SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION• The subject property is a non-conforming 15,625 square foot parcel located in the Residential R-40 Zoning District. The property is a corner lot with the address on Gin Lane which runs along the northeast property line and measures 125.00 feet, the southeasterly property line measures 125.00 feet, the southwest property line measures 125.00 feet and the northwesterly property line measures 125.00 feet and is adjacent to Mid Way. The parcel is improved with a single-story frame dwelling with an attached single-car garage which fronts on Mid Way. At the rear of the residence is an attached wood deck with a railing and stairs from the deck to a brick landing. There is a 10.2 ft by 14.2 ft shed located in the rear yard as show on the survey map prepared by Tamara L. Stillman, LS, and last revised September 14, 2021. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15; and the Building Inspector's October 22, 2021 Notice of Disapproval based on an application for a permit to construct an accessory in-ground swimming pool; at 1) located in other than the code permitted rear yard; located at 735 Gin Lane, Southold, NY. SCTM#1000- 4-7. RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool in the front yard upon a parcel having two front yards. The Town Code requires Accessory buildings and structures or other accessory uses shall be located in the required rear yard ADDITIONAL INFORMATION: During the public hearing,the applicant's representative indicated that there were two prior comparable ZBA decisions issued to neighboring properties; #7499 and #7515, both of which approved a side yard location for inground swimming pools. Three letters of support were received from the applicant's neighbors. Page 2,April 21,2022 #7610, Kasper SCTM No. 1000-88-4-7 FINDINGS OF FACT/REASONS FOR BOARD ACTION• The Zoning Board of Appeals held a public hearing on this application on April 7,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 12267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family homes. The subject parcel is a corner lot and has two fi•ont yards. The property on the Gin Lane side where the pool is proposed to be located has dense, mature evergreens and other landscape plantings, which will remain, with more evergreen vegetation screening to be added which will ensure that the pool will be well hidden and give the applicant complete privacy in the pool area that, although designated a front yard, is actually the applicant's "architectural"rear yard. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the fact that this parcel has two front yards and the existing septic system is located in the rear yard, along with an existing shed and fire pit, there is no other location for the pool other than the site chosen. Recent decisions by this Board; Appeal #7515 and Appeal #7499 similar to this appeal were granted. 3. Town Law$267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, due to the issue of a corner lot with two front yards, the applicant has no other options available to locate the proposed swimming pool. The existing sanitary system is located in the rear yard making it impossible to locate the pool in that area. In addition, the proposed 12 ft. by 30 ft. pool is not a large, and will be completely screened from public view by existing mature landscaping Further, the proposed pool will be set back from Gin Lane a substantial 30 feet (19.4 ft. from the property line) and 24.5 feet from the side property line which will further reduce any impact to the street or the adjoining property. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(N(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the survey map prepared by Tamara L. Stilllman, LS, and last revised September 14, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Additional evergreen screening shall be planted and maintained as proposed by the applicant and shown on the survey prepared by Tamara L. Stillman,LS, cited above. Pool pump equipment/mechanicals must be located a minimum of 20 feet from any property line or be contained in a shed type enclosure with a lot line set back that is in conformance with the bulk schedule for accessory structures. 3. Drywell for pool de-watering shall be installed. This approval shall not be deemed effective until the required conditions have been met. At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or apossible denial by the Building Department of a buildingpermit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities tinder the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and require a new variance application with public hearing before the Board of Appeals Vote of the Board: Ayes: Members Weisman(Chairperson) Dantes, Acampora, Planamento and Lehnert. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family homes. The subject parcel is a corner lot and has two front yards.A 12-foot-wide Right of Way along the easterly side yard effectively operates as a third front yard. The applicant proposes to place the swimming pool behind two corners of the house so that the house screens the pool from both Main Bayview Road and Koke Drive. If the applicant were to place the swimming pool in a code conforming rear yard location it would be more visible to the neighborhood than in the proposed location. The existing greenhouse is a 6 x 10-foot transparent structure. Koke Drive is a private road that does not have much trafc. The non-conforming front yard location of the greenhouse will not affect the character of the neighborhood. The property is heavily screened from view from both streets by mature landscaping and natural vegetation. 2. Town Law$267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could place the swimming pool in a code conforming location and demolish the greenhouse,move,rebuild it in a conforming location 3. Town Law 4267-b(3)(b)(3). The variances granted herein is mathematically substantial,representing 100%relief from the code for both the swimming pool and the greenhouse. However,the proposed swimming pool location will be behind the front of the house which is facing Main Bayview and in the"architectural"rear yard where there is the greatest privacy because it will be Iess visible to the neighbors than a code conforming swimming pool location. The 6 x 10 glass greenhouse is a passive structure that is transparent and only used to grow plants and has existed in its current location without adverse impact for many years. 4. Town Law 5267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and greenhouse while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings; 1. Town Law 5267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed pool will be at grade towards the rear of the house and will be screened from view by mature landscaping. Due to the odd shaped lots in this neighborhood, the large setback from North Bayview,and the waterfront nature of the parcel it will not produce an undesirable change in the neighborhood. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The irregular shape of the property,the location of the tidal wetland boundary at the rear of the property, and the location of the existing sanitary system in an alternative conforming front yard on this waterfront parcel restricts the applicant from placing a pool in a conforming location. 3. Town Law 5267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However,due to the odd shape of the property,the proposed placement of the pool is most practical and reasonable with regards to setbacks from tidal wetlands and privacy from neighbors; Additionally,the setback of the proposed pool from North Bayview is approximately 150 feet and is located in the applicant's architectural rear yard.Locating the pool closer to the Tidal Wetland boundary,in the rear yard and adjacent to Goose Creek,may create adverse impacts. 4. Town Law 5267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions set by this board. 5. Town Law 5267-bQ(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
