Location of property: private right-of-way (Majorts Path) off east side of Horton Lane, Southold, NIN York, bounded north by Overton, Fisher & others, west by Horton Lane. Fee paid $5.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE Al �trtvVLD ZONING BOARD OF APPEALS FORM ZB4 Marjorie McDermott, Secretary Southold Town Board of Appeals After investigation and inspection the Board finds that applicant requests permission for approval of access over private right-of-way in accordance with the State of New York Town Law, Section 28OA. Location of property: private right-of-way (Majorts Path) off east side of Horton Lane, Southold, New York. The Board finds that the right-of-way is being improved and widened so as to meet requirements of access under 280-A of the Town Law and that this access will serve only a minor subdivision. Upon inspection of the Board it was found that the road will enable emergency vehicles to get in and out up to this parcel. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE, IT WAS RESOLVED 011ie Overton, Main Road, Southold, New York, be GRANTED approval of access over private right-of-way in accordance with the State of New York Town Law, Section 280A on property located private right-of-way (Major' s Path) off east side of Horton Lane, Southold, New York, subject to the following conditions: 1. (There was no response. ) a After investigation and inspection the Board finds that applicant requests permission to erect water town (accessory structure) with height in excess of 50 feet. The findings of the Board are that applicant is going to erect a Hill's Supermarket, seven or eight individual stores and a moving picture house which will necessitate fire protection for life, limb and property and a water tower will provide adequate protection for applicant's tenants. The Board is in agreement with the reasoning of the applicant. I r THE CHAIRMAN: Is there anyone present who wishes to speak for this application? lit. EUGENE L. FISCHER# JR. : I am one of the owners up there and one of the people who has been doing the work. .. Mr. O'Connor also. The access is coming up from Horton's Lane. ,R. OICONNOR: I live 150� fset up on the north side. !-Is have access. We have been living there for three years. MR. PISCHER: My property from the upper border is about 200 feet further on. I don't know if this would have any bearing but I have been in touch with the Telephone Company and they said that they had no problem putting poles in and would come in without additional charge. THE CHARMANI I am sure you know what the reasoning is, because of fire emergency vehicles. We were up there looking at it this morning and it looks to me that you have improved it. MR. COMERPORD: In what way is it going to be changed? It looks now as though there is an entrance. Major's Path connects with a private road. THE CHAIRMAN: We are not granting access from the whole road t to further prdperties. Any access we grant would be subject to L approval of the Building Inspector. 1,1R. CO1,1ERFMD: Have you anything that I can look at that qualifies how access is proposed to be amended? I understand the Planning Board granted a minor subdivision and they require 50 feet. THE CHAIRMAN: 50 feet has been provided in the proposed plan. 111t. BERGEN: That doesntt mean it's going to be hard top. JIRS. XEM Y: When we bought the property there we paid $100.00. MR. THOMS KELLY: The owner asked if we would contribute toward the road. THE CHAIRMAN: In Riverhead they require blacktop. IM. C019ERF0RD: There is a question as to whether or not this is an access road. When Mr. Offenheiser's road was built all the building miLterials were brought up that road. On. the question of fire apparatus, that's no problem. We have been using it for seven years.
