SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection .................... paragraph .................... of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 8315 P.M. (E.S.T.), upon application of Mary Hallock O'Donovan, 405 C Heritage Village, Southbury, Connecticut, for approval of access over private right-of-way in accordance with the State of ,New York Town Law, Section 280A. Location of propertys south side of private right-of-way, Pvt. Road # 17, Mattituck, New York, bounded north by-private right-of-way, Pvt. Road # 179 east by George Lascelle, south by Great Peconic Bay, west by T. Carpenter. Fee paid $5.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE —J ZONING BOARD OF APPEALS FORM ZB4 ,/G L(f- } iar joile McDermott, Secretary Southold Town Board of Appeals After investigation and inspection the Board 'finds that applicant requests approval of access over private right-of-way on property located south side of private right-of-way; Pvt. Road # 17, Mattituck, New York. The Board finds that applicant possesses a long, narrow lot which can be divided under the present Ordinance into two parcels which will satisfy the square footage requirements of the present Zoning Ordinance. The lot Is approximately 310 ft. x 44* ft- to a private right of way to the north and slightly wider at the point of division, as described in the sketch, so as to create two lots of 14,000 sq. ft. each. The Board finds that strict application of the Ordinance will produce practical difficulties o�r,,�nnecessary hardship; the hard- ship created is unique and wouldf a shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the cb=agter oX the district. THEREFORE IT WAS .RESOLVED Mary .Rallock O'Donovan, 405 C Heritage Village,Southbury, -Connecticut, be GRANTED apprpval of access over -private right-of-way on property located south side of private right-of-way, Pvt. Road # 179 Mattituck, New York, subject to the following condition: The driveway shall be n0 less than 15 feet in width extending from the private right-of-way on the north to the newly created southerly lot running parallel and adjacent to the easterly line of the property.
