four,
to review for any possible contaminated areas for County funding for water main
extensions, of which we really didi~'t get very. far. And five, we were asked by
the Village Board and members of the community, to recommend to the-Tow~ Plannin~
Board to' review the sit~ plan for the Costello property for the best traffic~flow c0n--~
cerning the Mid~lleton Road communitY. I have done that. l'.made the
and received this response today from the Planning Board that they've got a better
plan than some of the people were--some of the people were concerned tha~ there was
only one way in and out of the community there, and it 'seems that they've got a better
~traffic flow out of it.' On the 6th I attended a meetinq at the Scaven~ler WJaste Plant.
We checked out the potentia[ problems of tractor-trailers turning around. .~/e're going
to have some-pretty big:trailers and:there's speculation that the one coming from Shelter
Island would not be able to maneuver through our gates, but we checked that all .out.
We received a maintenance check list from H2M which will~ be an operatio-nal guidlin~ for
our plant. And I missed--I had to leave--but ferran, the contractor there, came out
and reviewed the ramp proposal and the result is'on the resolutions tonight. On the
10th we had a specialr meeting, Which I'm sure we'll hear more about, with ~H2M and.
the DEC. On the 11th we' had' Master Plan hearings. On the 12th I attended a meet-
incj with the Village of Greenport. The Suffolk County Department of Health Services
has come up, through the EPA, with funding for a test of a ion exchange filter on
well number 6, which has had some nitrate problems, and the Village, I believe,
resolved to accept this-'. It's coming free to them at this'point, but they'll have to
pick up the maintenance on it,: and then eventually they may have to purchase some
part of it ~in'the future when it's given, up by the EPA. On the 18th We had a meet-
in~ Commerce and Industry Committ'ee and discussed the Master ~Plan, the Laurel booth,
the Scavenger Waste Program, and various things that are before the Code Committ:ee.
On the ,19th we interviewed Building Inspectors. The result is:the hiri:ng of a Build-
ing Inspector, which we're going to be c~oing later. And yesterday I atten~led a
meeting with the Village'of Green ort, H2M, their:consultant, and Dennis'Moran from~
- - P ' regarding the nit~ate n{~tices thatIi;1
the' Suffolk County Department of Health Services,
the Village has been required to send out, due to th~ high nitrate content ,from time
to time in their:water~ system, and they are developing a different operatiof~al procedure
whi.~h should lower the nitrates below the acceptable level, and hopefully by summertime
we won't be seeing any more of these notices. That's all. Thank you.
SUPERVISOR MURPHY: Jay?
COUNCILMAN SCHONDEBARE: Y{es, Frank, thank you. The Code Committee met
and discussed bed and breakfast and accessory ~partment laws, and we'll be amend-
ing them ~t'Onight as a result of that meeting. We also met with the Landmark Preservatio~
group for -~h~ proposal of the Landmark Preservation Law, which they have submitted
us. They'll meet with us again this :coming Wednesday in the Town Hall. We have
a meeting March 4th, I think it'is; if'that's this:Wednesday--7:00 to 9:00 we meet, and
we'll be discussing that again- Also the issue with regards to trailers will probably be
on the agenda. That's been referred to the Code Committ'ee. And likewise the proposal

for an Architectural Review Board for the Town, with regards to business property, was
submitted also to. the Code Committee. So if you want to have an interesting and enjoya~
debate, attend the Code Committ'ee on Wednesday night. It gets to be-rather raucous,
I 'guess. Thank you.

COUNCILWOMAN COCHRAN: Yes, on February Bth I met with our Recreation Director
Sue Fossett and' we have now completed the goals which will be used as guidelines for
the new Southold Town Advisory Committee-Youth Advisory Committee. We feel it's -'
important that the youth--the teenage group in'the~.community have' input' as to
programming in'the Recreation Department,-and I expect tha;~' letter t° go out
requesting support from the schools this"week. We did:have scheduled On- Monday
a' meeting with the Land Use Company on the Plock' property,I which Was, cancelled,
and also a Labor Management meeting,~ which was cancelled in: the evening. I Would
just lik~ to highlight briefly, because.! think it'~ information the Town:~)ard should
be aware of, in' addition I think also the public~ I attended the' Associatioh: of Towns
in:New York and I Will,just highlight some of the comments, or capsule; .The opening
session the Honorable Stanley N; Lundine, the Lieutenant Go~er~or, spoke, 'and he
said' that the Federal Tax RefoPm will' giv~ a two billion dol'lar.~wi~ndfall to the State of
New York, and he feels that it~should be used to lower the tax~.':rates, so that all the
taxpayers of New York State- benefit 'frOm this :action. Also in: addition, ink'the opening
session the Honorable' Edward V. Regan, Comptroller of New~ Yor~k State:, was one of
the speakers, and to highlight the jis~ 'of what he' Said ' feels ~hat hZ Supports ver¥~
strongly a Constitutional Change in: legi;sl:ation so t Passes. ~ation./~
that they also pay for wha~Ithe¥ are passing. Tw States
have made this'COnstit~tiona,I cl:~ange, ~nd'he feels this
State should go. Another session ,that.-I attended, the main ~ry
Williams, who is:CommiSsioner of the DEC. To high feels
that the DEC wiii'be--and I sharecl thiS'with the Town
they will'be tightening up on thei~"regulations as far as bur as a
way of ridding ourselves of.the tO0s o~ garbage that we now that
~they still: haYe a very strong concern on the.health and is~3ues 'in re-
lation to 'emissions coming from ~he~, e plants. He suggested.that; they
make a determination as to what direction they're ' what
their waste stream is 'so that this :would be a sup
direction the town should go in:disposing of all their"refuse. :ed that
all towns take a very close look at alternate technologie§ in'addition t~o: burping. He
talked in: relation--beCause one of'our concerns, ~nd ! think I Can' SPeak liar' l:~e Board,
we feel that we will:have to go into a recycling program, in'~additiO~n to whatever method
we reach a conclusion on in' ridding ourselves of all this-garbage, but he s~id'that he
has been talking to-businesses interested in:worki!ng with both ~ecycling of Plastics and
rubber tires. The one concern that these compar~ie~ h'ave not--they're,ready to jump
right into New York State and become a part of tills recycling' process~but their one
concern is that if:New York State can guarantee t~he quantities that would make it
feasible for them to set up these businesses within: New York State. He also said:--
and I thought this 'was interesting--that we talk about recycling, but their estimate
show that 60 million dollars a year in'deposit :returns are not returned, so that tells
you how' many cans--empty cans and bottles are still:going into the landfill',-although
there is a deposit :law. Also one litt'le thing that he shared with us that he had learned
the day before, was the fact that earth worms go through the plastic'liners in' landfills
and leave lots of litl:le holes, so I don't know how they're going to solve this ~ problem,
but I thought it 'was interesting. I also attended Federal Dollars and What's-Next,
Property Taxation and Agriculture, the Assessment.of Farmland, Creativ~ Financing,
Definition of Family Exclusionary Zoning. I did: have the priviledge--being the only
one that attended the Association of Towns meetings, to serve as the D~legate rep-
resenting Southold, so I was able to attend the Annual Meeting which was held on
Monday morning. There were many State issues 'that were passed in relation to solid
waste disposal, State shared revenue. This was interesting because they do not support
revenue sharing. They feel that you send a dollar to the federal government, and in
return you may get fifty cents worth of services. They feel very ~trongl¥ that money
being collected to do and provide services on a local level, that local off~ci'als have the
expertise to get a value from that dollars worth, rather than it :going up to the top
and funneling down and not getting as much from the dollar as you may if'it was
collected locally and spent locally. So it was interesting. We felt, gee, we're-going
to go home and tell all our people that we don't support revenue sharing, but that
~v-as the feeling of your towns in~ New York State. Also, there was a r~olution in'
relat on to--as an example of veteran's benefits and other benefits that are provided.
Aga. n ~t relates to the fact that .f the State passes ~eg~slat~on that ~t should be a
burden of the State to supply, the money. They're continuing to work ,,on tort liability
and insurance, local control of mining. I have shared a copy of this~ith all Town
Board members and I.m sure Judy will have it on t~]e if you are in~ere~ted in'-seeing
all of the action that was passed 'at the Annual Meeting. I won't take ~he time to ~o

into it; but i think if-you did ask for a copy you'd find it 'very interestin~l. The~Te
is 'from time to time some critici'sm of the fact that'towns spend money to gO to the
Association of Towns, but if:You see the entire picture, the Association of Towns, we
are a member of this 'group, and they do serve as a lobby group for small towns and
villages in' relation to the State and the Federal government. I was not entirely happy
with all of the sessions that i attended that we set up for Town Board members, but
! feel the concept and the opportunity to attend has merit; and I think it 'behooves me,
which I' ~m going to do, I am going to write a letter to the Executive Director of.the
Association of Towns requesting that v~hen they set up their!agenda that it 'gives us
something more than what they presently share with us in the way of speakers. One
afternoon I took the time to attend the session for Town Attorneys--excuse me, Bob~
but I didZ-and I found that more stimu'}ating .and informative than the sessions they II~!~t
set up for ToWn Boards. So I don't think it's a matter, of the concept in'what they'~

JUSTI:CE EDWARDS: Yes, on the 12th of February the DEC visited Fishers Island.
Two of the-members came over-to check on some wetland violations, and I think they
wrote up a few things. They promised to come back on the Island, and ! don't believe
they stopped work on any job, but they did:'put some future holds on a couple of the
Projects. I also went to the Association of Towns in~ New York City, and had twelve
hours of Justice. Schooling that I have to go through every year, so it ~was fun being
down in'the City, and it was also enjoyable going to these classes and learning about
some of the new rules and regulatiohs. Also' this'afternoon two members of the Fishers
Island Garbage Commission came over here and gave a litt'le presentation on the engineer-
ing work that has been done on 'our ini;inerator plant on Fishers Island, which ! believe
is in'the permit 'stage now with the DEC, and we're going to put two in~:in~rators in
there and they're going to be down near the Airport/SChool area. I think we're a
little fHrther along than Southold Town, of course it's a rlittle smaller project, but the
Garbage' District did:get right in'there right at the beginning and they're working on
it very hard. The boys had a nic~ time coming over. They came by ferry--two ferrys
and back again~. Also down at the Association of.Towns--there's :a place outside of
Hartford, Connecticut, that recycles tires, and they buy old tires and grin~l them up
and they use them for fuel, and there was a nice demonstration that one of.these
companies had there. Also at the Association of Towns you can.meet a Iotof these
manufacturers a~d distributors and they have' their'wares and it's just educatio~J.~
see the different things' that are available--not only in publications, but also in'~hard-

It's a scale to see if'You're legal as far as clams:, scallops, crabs, and it 'floats too.

I met with you-this afternoon regarding the Declaration of Covenants and Restrictions
on John Costello's :property, which appears as Item 46 on your agenda. I am happy
to announce that the Covenants and Restrictions have been executed both by Mr.
Costello and by__the representative of the mortgagee, who is :here this evening. I
think there was one question that the mortgagee had on the consent of .the mortgagee
form, where it states that the mortgage is 'hereby subordinated to the Covenants and
RestrictiOns, and I'd like to address to the Board, and specifii:~lly Mr. Tasker, whether
or not that language would be requirC-~d, or whether just the consent without that
language would be suffid:ent? The mortgagee Would perfer not to have that language
in:there if'it'S not necessary.
TOWN ATTORNEY TASKER: Well, I have no objection to the language not being in
there. In other words that. the mortgagee jLJst consent to the covenants. I don't
know how the rest of the Board feels.

and 9117 Actually, Frank, when you call for the police, a l~oliceman, you get
your response right? If you call for the'fire dep~rtment,· ~sponse, right? · Call
for 'an 'ambulance, response, right,? So what do you need--you say that you want
to pump something through Syracuse for, and spend~ $35,000 for this'system a year,
Doesn't make sense, Frank, for this :system, and the telephone company will' probably
change a few printed boards in~ the :sub-statio~ and make a few connections'and you'll
have your system.. This 'system is :operating what we ha~e now. You're trying to hold
a budget down. tl:~zery year the budget keeps going up more. Fourteen point four
vpercent this'year. You can't keep it 'down, Frank, by doing this:-spending $35,000'
ersus $7,500,' you can't.. It's .not right. I mean, like I Sa~, you call: 911 you get
your response~ There's so' many things that we can put this:money to, Frank. We

MR. CARLIN: I know the police is~ Another important one is 'the Tax Receiver's
Department to b~e computerized. No. _ I went in: there t° pay my tax bill'i~:.J[anuary
and I looked at that contraption they've, got in'there, which i seen 32 yea~-s ago when
I come into Town. Looks like it 'come over on the Mayflower. If an' needs a
computer, that department needs a computer. If'you're going to spend
that money and put it 'into something we can use here. Bring us up to
been getting along with: 911, there's no problem. When you make the call .to
do they ask for, the Police Department, or Fire Department? ¥O'ur telephone n
your name and address. It's the Same thing you're going to go to Syracuse, so what's
the difference. What difference if:it'§ direct or goes to Syracuse? Just'to put on a
computer, to save on a computer? . Doesn't make sense. And you're talking about
$27,500 more that COuld be put to better use, and. I'd like to see it 'go to a computer,
even if you can only get one for at least the Tax Receiver's Department---and .the
Clerk's .Department, which I think they need. Think about it.' Let's start shaving -,
some m~ney in this-TOwn. The taxpayers are paying enough money. The budget is'
going up every year, and these lit¥1e things can reduce our money in ou~r budget.
When you reduce the budget you reduce the taxes. Southampton this year can go
with a zero budget, and I don't know the reason why Southold can't. So we must

SUPERVISOR MURPHY: Do you want a couple of:answers? E911 is exactly What
it 'says, is :an expanded' 911 system. It's an instant identifi~:ation of a phone caller.
It has a tremendous potential' this:town where we have a lot of old people, and if
somebody sick and panics, it 'has a tremendous potential', or an accident where
we're not sure exactly the location, will help the Police Department eliminate crank
calls, and it 'will:also help the familie§ who have latchkey children, young children
at home by themselves. .It' a oarent qot hurt, 'or if:they got scared, that they woul~i:~
be able to pick up the phone and we, the Police Department, would know exactly
where the phone was coming from. Basically that's it.~ Curt.
CURTIS HORTON: I'm here tonight to represent the Cut~hi~gue Fire Dis~ricl~. I'm
(~airman of the Board in' Cutchogue, and I just want to tell everybody, the Town
Board and everying, that we came here the other night for a presentation which was
§iven by zhe Telephone Company, and everything,, and i think it ';~as very well do.'.~.
We are very much in: favor of this :system for more than one reason. We I~ave an
independent answering service right in:our fire district, but we do get many calls
from the Police Department. A good example was last Sunday. We had a Icail last
Sunday, Bridge Lane, acciden't, upside down, roll-over. It wasn't at Bridge Lane,
it 'ended up it was in'Mattituck. If you had this Enhanced~911'the Iocatiof~ would
-have been there. Somebody COuld have been dead because of the results of this.
I mean and like that. This:is 'the main'purpose, I ~hink, maybe I'm wrong. When

you get a call--many people moving in:here, they donJt know where they ~re. I'll
go back a few years ago--I think Paul COuld vouch for this~'he used to know every-

;excited,,.they're not sure--they say, well where do you live? I don't know. What's
your street number? . I don't know. This-way here they would know. We are hoping

of years--and it' :may beour expense, which we would be willing to go for--that we

saying is :there's additional benefits to this 'that we don't realize' until you understand

have a response and people' would know where the problem is :coming from. And this
is:the problem: people get excited, they forget, they say the wrong thing, l~'he kids
can remember;I they don't give the right address an~l what ~have yo[J, and this eliminates
all that, because it~immedia~ely puts on the screen where that call is'coming from.
FRANK CARLIN: How do they know the condition of the caller. How do they know --
if'he's a fire or a heart attack?
COUNCILMAN STOUTENBURGH: At least you're going to have somebody there, Frank.
You're going to have a policeman right there.
FRANK CARLIN: What if 'somebody walks down the road from an accident three miles
and goes to a pay telephone, and dials from there and the ambulance or police or rescue
goes to that area?

Ferry 'District in the Town of Southold, Suffolk County and providing for the election

The Town Board of the Town of Southold, in~the County of Suffolk, New York,
hereby RESOLVED. (by the, favorable vote of not less than two-thirds, of all the members
of Said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in:the County of Suffolk, New York (herein:
called "Town"), is hereby 'authorized to acquire and in~tall a new radio communications'
console in: the radio room of the Police Headquarters in said' Town. 'The estimated
maximum cost of said.specifit:~object or purpose, in~:luding preliminary costs and costs
incidental thereto and the financing thereof, is'$75,000 and said:amount is hereby
appropriated therefor. ~The plan of financing inblUdes the issuance of'$75,000 serial
bonds of the Town to finance said:appropriatiofi, and the levy and collection of taxes
on all the taxable real property in' the Town to pay the principal of said bonds and
the interest thereon as the same shall become due and payable.
Section 2. Serial bonds of the Town in the prini:ipal amount of $75,000, are
hereby authorized to be issued pursuant to the provisions of the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of New York {herein
called "Law") to finance said' appropriatiofi.
Sectioh 3. The following additional matters are hereby determined and declared:
[a) The period of probable usefulness of said specifii::object or purpose for which
said' $75,000. Seria~ bonds authorized pursuant to this resoluti0~ are to be issued, within
the limitations of Section 11'.00 a. '25 of the Law, is'ten (10) years; however, the bonds
authorized pursuant to this resolution or bond anticip~tioh notes issued in: anticipation
of the sale of such bonds shall mature no later than five (5) years from the date of
original issue of bonds or note~s herein! authorized for such purpose.
(b) Current funds are not requir~ed by the Law to be providC~J as. a down pay-
ment prior' to the issuance of the bonds authorizei:t by this resolutio~ or any bond
anticipation notes issued in:anticipation thereof in' accordance with Section 107.00 d. 4
of the Law.
(c) The proposed maturity of the bonds authorized by this'resolution will not
exceed five (5) years.
Section 4. Each of the b~)nds authorized by this resolution and any bond
antici'pation notes issued in:anticipation of the sale of said bonds shall contain: the
recital of validity as prescribed by Section 52.00 of the Law and said bonds and any
notes issued in:anticipation of said~ bonds, shall be general obligations of the Town,
payable as to both prinbipal and interest by general tax upon all the taxable real
property within' the Town without limitation of rate or amount. The faith and credit
of the Town are hereby irbevocably pledged to the punctual payment of the principal
of and interest on said bonds and any notes issued in:antici'pation of the sale of said
bonds and provision shall be made annually in the budget of the Town by appropriation
for (a) the amortization and redemption of the bonds and any notes in anticipation
thereof to mature in such year and (b) the payment of interest to be due and payable
in such year. ·
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 30.00 relativ6 tO the authorization of the
issuance of bond anticipation notes and of Sectiof~ 50.00 and Sections 56, 00 to
60.00 of the Law, and powers and duties of the Town Board relativ6 to authorizi'ng
bond antici'pation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized and of any bond anticipation notes
issued i~' anticipation of said bonds, and the renewals of said' notes, are hereby
delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authoriz6d by this:resolution and of any
notes issued in.antici~pation of the sale of said:bonds, may be contested only if::
(a) such oblig~tiohs are authorized for an object or purpose for which
' the To~zn is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
the 'publication of'such resolution are not substantially complied with,
and an action, suite or proceeding contesting such validity, is commenced within
twenty days after the date of such publication, or

COUNCILMAN PENNY: Yes, I~d like to make one, as far as diV_Ulgin~g b. usiness
relationships. ! have a very casual business ~elationship with (5ostelTo raarine
contracting, and John Cestello.~.--l~l~~e¢ that anybOdy could construe ,t_o be
a conflict of inf, erest here, and al~o i ~',~;ve' no business relationship' with the propos~-d
developers or contractors on this :subdivisiOn. There are no agreements or permits
or anything in:effect that Would construe that this'Would be a conflict and that I
would gain any advantage to this'zone change. Thank you.
COUNCII~VIAN STOUTENBURGH: I'd like to make a statement here. First again; with
your indulgence, let me again reassure you my strong support for affordable housing.
Few people Could be against that. concept. On the other hand, this 'support comes
witl~ certailn restrictions attached to it.'- One would be not to overburden Greenport
water supply, that is :already pushed to its limits by new development. Also, creating
additional salt water intrusion by this;use of water into an already sensitive and limited
Greenport water area. It has been reported that the new well at Brecknock Hall has
been found to have salt in'it 'and this'well, like the proposed COstello well, was to
/booster the Gre~enport's 'limited supply of water. And three, that Costello will be
'~ sewered, which means all that sewer water will' be pumped into LOng Island Sound,
as all sewer water is~ and not go back into the ground through ceSspools,, if'the
density were one acre or more, therefore building up the water,supply below us,
and we all do this in our own homes, most of us anyway. Affordable housing should
not put additi0~al burdens on any Village resident. Examples could be where Green-
port's allocated electricitY is :bought at a ~certain rate, and should ~hey have to now,
with this"extra amount of people, pay more, that means the people in:Greenport
Village would be paying the extra burden. And lastly, we hav. e two acre zoning
proclaimed throughout this Town of'ours and should this propos~ed project go through,
it :should not go through unless all the above problems that I'~ve mentioned have been
mitigated. Now, some people might thing they have. I do not think they have. I
will:not vote again§t this, but I Will not support it.' I will'abstai.n~ I just want it
on the record that ! think people should be looking into the ~nvi~"0nmen~al:problems
that we're creating for our future residents in:this :Town, and ! realize'.ithe importance
of this so~called project with the need for housing in' this 'Town, but I do think it'
should have been in a better location where there was a much better supply of water;

J. Yakaboski Whereby they agree that during the term of the agreement they will
not represent any clients before any agencies or boards of the Town of Southold.
