Southold Town Board of Appeals
After investigation and inspection the Board finds that
applicant requests permission to erect a subdivision sign with
insufficient setback and side area on property located on the
north side of Hain Road, ORient, New York. The Board finds that
a condition of granting shall be that applicant may advertise
only the subdivision description, the Agentts telephone number,
and may not advertise the name of the real estate broker, in this
case, Wetmore.
The Board finds that the public convenience and welfare and
justice will be served and the legally established or permitted
use of neighborhood property and adjoining use districts will
not be permanently or substantially injured and the spirit of
the Ordinance will be observed.
THEREFORE IT WAS RESOLVED George Wetmore, Main Road, Greenport,
New York, be GRANTED permission to erect a subdivision sign with
insufficient setback and side area on premises located on the
north side of Main Road, Orient, New York, subject to the conditions
which apply to all signs in the Town of Southold, as follows:
One sign, either single or double faced, not exceeding
twenty four (24) square feet in size advertising the sale
or lease of acreage.
The sign to be erected no closer than 25 feet to the Main
Road; no closer than the westerly side entrace to Petty 's
Bite Estates; and no closer than 2 feet to the Okula property
to the west.
The applicant may advertise only the subdivision description,
PETTYIS BITE ESTATES, waterfront, etc., and Agentis telephone
number.

SUBSECTION LOCATION: "Petty ' s Bight Estates" at Orient
Subdivision map on file.
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE applicant would be prohibited from
doing any on site advertising. The premises on Main Road is only
approximately 55 feet wide. Applicant is therefore unable to comply
with the ordinance which requires that a sign advertising the sale or
lease of acreage or lots have a continuous frontage of 500 feet or more .
The aforementioned 55 feet will be a road leading into the property
being advertised for sale.
Applicant is also unable to comply with the ordinance which
requires that such a sign be set back from either side line by 10
feet.

it is also requested that applicant be granted a variance of
the requirement of requiring a 10 foot set back from side lines.
To deny this application would subject the applicant to un-
reasonable and undue hardship. He would be strictly limited in the
type of advertising available to him regarding this property for all
practical purposes would be unable to do any on site advertising.
