Southold Town Board of Appeals
After investigation and inspection the Board finds that the
applicant proposes to erect a garage on a side yard area which is
insufficient for the purpose. The Board finds that the applicant
is the owner of a lot with 100 ft. frontage. Applicant has ample
side yard area on the easterly side of house to place garage
without a variance. There is no legal hardship. Any hardship
in this case is self imposed.
The Board finds that strict application of the Ordinance
will not produce practical difficulties or unnecessary hardship~
the hardship created is not unique and would be shared by all
properties al/ke in the immediate vicinity of this property and
in the same use district; and the variance would change the
character of the neighborhood and would not observe the spirit
of the Ordinance.
THEREFORE IT~%S RESOLVE~,, Joseph Rom~.Ro, 106-13 union
Turnpike, ~orrest H~lls, New Yo=k, be DENIED permis~ion tq
co~s~tr~ct add!t%on on existing dw%lling with insufficient
side yard area as applied for on property located on ~orth

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
,srequestedforthereasonthat: We need a garage, and the practical place for it
is attached to the dwelling. The dwelling was built prior to the zoning
ordinance on a "corner lot". Pennsylvania Ave only exists on the filed
map and is not improved. The lot falls off tward the creek on the
north making access and location for an accessory building in the rear
yar~ area impractical. The proposed addition with reduced setback in the
~e~erly side yard is the best solution to our problem.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because T~e dwelling was bu_~lt aboyt 1~ years ago- prior
to the zoniimg ordi~ante~ and .was set to take advamtage of the level
part of the iot. ~he road (~e~syl~cania Ave) has me~er been cut in
or improved and as of mow there is no pia~ ~o imy:rove it that i know
of.
~he proposed addition will not disturb my neighbor to the west as
he has give~ his approvai~ his home is built similar to this one - back
near his west line.
~e ~ia~aed the ~ ~: ' ~ ~ ~ ~, of
_ ~z~z~n to take advantage of the level r~art
o~ loto
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because ~ Th lo% ~Z'aii~ o£f tward the
creek on the northerly part of the lot o We have had fill brought i~
to ~,~i~ .... it to the prese~,t level~ ~d will have more ~,~ro~ga,z- ' ' i~ i~
the near £u,ture to help hold what we nme have.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because ~ ~he attached garage w±lZ be ~ore a~tract±¥e
"~' Th~ he,test dwelling in our area z~s an
and ~mpro'~e the neighborhood. ~' ~ ~
attached garage~ aza5_ it is much better looking.
The reduced sideyard will not harm the area as the adjoing home
on the west is set close to their west lizze and will leaz-e a large yard
between dwee!ings.
