paid by the party of thpart, does hereby grant and release unto the party of the s Gond part, the heirs
or successors and assigns of the party of the second part forever, an undivided 1710 interest
and to
that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being im to on Lupton' s Point in Mattituek, Town of Southold,
County of Suffolk and State of New York and bounded and described
as follows:
BEGINNING at a point on the southerly side of a Private Road,
running from Marratooka Lane (Road) to Deep Hole Creek, distant
1218.07 feet easterly from the corner formed by the intersection of
the said southerly side of said Private Road with the easterly side
of Marratooka Road (Lane); and which said point of beginning is
where the division line between premises herein described and land
of R. S. Barker intersects the said southerly side of said Private
Road; running thence North 790 45' 10" East, along the southerly
side of said Private Road, 100 feet to land of J. J. Perkins;
thence South 100 14' 50" East, along land of J. J. Perkins, 203
feet to Deep Hole Creek; thence westerly along Deep Hole Creek to
land of R. S. Barker; thence North 100 14' 50" West, along land of
R. S. Barker, 220 feet to the southerly side of said Private Road
at the point or place of BEGINNING.
TOGETHER with a right-of-way over the Private Road, to and from
the rear of the premises hereby conveyed to Marratooka Lane (Road),
and over said right-of-way, to and from the rear of the premises
hereby conveyed to Deep Hole Creek on the end of the Point.
BEING THE SAME PREMISES conveyed to Burton E. Mason and Anne C.
Mason by deed dated April 28, 1961, recorded May 2, 1961, in Liber
4980 cp 578, the said Burton E. Mason having died testate a resident
of Suffolk County, New York, on May 19, 1974.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the I-ien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
