TERMS AND CONDITIONS The Permittee Palmer&Nan E Schade residing at 1385 Calves Neck Road, Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. SCHADE 1385 CALVES NECK ROAD, SOUTHOLD SCTM# 1000-63-7-36 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 18, 2022 regarding the above matter: WHEREAS, En-Consultants on behalf of PALMER & NAN E. SCHADE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 1, 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 18, 2022 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of PALMER & NAN E. SCHADE to remove and replace existing dock (including 2'-3'x70' catwalk, and 6'x36' and 4'x24' floats), with a new dock connected to water and electricity consisting of a 4'x93'fixed timber catwalk constructed with open grate decking with two (2) 4'x6' steps for beach access; the existing relocated 2.5'x16' aluminum ramp; and a 6'x20' floating dock situated in an "L" configuration secured by two (2) 8" diameter pilings, and adjusting existing 3'x10' stair to dock if needed to align with new catwalk; and as depicted on the site plan prepared by En-Consultants, dated March 29, 2022 and stamped approved on May 18, 2022. Located: 1385 Calves Neck Road, Southold, SCTM# 1000-63-7-36 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. Wetland Permit for a dock structure was issued in 1983 (110) and in 1990 (1596) authorizing access to public waters. The applicant is seeking authorization to rebuild a dock;structure not in compliance with the original permits. The existing dock is significantly longer than intended. The applicant fails to prove that the action meets the following requirements as outlined in § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. And a dock has been present on the subject property since it was originally constructed pursuant to Wetlands Permit No. 110, issued by the Town Board in March 1983,and repaired pursuant to Southold Trustees Permit No. 1596,issued in April 1990. However,the existing dock configuration,though present for more than 20 years,does not conform to the specifications of the original permit or to the dock construction and operation standards set forth by Section 275-11(C)(2)of the Town Code. Therefore,the proposed project seeks to replace the aging,existing dock with a new dock that meets these standards. To that end,the proposed dock has been designed for consistency with the existing"pier line"established by the seaward limits of the surrounding docks;the dock and associated watercraft would extend seaward a distance well less than one-third the 470-foot width of the waterway; and the dock would be positioned at least 15 feet from the laterally extended easterly property line. Additionally,the proposed float would rest in water at least 30 inches deep at mean low tide;and although there is no wetland vegetation present at the dock site,the catwalk would be elevated above the intertidal area and constructed with untreated,open-grate decking so as not to inhibit the potential future growth of marsh vegetation beneath it. SCHADE 1385 CALVES NECK ROAD SOUTHOLD,NY SCTM#1000-63-7-36 Policy 6 The proposed dock would be located along a historically developed shoreline, amongst numerous Trustees-permitted dock structures, including the adjacent docks to the west and east. And a dock has been present on the subject property since it was originally constructed pursuant to Wetlands Permit No. 110, issued by the Town Board in March 1983, and repaired pursuant to Southold Trustees Permit No. 1596, issued in April 1990. However, the existing dock configuration, though present for more than 20 years, does not conform to the specifications of the original permit or to the dock construction and operation standards set forth by Section 275- 11(C)(2) of the Town Code. Therefore, the proposed project seeks to replace the aging, existing dock with a new dock that meets these standards. Additionally, the proposed float would rest in water at least 30 inches deep at mean low tide; and although there is no wetland vegetation present at the dock site, the catwalk would be elevated above the intertidal area and constructed with untreated, open-grate decking so as not to inhibit the potential future growth of marsh vegetation beneath it. Thus, consistent with Policy 6, the project would not create a "fragmentation of ecological communities" along the developed shoreline; result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the adjacent tidal wetlands or surface waters of Town Creek.
