The Commissioners were aware of your list of items as set forth in your letter of May 19, 2022 to Mr. Kito. After reviewing the matter with Mr. Kito the Fire Commissioners were surprised as to where he was actually proposing to locate the cell tower on the Fire District property. After discussion the Commissioners decided that the tower could not built in the proposed location. The reason it cannot be located in this location is because this area is used frequently throughout the year for firematic purposes . It is used for: fire hose and aerial ladder training; the primary landing area for helicopters providing medical and other emergency transfers to hospitals; staging area for LIPA for emergency service vehicles during times of severe storms and hurricanes; community events such carwashes, children' s Easter egg hunts, Santa Claus helicopter arrival reception area at Christmas time; disbursement area for the Cutchogue Fire District 5k run; and most important, the tent area for seating at the annual Fire Department Chicken Barbeque . Further, for the next two years, this area will also be used as a staging area for contractors and their materials as the Fire District is planning next spring to commence construction of their recently approved firehouse. The Commissioners do want a tower that will provide communication coverage for the entire Fire District and assist the Police Department in improving their communications and to provide better cell phone service for the residents . The application is considered incomplete until payment is received and application materials have been sufficiently provided as detailed below. Pursuant to §280-74A(d) of the Town Code, the Planning Board will hire a Technical Consultant to aid in the review of the application and hereby requires the submission of$8,500.00 into an escrow account with the Town Comptroller's Office to cover the cost of the Technical Consultant's review. ❖ Please remit a check in the amount of$8,500.00 payable to the Town of Southold to the Planning Department. Any unused portion of the Technical Consultant's Fee will be returned to you. Sheet Z-01 of the Construction Drawings (CD): Site Information indicates "Zoning/Jurisdiction" as the Town of Cutchogue. This needs to be corrected to the Town of Southold. 2. Section 280-70.D(1) and (2) Location of Wireless Facilities: CityScape was not provided relative information to review these standards of the Code. The Applicant states, "Further review of priority ranking provided as part of application submission". Please provide these materials for CityScape's review. 3. Section 280-70(G) Fall Zones: Applicant is proposing a 140' concealed tower. The Code requires a fall zone of two times the height of the tower for a total fall zone of two hundred and eighty (280) feet. The Applicant is showing a fifty-eight (58) foot distance from structures on the property and is requesting a variance from this standard. The Applicant indicates a structural report is provided as part of the application. CityScape has not received this document. Please provided the structural analysis for CityScape to review. 4. Section 280-70(H) Federal Aviation Regulations: This item is not addressed: The Applicant needs to address this Code section is writing. 5. Section 280-70(I)(2) Maximum Height: The maximum height allowed is eighty (80) feet. The Applicant is requesting a sixty (60) foot variance. CityScape has not received any documentation to justify the proposed height needed for the tower so an opinion cannot be provided on the need for the height and requested variance: The Applicant needs to address this item in greater detail. 6. Section 280-70(I)(3) Minimum Distance: The minimum to adjacent residential property lines or streets is no less than 500 feet. The proposed distance is fifty-eight (58) feet and the Applicant requests a variance from this standard. The Applicant needs to demonstrate the need for a tower in this location and that no other properties are available that can meet the distance separation requirements of the Code. 7. Section 280-70(K) Radio Emissions: This item is not addressed. The Applicant needs to address this item in writing. 8. Section 280-70(L) Structural Inspection Report: This item is not addressed. The Applicant needs to address this item in writing by stating they will comply with the Code in the future should the application be approved, and the tower constructed. 9.
