SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION• The subject property is a non-conforming 12,000 square foot parcel located in an R-40 Zoning District. The parcel runs 100.00 feet along the northerly property line fronting Captain Kidd Drive. The parcel runs 120.00 feet on the East side, 100.00 feet on the South side, and 120 feet on the West side. The parcel is improved with a frame dwelling and one-story garage. All is shown on a survey prepared by Robert W. Ott, L.L.S. last revised August 21, 2021. BASIS OF APPLICATION: Request for Variances from Sections 280-15; Article XXIII, Section 280-124 and the Building Inspector's September 2, 2021 Notice of Disapproval based on an application for a permit to legalize an accessory garage and roof over rear patio attached to an existing single-family dwelling; at 1) located less than the minimum code required rear yard setback of 5 feet. 2)located less than the code required minimum side yard setback of 5 feet; 3) more than the code permitted maximum lot coverage of 20% located at: 705 Captain Kidd Drive, Mattituck, NY SCTM No. 1000-106-5-8. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built roof over rear patio"and "as built shed". The shed is located 4.5 feet from the rear yard line and 2.8 feet from the side yard line where town code requires a minimum 5-foot setback from the side yard line and rear yard line. The lot coverage resulting from the roof over the rear patio and the shed is approximately 25% where town code permits a maximum lot coverage of 20%. A Site Plan prepared by Mark Schwartz, Architect, indicates 24.9% lot coverage. ADDITIONAL INFORMATION: The parcel has the benefit of Certificate of Occupancy No. 1514 for a private one family dwelling; Z5318 for a private one family dwelling; and Z5319 for an Accessory building. The applicant's Page 2,April 21,2022 #7608,Thirkield SCTM No. 10.00-106-5-8 agent testified that the accessory building listed in the Certificate of Occupancy is different than the subject accessory building. Site inspection and photographic evidence submitted by the applicant showed a second shed on the parcel which is not on the survey. Since this structure will add to the existing listed lot coverage the applicant's representative agreed that it should be removed. In support of the application the applicant's agent submitted seven prior ZBA variances. None of the submitted variances are on the same block as the subject application and are not close enough to the subject parcel to be considered character of the neighborhood. 1) ZBA file number 3704 for 28.2% lot coverage concerned a water front parcel making improvements to prevent erosion in 1988. The improvements were part of a retaining wall and grading system that was built to prevent further erosion. The deck was an open air deck that is open to the sky. 2) ZBA file # 4259 for 27% lot coverage. That lot is much smaller than the subject lot and the variance was granted for open air structures that will not be visible from the street. 3) ZBA file#5101 is for a lot coverage of 22.69%which is a much smaller request than the subject application and it is for an accessory swimming pool which is not a raised structure. 4) ZBA file# 5888 is for an accessory swimming pool which is not a raised structure. 5) ZBA file# 6543 is for 22.5 percent lot coverage is a for an open-air stone terrace. 6) ZBA file# 3951 is for 25.5% lot coverage is for an open-air deck. 7) ZBA file# 3957 is for a deck with a side yard setback of 1 %2 feet. The applicant's agent stated that the"Roof over patio" is to support the solar panels for which no building permit nor a Certificate of Occupancy is on file. However,the agent could not say why the solar panels could not be placed on the roof of the house. The Board received a letter of support from a neighbor FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of the variance for the non-conforming rear yard setback and non-conforming side yard setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The"as-built"shed is in the same location of an existing shed that had the benefit of a certificate of occupancy. The grant of the variance for the non-conforming lot coverage will produce an undesirable change to the character of the neighborhood. The neighborhood is an older neighborhood that consists of improved parcels with conforming lot coverage. Non-conforming lot coverage in the area was previously granted for low impact flat, low to the ground structures such as decks and pools and not for bulky, three-dimensional raised structures such as garages, sheds and roofed-over patios. 2. _Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could move the "as-built" shed to a code conforming location. The applicant has applied for a building permit for a front covered porch and it says on the building permit that the applicant will comply with lot coverage requirements. 3. Town Law &267-b(3)(b)(3). The variances granted herein for the rear yard setback is not mathematically substantial, representing 10% relief from the code. The variance granted herein for the side yard setback is mathematically substantial representing 56% relief from the code. The variance denied herein for lot coverage is Page 3,April 21,2022 #7608,Thirkield SCTM No. 1000-106-5-8 mathematically substantial representing 20% relief from code. However, the variances granted for the side yard setback and rear yard setback are for a shed that replaces an existing shed that had a certificate of occupancy. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law&267-b(3)(b)(5). The difficulty has been self-created. The applicant made the improvements without applying for building permits. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief for the shed's side yard setback and rear yard setback is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of the requested relief for the non-conforming lot coverage is not the minimum action necessary and adequate to enable the applicant to enjoy a shed and roof over porch. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to GRANT the variances to legalize the"as built"shed having a side yard setback of 2.8 feet and rear yard setback of 4.5 feet as applied for, and DENY as applied for the non-conforming lot coverage. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. This approval shall not be deemed effective until the required conditions have been met. At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing,two sets of the final site plan or survey, architectural drawings, with a recalculation g lot coverage etc., conforming to the relief granted herein. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. At the time of the Board's decision, we afforded the applicant the right to choose how to reduce the excessive lot coverage on the subject property to a conforming 20%, and the Board's assumption about the applicant's options to do so were not limited to the removal of one or the other of the two "as built" accessory structures in order to comply. However, it appears that the applicant chose to demolish the "as built" accessory garage only, leaving a remaining 20.8% lot coverage. During the Zoning Board of Appeals Regular Meeting of April, 6, 2023, the Board determined that it is reasonable to allow less than 1% above the conforming lot coverage to remain, and therefore, has determined that the non-conforming lot coverage is de minimus in nature. The Board under Findings and Fact Reasons for Board Action: 6 Town Law 267-b "Grant of the requested relief for the non conforming lot coverage is not the minimum action necessary and adequate to enable the applicant to enjoy the shed and roof over porch. There was never a discussion that the applicant consider removing either the shed or the roof over porch as a "minimum" action .necessary to be in greater conformance with the 20%maximum lot coverage. By granting relief for the shed and denying the coverage, the Board left in place the coverage violation.The applicant has been left in the position of deciding how to meet the " minimum" action necessary to enjoy the shed and roof.There is no way to meet that standard without removing either the shed or the roof.The applicant chose to remove the shed, thereby eliminating two(2)variances granted by the Board. Even with the shed's removal, the remaining lot coverage with the"as built" roof is 20.8%, or 96 SF greater than the maximum lot coverage allowed.The only way left to the applicant is to go before the Board for a variance for Lot coverage to legalize the roof over porch and prove ( as the Board so stated), is the minimum action necessary to legalize the roof. ` On January 9, 2023, Leslie sent me a letter rejecting my application on the basis that "all relevant information" Had already been presented.This is not the case.There was no discussion as to an alternative to minimizing the amount of lot coverage requested and they explicitly concluded that the request for a variance for lot coverage was not the minimum,which would allow us to return with an application that proposes to prove to the Board the applicant has taken an action that would allow him to enjoy the roof over shed. Based upon all testimony, documentation, personal Inspection of the property,and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant requests that an existing garage be allowed to remain, built under Building Permit No. 31420. The setbacks of this garage building are 4.2 feet and 5.2 feet from the side yard measured at both corners. Also rioted in the Building Inspector's denial of a building permit is a new in-ground swimming pool that was added to the site,'and not shown on the survey submitted to the building department. For the record, it is noted that: Page 3 - Appl. No. 39571 Matter of CHRIS MESKOURIS & ORS Decision Rendered October 17, 1990 (a) the subject premises are nonconforming not only as to lot area and width but is believed to have been improved with a dwelling structure built during or before 1960; (b) lots in the immediate vicinity of the subject premises to the west and east are of a similar size in this preexisting subdivision of Cpt. Kidd Estates; (c) the total lot area, to the ordinary highwater mark of the Long Island Sound, is shown to be 15,096 sq. ft. (d) the total coverage of the lot, with the proposed deck, is 2320+- and a variance is not necessary since the total coverage of the parcel by buildings is less than the maximum 20% of lot area to the highwater mark. 7. In considering this application, the Board also finds and determines: (a) the relief as granted will not in turn increase the dwelling unit density, since the parcel is believed to have been improved with a dwelling before 1960; (b) the evidence submitted and practical difficulties claimed are sufficient to warrant a grant of this variance; (c) there will be no substantial change in the character of the immediate neighborhood or detriment to adjoining properties; (d) the difficulties cannot be obviated by some method -feasible to the appellant to pursue, other than a variance; (e) that similar relief was granted to County Tax Map Lot 1000-106-1-35 (Subdivision Lot 37) located immediately to the west of this parcel; (f) that in view of the manner in which the difficulties arose, and in considering all the above factors, the interests of justice will be served by granting the variance, as conditionally noted below.
