APR 1 44 ? pop ....moi` iFa- Appl. No. 5217 - Linda S. Sanford Southold Town Clerk Property Location: 780 Private Road 17, Southold Parcel 81-3-27. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 93,663.23 sq. ft. parcel has 143.67 ft. frontage along a private right-of-way along the northerly property line, and the premises is improved with an existing one-story +- 2365 sq. ft. dwelling and deck addition, accessory shed, pergola, and garage structures, as shown on the survey prepared February 18, 2002, amended June 4, 2002, by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's August 20, 2002 Notice of Disapproval, amended January 22, 2003, in applicant's proposal to demolish the existing dwelling and to construct a new dwelling at less than 75 feet from the rear lot line and bulkhead. Also requested are a new swimming pool structure at less than 75 feet from the bulkhead, and Variances under Section 100-235A(1) and Town Law Section 280-A, for a determination regarding improvements over an existing private right-of-way for sufficient access by fire and emergency vehicles. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: VARIANCE REQUESTS: Applicant proposes to construct a new dwelling, after removal of the existing dwelling with additions. The new dwelling is shown at an improved angled, allowing for an increased overall setback from the bulkhead and rear lines, utilizing a portion of the existing nonconforming yard for a new porch. The closest corner of the new porch will be 25 feet from the existing bulkhead and approximately 56 feet from the apparent high water line shown on the site plan map prepared by Charles A. Napoli, Architect dated June 27, 2002, revised January 20, 2003. Applicant also requests approvals under New York Town Law, Section 280-A, and Zoning Section 100-235 (A-1) concerning sufficient egress and ingress over an existing „.. ,___:= . 0 11111 Page 2="Aril 3, 2003 Appr. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variances requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed reconstruction of the dwelling is within keeping of the neighborhood setbacks, which houses have similar sloping and pitched roofs and traditional gables, open porch design. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than variance requests. 3. The requested area variance is substantial, however this is a reconstruction of an existing nonconforming house, and applicant has agreed to move the house to increase the rear yard setback and decreasing the front setback, and removing the proposed swimming pool from the plan. The code requirement is 75 feet setback from the bulkhead. 4. The difficulty is self-created since properties are acquired with knowledge of nonconformities and limitations of the existing building and property. 5. No evidence has been submitted to suggest that the new dwelling will have an adverse impact on physical or environmental conditions in the neighborhood. By letter dated August 1, 2002, the Board of Town Trustees granted approval with conditions at a Regular Meeting held July 24, 2002 for construction of a new residence after demolishing the existing residence. 6. Grant of the requested variances is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Tortora, and duly carried, to DENY the setback relief requested for a 25.75 ft. setback at its closest point to the bulkhead, and to I Page 3—April 3, 2003 ApI. No. 5217—Linda S. Sanford 81-3-27.1 at 780 Private Road#17, Southold • GRANT Alternative Relief, as shown on the site plan prepared by Charles A. Napoli, Architect dated June 27, 2002, revised January 20, 2003, with a new setback of 27.65 feet from the bulkhead, and 59.25 feet to a tie line along the apparent high water mark, after reducing the square footage to meet this requirement (1607 sq. ft. to 276 sq. ft.) and omitting the proposal for a swimming pool structure in the rear yard; and to GRANT a Variance under New York Town Law, Section 280-A, and Zoning Section 100-235A, SUBJECT to continued maintenance of the private right-of- way, with base improvements at a minimum width of 15 feet within the easement area, at all times for safe and adequate ingress/egress by fire and other emergency vehicles to the applicant's dwelling, and full unobstructed vehicular passage. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Tortora (Chairwoman), Goehringer, Oliva, and Orlando. (Absent was Member Horning of Fishers Island.) This R- . . ion was duly adopted (4-0). 4111111111111111111 Lydia A. In accordance with Article III,100-32 and Article XXIII, 100-239(4)(B),we request area variances based upon the following reasons: 1.) All new construction (5493 sq. ft. of residence, plus 900 sq. ft. of pool)will not increase the non-conforming setback from the bulkhead or tie line, except for the extremely non-conforming existing deck which we are removing. 2.) The existing house, including the deck, is 3087 sq. ft, of area within the 75—foot setback line from the bulkhead. The new house, including the in-ground pool, is 3473 sq. ft. of area within the 75-foot setback line from the bulkhead. The amount of relief requested(386 sq. ft.)is not substantial because 900 sq. ft. of it is the in-ground pool which is currently being redesigned smaller. 3.) In addition,we are removing the deck of the existing house which is currently 9 ft. from the bulkhead and rotating the new house such that the corner of the new house is lined up with the exact corner of the existing house which is 25.75 ft. from the bulkhead. 4.) The construction will not have an adverse impact to the physical or environmental conditions in the neighborhood. We have hired a Landscape Architect and an Environmental Engineer to minimize the effect of the construction to the wetlands. For example, the Landscape Architect is going to leave the site as natural as possible and move established trees only as necessary. Similarly, the Environmental Engineer will abandon, the existing outdated cesspools and design a new septic system with a septic tank and leaching field in accordance with Suffolk County Health Department standards. In addition, the contour of the property will remain unchanged. 5.) The site has a fully grown landscape. As such, the proposed structure is designed to be beneficial to the environment and minimize impact to the existing canopy and mature specimens and trees. Although we are in the early desi n 4,we-do-not-belie ro osed new house footprint will get any larger the pool is being redesigned smaller. '"-- 7 ;MY/; 1101. Subject parcel contains a pre-existing non-conforming dwelling with respect to the required rear yard setback and required bulkhead setback. Ms. Sanford proposes to demolish the existing dwelling as part of her plans to construct a new dwelling in a location substantially more conforming with respect to zoning than the dwelling that exists today. On August 20, 2002,Ms. Sanford received a Notice of Disapproval from the Building Inspector that was subsequently amended on August 26,2002, further amended on October 21, 2002 and again amended on January 22, 2003. A copy of the Notice of Disapproval as amended is attached hereto at Exhibit A. •DESCRIPTION OF THE PREMISES Subject parcel contains 93,663.23 square feet and is a waterfront parcel fronting Southold Bay. The parcel is located within the R-80 Zoning District and is conforming ( parcel with respect to the area and dimensional requirements set forth in the Southold Town Zoning Code. The parcel contains a 2,350 square foot single family dwelling (footprint)with an attached 667 southerly deck, a second 164 square foot northerly deck and a 615.0 square foot slate patio nearly all of which is located in a non-conforming location as per the Town's current Zoning Lawl Subject parcel contains a wood bulkhead that was built in the mid 1960's. In addition, the premises benefits from a fully improved right of way which also services five other adjacent lots to the north, south, and west. A copy of the as-built survey prepared by Joseph A. Ingegno,L.S., last dated August 22,2002,is attached hereto at Exhibit BJ APPLICABLE REGULATIONS The overall project consisting of the demolition of the existing dwelling, decks, porches and patios and the construction of a new dwelling with porches, pool and reconfigured driveway(hereinafter referred to as"The Project"). The Project benefits from a permit granted by the Southold Town Trustees on August 1,2002,pursuant to Chapter 97-18 of the Southold Town Code and a letter of Non-Jurisdiction/Authorization granted by New York StateiDepartment of Environmental Conservation on September 12, 2002, pursuant to Article 25 of the Environmental Conservation Law("State Wetland Law"). The Project also complies with the requirements of the Suffolk County Sanitary Code implemented by Suffolk County Department of Health Services. All approvals listed above have been previously supplied to your Board in connection with this zoning matter. i Pursuant to the Notice of Disapproval issued by the Southold Building Inspector, the Project requires three forms of zoning relief. They are: 1. No building or premises shall be used and no building or part thereof shall be erected or altered in the A-C,R-80, R-120,R-200,R-400 Districts unless the same conforms!Ito the requirements of the Bulk Schedule and of the Parking Schedule incorporated into this chapter with the same force and effect as if such regulation were set forth herein in full. 2. All buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall bel set back not less than seventy-five, (75)feet from the bulkhead. 3. No building shall be erected on a lot that does not have direct access to a public street inl accordance with Section 100-235 (A) (1)of the Southold Town Code. REQUEST FOR INTERPRETATION OF THE ZONING LAW We respectfully disagree with all of the determinations rendered by the Building Inspector and clarify the state of facts as follows: • The existing dwelling contains a 677 square foot wood deck connected to the dwelling and part of the dwelling, which is elevated approximately 8 feet above natural grade. The raised deck is part of the principal dwelling. The dwelling is set back 41.7 feet from apparent high water mark also known as the rear lot line. • The dwelling is set back 9.5 feet from the seaward edge of the existing bulkhead. • The right of wa is fully improved and has served as safe convenient access to this property and five other adjacent properties also improved. Interpretation of thel,Zoning Law is requested pursuant to §100-271 D(1)of the Town Code. Specifically, the existing premises contain a non-conforming building with a conforming use. The dwelling is a non-conforming building because it is sited closer to both the rear lot line and the existing bulkhead than the minimum distances set forth in the Town Zoning Law. T119 dwelling is located 41.7 feet from the rear lot line were 75 feet is required. Further, the existing dwelling is located 9.5 feet from the existing bulkhead were 75 feet is required. The existing and proposed use is residential and therefore conforms to the Town's Zoning Law. §100-242 (A) of the Town Zoning Law states: "Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings." §100-239.4(B)(1)iof the Town Zoning Law states: "All buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than seventy-five (75)feet from the bulkhead Buildings located on lots upon which a bulkhead concrete wall, riprap or similar structure exists and whi h are adjacent to tidal water bodies other than sounds shall be set back not less than seventy-five (75)feet from the bulkhead The following exceptions will apply: (1)Buildings which are proposed landward of existing buildings." As the reconstruction and enlargement of a dwelling proposed in this application will not increase the degree of nonconformance with regard to the regulations pertained to such buildings, such reconstruction and enlargement is permitted as of right. In the event that the applicable regulation appears to be unclear, the statute is strictly construed in favor of the applicant and against the municipality. Notwithstanding the above, I am familiar with the decision rendered in the application of Roger and Leslie Walz (appeal No. 6039)that is the subject of an Article 78 proceeding. I am also familiar with the Zoning Application of Astrid Gaddis in which a variance for the demolition of an existing house and the reconstruction of a new house with porches was denied because the proposed improvements were closer to an existing bulkhead and side lot line than was the existing dwelling prior to its demolition. The Walz and Gaddis applications are incorporated into this record by reference. The Gaddis application was denied based upon noncompliance with respect to §100-242(A)of the Zoning Code. I This application differs from both the Walz application and Gaddis application. In the Walz application, the request was made to construct a second floor addition three feet from the side lot line(the first floor underneath also set back three feet from the side lot line). In the Gaddis application, variances were requested for construction increasing the degree of nonconformity. This application differs in several key respects: 1. The proposed dwelling would be set back from the rear lot line by 59.25 feet whereas the existing dwelling is set back 41.7 feet from the rear lot line. 2. The proposed dwelling would be set back from the existing bulkhead by 27.65 feet whereas the existing dwelling is set back 9.5 feet from the existing bulkhead. 3. The proposed dwelling would occupy 276 square feet within the required rear yard (75 feet from the rear lot line)whereas the existing dwelling'occupies 1441 square feet (including the elevated attached deck)within the required rear yard. 4. The volume of the proposed dwelling would be substantially less than the volume of the existing dwelling within the required rear yard. 5. The proposed dwelling would occupy 2578 square feet within the 75- foot setback from the existing bulkhead whereas the existing dwelling I (not including slate patio) occupies 2937 square feet within 75 feet from the existing bulkhead. In summary, the Pr r jest is distinguished from prior determinations made by this Board in that all proposed improvements increase the degree of conformance with respect to the required rear yard set'hack. In addition, all proposed construction would be set back from the existing bulkhead further than the existing dwelling on subject premises. The requested interpretation that no zoning variances are required should be granted due to demonstrated compliance with respect to Sections 100-242(A) and 100-239(B)(1)of the Zoning Code and also because it is distinguished from the prior determinations of Walz and Gaddis. Likewise,we respectfully disagree with the Building Inspector's Determination of non-compliance pursuant to §100-235 (A) ("Access Requirements"). §100-235 (A) (1) states: "No building shall be erected on a lot that does not have direct access to a public street in accordance with §280-a of the Town Law." §280-a of the Town Law states: "No permit for the erection of any building shall be issued unless ... (c) a street on a plat duly filed and recorded with in the office of the county clerk or register prior to the appointment of such planning board and the grant to such board of the power to approve plats." In this case, access was already established by deed recorded in liber 2712 page 377 filed on May 27, 1947. 'The deed, transferring property now defined as SCTM 1000- 81-3-13,14 from Ann Hallock Curie-Bell to Leonard Bruce and Doris Lillian Aldridge Bruce references the easements across both properties to the benefit of subject property for purposes of access. Since the deed was recorded prior to the requirement that was effective upon adoption of the Southold Town Zoning Code (April 9, 1957) and the access is presumptively suffcient for the purposes of access as defined in Town Law 280-a, no special variance for access should be required. In practice, the requirement of obtaining Zoning Board Approval pursuant to §100-235 (A) (1) has never been required for any building utilizing this right of way. A records search was made by this office accessing the Building Permit and Certificate of Occupancy records for all parcels fronting and using the right of way. Attached herewith at Exhibit C are copies of the Certificates of Occupancy issued following completion of the building activities. A records search of the Town's Zoning files revealed no variance history on any lot fronting and using the right of way. Attached herewith at Exhibit D is the response of the Town Zoning administrator to the Freedom of Information Request filed by this office indicating that no variance application were filed for any lots fronting or using the right of way. Presumably, no variances were ever required for any lots fronting this right of way because of prior determinations made by the Building Inspector that no such relief was necessary. That is,the right of way was created prior to the requirement for such approval and/or the right of way was suitably improved to provide sufficient access pursuant to §100-235 (B) and(C) as well as the requirements of Town Law § 280-a. REQUEST FOR RELIEF FROM THE TOWN ZONING CODE Notwithstanding our request for an interpretation of the Zoning Law under the facts and circumstances described above, the applicant has applied for relief from the zoning code as applied for including alternative relief consistent with the site plan prepared by Charles A. Napoli, Architect, dated August 10, 2002,the alternative site plan dated August 26, 2002 and the alternative site plan dated January 20, 2003. All submitted site plans feature the same basic dwelling. They are distinguished below as follows: The August 10th 2002 Site Plan: This site plan was filed in connection with the original Application for Appeal filed with this Board. The site plan features a proposal to construct a 2826 square foot dwelling, a 929 square foot porch(northerly) a 252 square foot westerly porch(entrance) and a 384 square foot porch(southeasterly). The dwelling would be setback 59 feet from the rear lot line and 25.75 feet from the bulkhead at its nearest point. This site plan also features a 731.28 square foot pool also located 59 feet vi, ' from the rear lot line and 25.75 feet from the bulkhead. This site plan demonstrates a redevelopment of the property that increases conformance with respect to dimensional setbacks from the rear lot line and existing bulkhead. The August 26th 2002 Site Plan: This site plan features the same house layout _ with identical setbacks relative to rear lot line and the existing bulkhead as shown in the " August 10th 2002 Site Plan. This site plan differs from the previous site plan in that the /;k' area of the proposed pool is reduced from 731.28 feet to 729 square feet. The area of the proposed pool was reduced so that the structural coverage within the required rear yard t would equal the existing coverage in the required rear yard. The site plan demonstrates a redevelopment of the property that increases conformance with respect to the dimensional setbacks from rear lot line and existing bulkhead while maintaining the same area of coverage within the rrequired rear yard. This site plan is submitted to provide this Board guidance in consideration of alternative relief. The January 20th, 2003 Site Plan: This site plan features the same size house as the two former site plans. The proposed pool is eliminated from the overall zoning proposal. The siting of the dwelling relative to the rear lot line and bulkhead is slightly increased to 59.25 feet and 27.65 square feet, respectively. Importantly, the coverage within the required rear yard is reduced from 1607 square feet to 276 square feet. u iv Coverage within 75 feet of the existing bulkhead is similarly reduced. The site plan demonstrates a redevelopment of the property that increases conformance with respect to setbacks from the rear lot line and existing bulkhead also increasing conformance with respect to structural coverage within the required rear yard. This site plan is submitted to provide this Board with a second alternative for alternative relief. VARIANCE CRITERION (1) Whether the variances sought will result in an undesirable change in the character of the neighborhood or a detriment to nearby properties: The variance sought will not cause an adverse effect or impact upon the character of the neighborhood. Attached herewith at Exhibit E is a rendering of the exterior elevation of the proposed reconstructed dwelling prepared by the project architect Charles A. Napoli. The rendering demonstrates a dwelling that features a sloping and pitched roof with traditional gables along with open porches. Such design comports with the character of the neighborhood. The siting of the dwelling also comports with the character of the neighborhood. Attached herewith at Exhibit F is the contact print of an aerial photograph taken and developed by Aerographics Corp. dated March 14, 2000. The contact print is a duplicate of the enlarged print to be presented at the Zoning Board Hearing of February 20, 2003 which is enlarged to scale 1"= 100'. The aerial photograph provides for a clear and unambiguous description of the neighborhood. The neighborhood is defined for purposes of this application as consisting of 22 lots of which 20 are improved with principal building and accessory buildings and structures fronting Southold(Peconic)Bay. The 22 parcels (including subject parcel)are identified on the aerial photograph by tax map boundary and designation. Of the 20 improved lots, 13 have been developed in a manner at variance with the required rear yard setback and bulkhead setback. Therefore, the character of the neighborhood consists, in majority part, of non- conforming development with respect to dimensional requirements but with conforming uses. 1 The applicant has proposed the reconstruction of a dwelling in a non- conforming locationfthat approximates or exceeds the average setbacks of principal and accessory structures. Among those parcels containing non- conforming building and structures, the average setback of principal structures • from the rear lot line was found to be 57 feet. The average setback for structures from the rear lot line was found to be 38 feet. The average setback for principal structures from bulkheads was found to be 36 feet. The average setback for accessory structures from existing bulkheads was found to be 20 feet. In this application, the setback for the principal reconstructed building relative to the rear lot line and bulkhead is 59 and 25 feet, respectively. Therefore, the variance, if granted, will not cause an undesirable change in the neighborhood from the standpoint of the existing setback condition of the neighborhood. 1 , I Nor would the variances, if granted, detract from the visual characteristics of the neighborhood. Attached herewith at Exhibit G are a series of photographs taken by Erwin N. Potter,Landscaped architect that portray the woodland character of the site and neighborhood. Essentially, while nearly all of the neighborhood shoreline residential properties have been improved with single family dwelling and associated accessory structures, the existing canopy provided by the mature woodland along the shoreline has been preserved. For the most part, it is the accessory structures including decks and bathhouses that are the most visible within the neighborhood along the shoreline. In this proposal, the tree line canopy would be preserved, as the construction activities proposed would be largely limited to the area occupied by the existing dwelling. Similarly, nearly all the northern portion of the site consists of mature hardwood forest that provides significant screening and privacy for adjacent properties. A review of the as-built survey prepared by Joseph A. Ingegno reveals the location of the large trees on the site. (See Exhibit B) The large mature trees as well as the shrub understory would also be preserved, as the construction activities are largely limited to the existing dwelling. Thus, the woodland character of the site and neighborhood would be preserved. While not required, the project as proposed has received support and approval from all adjacent neighbors. Attached herewith at Exhibit H is correspondence received from Doris Davis,Donald Levanthal, Susan and Jeff Kaytis, Jane and George Kaytis, Jerry Callis, and Mark and Anne McDonald all of which support the application as applied for. Thus, the consensus of the neighborhood is that the proposed development activities will not adversely effect the character of the neighborhood. (2) Whether the benefit sought by the applicant can not be achieved by some method feasible for the applicant to pursue other than an area variance: The benefit sought by the applicant relates to the desire to substantially construct within the area of the existing dwelling. By doing so,the applicant is able to preserve the mature woodlands existing throughout the central and northern portions of the site. Preserving this area affords both the applicant and the applicant's neighbors privacy between home sites as well preservation of the natural benefits afforded by such habitat. Demolition of the existing dwelling and construction of the dwelling 75 feet back from the bulkhead would result in substantial clearing of the site thereby altering the habitat values, privacy, and character of the neighborhood. Therefore, the benefit sought by the applicant can not be achieved without an area variance. •sro S{au s ;ugoi ddg a ; ui ;ugoi ddg alp ;o aAofua c;uasaid Aognud o Rg I g p I q q R RP I not;nunuip qpm paidnoo;saro3 poomprgq jo uoptod p or po B jo uopetr!u iia aq;ui;ansa i mom pgaipunq otp tuo.g;aoj SL gugiamp jo uoiaonr;suoo `si wt •s;ogdutt aJ!!Jo Apignb pug ig;uautuortnua ant aou rgiiuris asnuo pinom pi otp nq aq;wog;aaJ SL paps Sugiamp mau B jo uoi n.t;suoo aq;pug Sutiiamp Supsixa Gi po uoipioutap 0141 •saprnord Apuasard;sar0J poompreq annum aq;;Bq;ssoggWiau pug;urogddg aq;iiq paAofua icognud Jo as aap paonpa.i g pug;saioj poompnq aim:gui po Suugaio grout `aouggrn;sip a;ts.ia;gait ut;insaa mom uotsugdxa pigmpugi was `uoipppg uI •3iogq;as pgatpunq pug piCA JBat parinbar alp utgpm affgianoo aq;pug logq;as paining aq; Vgq;as pnA .moi 0140.01.ani;BIar s;spta Apgagt ieq;aouvuuoJuoo-uou Jo as iop gBni au;&uimasaid aitgm quou of o;Sugiamp aq;pugdxa 01 Aug Op-Jo-se ug sAofua;ugogdde aq;`aroja logy •ouq;oi nal pug peal:piinq aq;uio.g SL ugq;.iagpnJ Apgarig Si Buiiiamp Sut;sixa ogjo uoluod A iaquou aq;wq;aai;ou aj pings preog siq;`ranamoH •31ogq;as p.rA xea r uinumnui aq;Suip000xa&garaq;mining but;sixa aq;uto g log; SL paps aq pinoo Sutiiamp mau g pug pagsgoutap aq pinoo Sugiamp&ui;sixa aq;asngoaq pavan -jigs sT digspreq at; autdo pinoo preog sni;`AiggnraouoD •powaro jigs st digspreq aq; ;ou JO iogogm jo uoi;sanb aq;atoidxa Auto prgog siq;`ant;gutuua;ap;ou ainl& •((uiiiamp Sui;Sixa aq; •a •i)pagm;sip Apgarig nip 01 papuni Alofti st aouggin;sip a;is ag;asngoaq poogrogq8tau alp jo uoippuoo igoishgd aq;01 pedal! ou ui s;insar Sutiiamp&upstxa mpg);uud;ooJ ag;utgpm Aiigq;ug;sgns Sutiiamp aq1 jo uopotu;suooai aq j •pooq.iogg2tau atp Jo suoi;ipuoo igoisAgd aq;o; aagduii JO;oaa asianpg ug it!;insar `pa;ugiS J4 `saouguen aq;pinom ION ;sanbar aougpen snit.o;Suggiar suiaouoo reluautuorinua ou ate magi •;uautuortnua at; Aotiod pool pug arm Jo aougiatp.inJ ui;saroj poompreq anneal g jo uoi;gnrasard aq;uT;ansa.'iiim aougugA 0111.10 ignorddg aq;`AiiguotpppV •saotnras g;igaH3o;uaut;redaQ Aluno3 3Iiojns Jo s;uauia.nnbar aq;gpm sagduioo;oaford aq;pug `uoi;gnrasuop ig;uautuoainug Jo;uaunndaQ a;g;s 3poA maN`sag;stuff pioq;nos ag;tuog signorddg pantaoar seq;ugogdde aq;`;rto pa;utod Aisnoinard sy •poogrogqSpu aq;Jo suotppuoo ig;uauiuo t!nua ag;o; gduti asianpg ug uc;insar;ou iiim`pa;ug til J! `saougrrgn aqs, :poozpoggq au azp fo suop puoa Iv;uauruogtua .101va:sbgd ag3 uo zavduq.ro paffa as:lawn wn un asnva mat aauvuvn alp xagzagq (p) .am aq;jo not;ipuoo 3iogq;as&ui;srxa ag;rano asuarour planing pug au!!;off rgar aq;wag slogq;as sg igi;ug;sgns ;ou sr aougugn roj uogeotiddg spp.`sngZ •aougpen Aug roj paw aq;;nogpm quoit aq;01 Sugiamp SuI;srxa atp pugdxa pinoo;ugogdde aq;`;no pa;uiod Aisnoinard sy •;uautarmbar aq;o;digsuoi;giat ui igq;ug;sgns;ou are saouWugn 0141 :1vpursgns si;ganos aauvyva alp aaspag4 (() , As a final matter, the proposed variance for relief from §100-235 A(1)of the Town Code is reasonable and fulfills the requirements of Town Law §280-a. Subject parcel is presently served by a 50 foot right of way 400 feet long which connects to a second right of way 20 feet wide extending 116 feet to the site. Both right of ways are fully improved in-conformance with Town Law §280-a which declares right of ways of 15 feet to be presumptively sufficient for access, and also in compliance with Section 100-235 (C)of the Town Code also requiring minimum access width of 15 feet. In addition,by way of correspondence from James Richter,R. A. to Michael Verity, Building Inspector dated April 19, 2002,Mr. Richter serving as Town Engineer has certified that the existing access meets the minimum standards for access of emergency equipment and personnel. (See Exhibit I.) Therefore, there are no physical or zoning concerns relative to access. FoLt e-r asons set forth above, the applicant respectfully requests an 'nfrpretation yvanted certifying that no variances are required pursuant to §100-242 - nforming structures with conforming uses), §100-239.4(B)(1) (Building 11,.401,0 Setback requirements adjacent to water bodies and wetlands) and §100-235 A(1) 4 (Access)based upon strict application of the statutes and Town zoning policy and ,(\ j s'ry practice. The private access roadway consists of a compacted stone blend wearing surface. This roadway appears to be stable and should support the weight of emergency vehicles when required to do so. The area immediately surrounding the traveled roadway is also clear of debris and vegetation that might restrict access. In conclusion, the existing driveway to the above referenced property meets the minimum standards for access of emergency equipment and personnel. Sanford 780 Private Road 17 Southold, N.Y. 11971 Dear Members of the Board: I 've - been in Southold since 1980 ,and in all of ' that time , twenty-two years , I 've been hearing about what should be done to keep Southold rural. What has happened? We now have many subdivisions full of over-built houses as well as a lot more new individually built homes. And so many of them now have swimming pools. Where does the water come from? Shall we tear down all the small houses and replace them with bigger and bigger ones? I live in a charming small house that belonged to the Joseph Hallocks and in their time was called "The Bandbox" . I fear 'that when I am gone it too will be demolished and replaced • with a "Monster" . I 'm by no means saying all houses should be small but Southold in turning into a Trophy-House town. Is that what we want? I say no. If everyone who buys property in Southold can get variances why have regulationBf? The regulations are there when the property is purchased and the purchaser should be aware of them. I would like you to disallow the request for variances in this instant. Thank you. Sanford - #5217. This is an application based on the Building Department's August 20, 2002 Notice of Disapproval, amended January 22, 2003, in a proposal to demolish the existing dwelling and construct a new dwelling: (1) at less than 75 feet from the rear lot line and bulkhead. Also requested is a new swimming;pool structure at less than 75 feet from the bulkhead, and Variances under Section 100-235A(1) and Town Law Section 280-A, for a determination regarding improvements over an existing private right-of-way for sufficient access by fire and emergency vehicles. The right-of-way extends over privately owned lands now or formerly of Kaytis, and land of McDonald, from a point starting along the east side of Paradise Point Road, Southold, to the applicant's lot, referred to as 780 Private Road 17, Southold, Parcel #81-3-27.1. CHAIRWOMAN: Is someone here who would like to speak on behalf of the application? LINDA SANFORD: As you said this is a continuation of the meeting that we had back in February. We were snowed out on March 6th and hopefully Spring is in the air. We are prepared to review again the 3D drawing of the home we are wanting to build here. We are requesting a variance to the 75' setback from the rear yard highwater mark and we did review that as you recall in the last meeting and we did demonstrate that we had about 276 sq. ft. of house in the less than 75' space the bulk of which was a porch a nonenclosed porch and Mr. Goehringer wanted to specifically look at the ROW which was the last question. CHAIRWOMAN: I just want to get a couple of things on the record here. What the board had looked favorably on was the specific site plan, I believe it was the January 20th site plan and that's a total of 276 sq. ft. without the pool and to reiterate the specifics it was 5925 to the tie line and 2765 to the bulkhead and that was the plan the board felt would be acceptable so the only issue at this point that we really need to go over is the ROW. I did go out on the ROW, I did go and look at it and it frankly it looked like it was sufficient for fire and emergency access at this point however I will defer this over Mr. Goehringer who is more of an expert in this field. MEMBER GOEHRINGER: As I told you I had seen the property twice. Once in it's worse with a significant amount of snow on it and most recently last weekend. I had no problems with the ROW as it presently exists. I just want you to be aware that when you bring 50 ton vehicles in that there is going to be some enhancement that you may have to do and the board will just reserve the right to look at that sometime in the future and of course the decision will be made that it has to be continuously maintained which I'm sure all of you and all the property owners continuous and adjacent to you will do because it's a magnificently beautiful area. MS. SANFORD: We certainly agree to do that and I've already talked to the neighbors about making sure we are fixing it after we have taken the trucks through it. MEMBER OLIVA: I went there and it's a beautiful piece of property and I don't have any problem with the ROW. I wish you luck with it. MEMBER ORLANDO: No questions. SANFORD. This is an application based on the Building Department's August 20, 2002 Notice of Disapproval, amended January 22, 2003, in a proposal to demolish the existing dwelling and construct a new dwelling: (1) at less than 75 feet from the rear lot line and bulkhead. Also requested is a new swimming pool structure at less than 75 feet from the bulkhead, and Variances under Section 100-235A(1) and Town Law Section 280-A, for a-determination regarding improvements over an existing private right-of-way for sufficient access by fire and emergency vehicles. The right-of-way extends over privately owned lands now or formerly of Kaytis, and land of McDonald, from a point starting along the east side of Paradise Point Road, Southold, to the applicant's lot, referred to as 780 Private Road 17, Southold, Parcel#81-3-27.1. CHAIRWOMAN: Are you Linda Sanford? LINDA SANFORD: Yes. CHAIRWOMAN: We have a very complete file from you. We also have some additional information that was handed in on February 13th letter 2 of 2 and this is a paperwork matter. I want to note that in the letter of February 13th there's a request for interpretation is that something you want us to address before the variance? MS. SANFORD: What we are asking is for an interpretation against the code that we have been referring to here and depending on what that interpretation is we may need to go forward on the variance, we are prepared to do that as well. What we would like is to have the interpretation first based on the data we have presented here. CHAIRWOMAN: There is a legal technicality that's going to gum up the works here. A, you didn't apply for.an interpretation before the legal notice was posted so the legal notice does not give notice for an interpretation. B, there's no compliance with Chapter 58 which is neighborhood notification, board interpretation. C, you did not pay the requisite fees. So to put it bluntly we- MS. SANFORD: Skip the interpretation. CHAIRWOMAN: You can certainly apply. We can accept this as an application with just filling out the rest of it,but you would have to very definitely describe it looks to me like just reviewing this it looks like you are asking for an interpretation for 3 different positions of the code, then you really have to - we could use part of this fill out an application, fill out a little mark interpretation and say here's this area, this area an this area, just as you have here and then we would advertise it for a public hearing and give neighborhood notices and the whole 9 yards. That's why I didn't want you to go forward with this until we - so if you want a couple of minutes to talk you your please go ahead. MEMBER GOEHRINGER: Lydia I have a pressing issue I need to discuss with you. George has to leave at 3:15. I have to leave at 3:30. Page 53 of 63 Page 54 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing CHAIRWOMAN: We have some people here who have been waiting over an hour so if you wouldn't mind we are going to take a temporary recess so you can discuss this and make a decision as to how you wish us to proceed and in the meantime we are going to proceed right along until the next hearing. We are taking are recess for the Smford's to decide what they would like to do with their interpretation request and we are going to move to the next hearing. 3:08 pm SANFORD (CONT.) MS. SANFORD: We have conferenced and what we would like to proceed with is the request for a variance however and this is my first time through this so please help me. What I would like to do at the end we'd like to go through a short presentation and then poll the board to get a sense of what your thoughts might be and then reserve the option to perhaps adjourn if we need to adjourn on that if that's alright. MEMBER GOEHRINGER: We have a major problem. Mr. Horning is leaving at 3:15 and I have struggled through an eye appointment all day. I have an appointment on the other side of Southold at exactly 3:45. I'm going to leave at 3:35. CHAIRWOMAN: We have a very complete record in front of us. I went through everything, what the nature of the variances are, I just there are 2 alternative site plans that you have submitted. The first site plan is the August 26th one and that includes the pool. Essentially the dimensions are the same there's no change in the setback dimensions. The site plan that was prepared January 20th you've eliminated the pool and increased the distance to the bulkhead by 2'. The distance to the tie line, property line is almost identical. Have I got it? CHARLES NAPOLI, ARCH: One thing, we are landward of the bulkhead. MS. SANFORD: We had moved landward 2' further away from the bulkhead. CHAIRWOMAN: A couple of things here. There is reference in here to other lots in the area. Mr. Anderson went through a very lengthy dissertation about the other lots along the beach 20 some odd lots and one of the things he talked about in here is that there are and there's no page number but I'm sure you'll find it it's under variance criteria number 1 Flagsgraf. He says among those parcels containing nonconforming buildings in structure the average setback principal buildings from the real lot line was found to be 57'. The average setback for structure for the rear lot line was found to be 38'. What's that based on? MR. NAPOLI: Based on the aerial. We gauged it all going off the aerial. Here's the high water mark which is the rear lot line and we basically measured them all right here. We took an average of each structure. CHAIRWOMAN: And the lot next to it on the east is vacant? MR.NAPOLI: No, it's improved. I believe there's only 2 unimproved out of the 20. Page 54 of 63 Page 55 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing MEMBER GOEHRINGER: The average setback is based on- CHAIRWOMAN: It's very tough to see this you'd really have to look at it. Because when people use the aerial is very difficult. Usually what we see is a rope and then a survey marks back and then this is- MEMBER GOEHRINGER: It's confusing Jerry because some of it references accessory structures and other reference principal structures. MS. SANFORD: We've got it both ways so it's the averagevsetback of principal structures from the rear lot line is 57'. MEMBER GOEHRINGER: That's normally where the high water mark would be. MS. SANFORD: Then the average setback from the bulkhead is 36'. We've looked at both high water mark and bulkhead and setbacks from there. CHAIRWOMAN: The neighborhood average is 36 and you're asking for 27. MS. SANFORD: From the bulkhead. MR. NAPOLI: 9' exists now with the existing house. CHAIRWOMAN: The average setback in the neighborhood is 36' according to this aerial. The proposed setback on the January 30th plan is 2765. You're proposing 59 to the tie line which is the property line. Your deed goes to the tie line? MS. SANFORD: Yes. MR.NAPOLI: That's a pictorial definition of the rear yard setback in blue 75'back from the tie line. CHAIRWOMAN: I'm going to ask you the proverbial question. If it's brand new construction, why can't you move the principal structure back further from the bulkhead. You know Bruce Anderson your consultant talked about a number of very valuable trees that are going to be destroyed. MS. SANFORD: Let me ask Irwin Potter. Irwin is the environmental landscape designer. Irwin you may want to use the microphone. I was trying to preserve very much the current wooded area the environmental properties of the land. IRWIN POTTER: I was asked to look at the property from several perspectives but most importantly from the perspective of putting a new house on the property with as little destruction to the existing forest cover to the existing tree line as possible. The reason for that and I'll be very quick and if you choose to cut me off do so is that in looking at this property both across the Page 55 of 63 Page 56 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing bay or from the water and from the neighbors that little corner you see cut out to the left there the neighbors house is a few feet over in that direction. In looking at this property from that is was my consideration that one of the important environmental features in terms of visual and in terms of putting a new house in there was to try to maintain the tree cover line because when you look at this shore line along here I don't have to tell you about your own;:neighborhood but when you look at this shoreline what you see is a wooded shoreline. Now what happens is this. This building occupies a portion of the existing structure and a portion of the property immediately behind it. As a consequence that building and the revised driveway takes out only 8 or 9 trees does not interrupt the canopy, doesn't break the canopy. So in my opinion it protects the larger neighborhood that is the neighborhood across the bay and it impacts the near neighborhood that _ is the people living around it. Keep in mind the people who live around it have the forest cover. As you can see from the plans we have shown, we remove very few trees, we are trying to maintain the canopy so what you have is in essence the same kind of structure you have now that is a building sitting under the canopy or within the forest and that is very similar if not exactly the same as most of the houses along here. That is these houses are houses that are tucked beneath the canopy. From my perspective that was an important constituent of the visual effect of what this neighborhood is like. MS. SANFORD: And in maintaining the spirit of the environment. CHAIRWOMAN: On the map what is the blue? MR. NAPOLI: The blue is 75'back from the tie line. CHAIRWOMAN: If we go to the last map the most recent map would take us MR. NAPOLI: The purple in this most recent diagram is the existing house and deck. Here's the deck. CHAIRWOMAN: The white is the proposed deck and house. MR. NAPOLI: It's not a house it's an open porch. And I what I'd like to do is take off the old house. If you see the size of the old house and deck I'd like to remove that it's the only piece that's into the setback line and as you can see it's almost all porch. CHAIRWOMAN: I'm looking for that map. MEMBER GOEHRINGER: The purpose for placing the house on that skewed position is I assume one based upon what Mr. Potter said and two probably commands a better view that way. MR.NAPOLI: No as a matter of fact the best view would be to have it along the setback line. This happens to be the direction of morning sun. You can see this arrow right down here these are the sun angles. Linda came to me and said I want a beach house and a formal house. My job is to make one out of both of those requests. The other thing she said when we were interviewing how she wants to use this place. She loves morning sunlight so her bedroom Page 56 of 63 Page 57 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing happens to be right here on the 2nd floor. In addition directly underneath that is the informal living summer room also in the morning sun. MR. POTTER: I want to add one thing that make my job a bit easier as you can see all the trees that remain to the right the only one that is likely to be lost is the one- CHAIRWOMAN: You know the autocat that showed the porch area and the intrusion I just want Member Homing to see this. This is the only area of the variance. MR. NAPOLI: As you can see it's quite less in mass and of course you can see in volume it's considerably less in volume everything else is open porch. CHAIRWOMAN: On that map it almost cuts a diagonal right through the porch and then this way maybe a tiny little piece. The porch is a total of 276 sq. ft. MR. NAPOLI: No the entire area in the setback is 276 sq. ft. including the piece of the kitchen. CHAIRWOMAN: So the total area of the variance is 276'. Is that correct? MR. NAPOLI: Yes. And of that 250' is open porch. MEMBER GOEHRINGER: You will covet that porch to remain open? And allow us to restrict that if we are so inclined? MR. NAPOLI: She wants to be under cover in the rain. MS. SANFORD: I want a wrap around porch. CHAIRWOMAN: I have no problems with this at all. Let's go to the 280A access. MEMBER GOEHRINGER: I have to tell you I spent a great deal of time on that property walking around and looking at the treeline and getting the feeling that your landscape architect has devised for us. This is a wonderful device in allowing us to analyze this and I was so enamored with the property and the trees and with the destruction of the existing house I don't mean destruction I mean in it's physical obsolescence that I spent very little time on the 280A and I have to admit to that. CHAIRWOMAN: Basically what we would be requiring Jerry is a simply access for fire and emergency vehicles. MS. SANFORD: And the fact that the ROW is also where several neighbors also enter to their property so it's been in use for many years. MEMBER OLIVA: Which ROW do you use the one going through McDonalds or the one that's just to the east of it? Page 57 of 63 Page 58 \/ February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing MS. SANFORD: It goes through McDonald's on one side, Kaytis's are on the other and then through to ours. CHAIRWOMAN: What's on the ROW now? Any gravel bed? MS. SANFORD: Yes. MR. NAPOLI: We have photos and we have staked it. CHAIRWOMAN: We could leave it open until March 6th MEMBER GOEHRINGER: I'll submit a brief report on what my analysis is in reference to the ROW. Remember we are not evaluating it into the property only the tangent of the property line. So whatever you intend to do from your property line in is your business. We are only interested in getting from Paradise Pt. Rd to your property. If I have a problem getting to your property, paint it, stake it so I can see the monument coming in. MS. SANFORD: It has been staked. We can uncover them. MEMBER GOEHRINGER: Just uncover one so I can understand. MS. SANFORD: On March 6th I won't be here but I think my colleagues can represent me here if that's okay with you. CHAIRWOMAN: I don't think we have any more questions. I think I can safely say the board is fairly comfortable with the January plan I think it's a clean record you presented us with. The only other issue is the 280A access that Mr. Goehringer is going to go look at and we should have that wrapped up by the 6th. MEMBER GOEHRINGER: I have to tell you that having these graphics are invaluable in evaluating an evaluation of this nature. MS. SANFORD: It is very difficult for me to look at a 2 dimensional drawing and it really came to light with the 3D. MEMBER GOEHRINGER: Very, very, well done. We appreciate it especially since the existing house is in the center of what you want to make with fresh new construction. MS. SANFORD: We staked out the new home but that was very hard for me to visualize walking the property line. MEMBER GOEHRINGER: Are you a contract vendee or did you buy the property? MS. SANFORD: I'm from Laurel. I grew up here on the north fork and I bought the property. Page 58 of 63 Page 59 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing CHAIRWOMAN: 7pm March 6`h. This was so easy and clear I want to compliment you. CHAIRMAN; Does anyone wish to say anything for this applica- tion? RUDOLPH H. BRUER, ESQ. : Rudolph Bruer, Southold, and I'm here for Mr. Weist. I think the application pretty well speaks for itself, and Z think that examination -is:-_self-explanatory. Mr.- Bruer brought -up a copy of the survey showing the proposal. CHAIRMAN: Yes, we have the same map. The right-of-way is right off here, this is his frontyard, and this is the water down here. Does anyone wish to speak against this? (There was no response. ) MR. TUTHILL: I have no questions. I 'm ready to make a motion. CHAIRMAN: Bob, do you have anything more to say on the Weiss application? _ MR. DOUGLASS : No. After investigation and inspection, the Board finds that the applicant is requesting permission to construct a garage- in 'frohtyard area, which-,ffrontyard. area.-,covers a very large portion:of'-sh: 'parcel due to the location of the access into the parcel.
