Southold Town Board of Appeals
After investigation and inspection the Board finds that
the applicant requests permission te locate an accessory building
in side yard area. The rear yard does not slope upward enough
to interfere with the proper location'of the proposed garage in
the rear yard area as it was shown on the building permit applica-
tion. This slight inclination could be corrected by excavating
into slope of rear yard about four feet and leveling the property
off. If this application were to be granted it would be an
imposition to the neighbors on the west. The Board feels that
the owner has made an error in the location of the slab, any
hardship created is self-imposed.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary hardship;
the hardhsip created is not unique and would be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not observe the
spirit of the Ordinance, and w%%% c~n~e}t~e ,character of the
district.
Therefore, it was RESOLVED that Marjo~y Mallory & ~no.,
Fanning Road, N~w Suffolk, New York, be DENIED permission to
