Goggins & Donna M Goggins PROPERTY LOCATION: 2000 Jackson Street,New Suffolk,NY SCTM# 1000-117-10-17 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated 3/2/2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION- The subject property is a non-conforming 10,448 square foot parcel located in an R-40 Zoning District. The parcel is a corner lot which runs 101.44 feet along the northerly property line fronting Jackson Street, runs 102.24 feet along the easterly property line fronting Fourth Street. The parcel runs 103.10 feet on the South side and 102.13 feet on the West side. The parcel is improved with a two-story frame house with attached covered deck and deck on grade, a one-story frame cottage, and a frame garage. All is shown on a survey prepared by Kenneth M. Woychuk, dated February 8, 2022. BASIS OF APPLICATION: Request for a Variance from Sections 280-124; and the Building Inspector's December 3, 2021 Amended January 11, 2022 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool, at 1) more than code permitted maximum lot coverage of 20% located at 2000 Jackson Street, New Suffolk,NY SCTM# 1000-117-10-17. RELIEF REQUESTED: The applicant requests a variance to construct an in-ground swimming pool that will result in lot coverage of 26.3 % where town code permits a maximum lot coverage of 20%. ADDITIONAL INFORMATION• The applicant testified that the one-story frame cottage on the property was built before 1957 and qualifies for a pre- Certificate of Occupancy. The Board informed the applicant at the hearing that a Pre-CO. Must be obtained for the cottage prior to the issuance of a building permit. The property has the benefit of CO Z176130 dated 21/23/88 for Page 2,April 21,2022 #7649, Goggins SCTM No. 1000-117-10-17 the accessory garage; CO Z14234 dated 2/19/86 for the foundation of a single-family dwelling; and CO Z19665 dated 1/18/91 for a porch addition to a single-family dwelling.No CO for the single-family dwelling is on record On February 23, 2022, the applicant submitted a site plan prepared by Nigel Williamson, Architect, dated January 20, 2022, depicting the proposed lot coverage at 26.275% with a proposed swimming pool measuring 16 ft. by 32 ft. On March 4,2022,the applicant submitted a survey prepared by Kennith M. Woychuk, L.S., dated February 8,2022 depicting the pool size at 16 ft. by 36 ft., but without lot coverage calculations. The applicant submitted several prior variances in support of the application. Variances relevant to this application are ZBA Variance#6127 for lot coverage of 23.4 percent and ZBA Variance#7272 for lot coverage of 28.4 percent. The other lot coverage variances submitted were in a different zoning district than the subject application or were not located in a close proximity to the subject parcel. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood that consists of single- family homes that were built prior to zoning. There are parcels in the neighborhood with improvements which exceed lot coverage. The pool is not a raised structure and will not, for the most part, visibly impact the street because of the massing of existing structures on the parcel,the existence of a masonry wall on the side property line,which will be supplemented with solid wood fencing or a masonry wall and/or landscape screening as conditioned herein. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The current lot coverage on the parcel is 20.762%. Any proposed improvements to the parcel will require the benefit of variance relief. The current structures were constructed prior to zoning. 3. _Town Law 6267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 31% relief from the code. However, the pool is for an in-ground structure and not a three-dimensional structure that would visibly impact the road frontages. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,April 21,2022 #7649,Goggins SCTM No. 1000-117-10-17 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Nigel Robert Williamson, Architect, last revised January 21, 2022, showing lot coverage at 26.275%. SUBJECT TO THE FOLLOWING CONDITIONS• I. The applicant must apply for and obtain Pre-Certificates of Occupancy or Certificates of Occupancy to legalize the as built cottage and the as built single family dwelling currently located on the premises prior to receiving a building permit for the in-ground swimming pool. 2. The applicant shall submit an updated survey by a licensed land surveyor depicting the proposed 16 ft. by 36 ft. pool size and total lot coverage calculations of 26.275% prior to receiving a Certificate of Occupancy for the pool. 3. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 4. Drywell for pool de-watering shall be installed. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimus in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted.
