The Board finds, as stated by the Building Inspector, that two families have been living in garage with less than 850 sq. ft., uo C.0., the garage has a kitchen, and is a second dwelling ou the premises. The Board finds that strict application of the Ordinance would not produce practical difficulties or uunecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood and will not observe the spirit of the 0rdiuance. We have tried many times last fall and during the winter te gaim access te the Heaceck garage te which you reffer~ but have been u~successful in finding anyone en the premises whenour inspector was there during working hours. This building is among several we are trying te get into for inspection purposes at the firmt eppertunity. Technicalities in the "search ana evidence law" are se tight new, that we must fellow strict precedured te get evidence th.at will stand up i~ Court. Otherwise the case will be thrown cut. We will check this again on our next swing through ~he Cedar Beach area. I am enclosing a maw of the oro~e~ty in G~estton and you can see that this is a direct v~lation of the Zoning Law. I would a~reciate yo~ taking the neccesa~y ste~s to prevent this b~lding being occupied as a living Guarters either on a temporary or ~ermanent basis. Thanking you for your coo~eration in the matter. The owner -occupant has consulted counsel and filed an appeal to the Soard of Appeals, which will be heard at their next meeting to be held on August 19th.
