For a Variance to the New York State Uniform Fire Prevention and Building Code DECISION PETITION NO. 2002-1334 Upon the application of Robert O'Brien, P.E., filed pursuant to 19 NYCRR 450 on December 24, 2002 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to alterations to an existing one-family dwelling (Al occupancy), of type 5b (wood frame) construction which is located at 4450 North Bayview Road, Town of Southold, County of Suffolk, State of New York. Relief is requested from: - 9 NYCRR 71t.2(b), which requires that recreation rooms and toilet rooms have a minimum height of seven feet. [The petitioner requests that a recreation room and toilet room be permitted with less than the required ceiling height.] FINDINGS OF FACT 1. Four rooms and a bathroom were constructed in the cellar of the building without the benefit of required permits. 2. The petitioner proposed to remove the subdividing walls in order to create one large recreation room and a bathroom within the finished portion cellar space. 3. The ceiling height throughout the cellar space varies from a minimum of approximately 6 feet 11 inches to a maximum of 7 feet 2 inches. 4. The difference between the requirement of the code at 9 NYCRR 711.2(b) and the minimum ceiling height proposed is 1 inch. This represents a difference of approximately 1 percent and is considered to be diminimus. 5. There are utility pipes and a sloping soffit adjacent to a wall which reduce the headroom clearance within the cellar. The code official considers the reduction in head room caused by these items to be a violation of the ceiling height requirement. Petition No. 2002-1334 Page 2 6. The headroom clearance of the pipes is approximately 6 feet 8 inches. The soffit slopes through a horizontal distance of less than 2 feet from a height of approximately 7 feet to a height of 5 feet 10 inches where the ceiling meets a wall. The headroom reductions caused by these features are considered to be inconsequential. 7. The cellar recreation room will have a door to the exterior via bulkhead stairs. This provides a substantial benefit in that it far exceeds the minimum emergency egress opening dimensions required in Part 714, Openings for Emergency Use. In addition to the exterior door there is a stairway that leads from the cellar to the main floor. 8. The petitioner will install smoke detecting alarm devices within the recreation room in accordance with the requirements of the code. 9. The subject space is a single family dwelling, used by individuals who are accustomed to their surroundings, and the height of the ceiling would not have a substantial negative effect on their health or life safety. 10. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSION OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would not substantially adversely affect the Code's provisions for health, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to permit a recreation room and toilet room with a minimum ceiling height and headroom clearances as described, be, and is hereby PROPOSED TO BE GRANTED with the following condition: 1. That all conditions, enhancements and equipment described herein shall be installed in accordance with the applicable generally accepted reference standards. This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writinq received by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
