Dated ...................................................................... REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 (~) A Variance to the Zoning Ordinance ( ) is requested for the reason that the applicant desires to operate a plumbing shop as close to home as possible due to family health problems. Also the existing building is a dilapidated eye-sore which if re~_aovated would improve the loo~s of the property and neighborhood. Fo~m ZB1 (Continue on other side) REASON FOR APPEAL Continued I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHll~because applicant desires to continue earning livelihood in the only trade in which he is trained, at the same tLvie to keep a frequent check on his wife's health. 2. The hardship createdis UNIQUE andisnotshared by all pr~erties aJike in the immediate vicinity ofthisproperty and in this use district because no one else in the l~med±~te vicinity c~n meet the conditions for reinstatement of non-conforming business. 3. The Variance would observe ~e spirit ofthe Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the adjoining property is zoned business. Also no appreciable change in traffic in the neig~borhood since there will be no over-the-counter sales. Being a one man business operation the neighborhood will not be disrupted. PHELPS October 19~ 1970 Zoning Board of Appeals Southold Suffolk County Long Island~ New York Att: Mr. Howard Terry~ Building Inspector Re: October 22nd Hearing Regarding John Figal~s Variance Application Dear Sirs: If it were possible to grant this variance only to John P. Figal for his exclusive and personal use~ and if this structure were to be demolished when he no longer h~d use for i% then I would look upon the application with favor. Since this is not possible~ I am compelled to object for the following reasons: 1. This variance would establish a business in a residential area. 2. This tt-pe of business could create objectionable noises~ odors and traffic. 3. There is no limitation upon the amount of business conducted therein or upon the size of the building in which it might be con- ducted~ nor its location~ which is at present in close proximity to my residence. 4. There is no knowledge of who might become successor to Mr. Figal's business. 5. This would establish a wholly undesirable precedent which would depress adjoining property values and seriously interfere with the purposes for which my property was acquired~ namely~ as a residence in a quiet and peaceful neighborhood strictly zoned for residential purposes. ~tOWe C.
