No. 5243- RORY and JENNIE FORRESTAL -Southold Town Clerk Property Location: 1065 Saltaire Way, Mattituck; County Parcel 1000-100-1-3 . SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 20,560 sq. ft. parcel has 100 ft. of frontage along the west side of Saltaire Way and 207.21 ft. of lot depth along the south property line. The property is improved with a 1-1/2 story frame-brick dwelling with attached two-car garage and accessory playhouse structure behind the dwelling, as shown on the March 10, 1989 survey prepared by William R. Simmons, Jr., L.S. for the applicants. BASIS OF APPLICATION: Building Department's October 2, 2002 Notice of Disapproval, amended December 9, 2002, citing Section 100-244B, in its denial of a building permit to construct a second-story addition to the existing dwelling proposed within the code's 35 ft. minimum setback for both (total) side yards and less than 15 ft. setback remaining on a single side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story addition with a nonconforming total side yards of 33 feet, including the existing 13 ft. setback from the south property line (and 20 ft. from the opposite side yard), as detailed on the plans dated 5/2002, Job #02-19, by Peter T. Podlas, A.I.A. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a well- established subdivision situated on about one-half acre lots. The property is a non- Page 2—April 3, 2003 Appl. No. 5243—R. and J Forrestal 100-1-23 at Mattituck conforming 20,560 square foot lot in an R-40 zone containing a 1-1/2 story house with garage and decks. The applicants propose to convert a portion of the dwelling and existing two-car garage into a garage with a two-story structure for a master bedroom suite and to enlarge the other bedrooms. The required total side yard setbacks are 35 feet, the applicant with the additions and alterations will maintain a total side yard setback of 33 feet. 2. The benefit sought by the applicants cannot be achieved by some other means other than a variance. The house met the side yard requirements before the code was changed in 1989, when the total side yard requirement was 25 feet. The applicants are building over an existing structure and not enlarging the original footprint of the house. 3. The difficulty was self-created when the applicants decided to enlarge the dwelling. 4. The variance is not substantial as the total setbacks will be 33 feet instead of the required 35 feet. Total lot coverage is 15%. 5. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that this variance will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this requested variance is the minimum necessary for the applicant to enjoy a second-story addition over the existing garage for a new master bedroom suite. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law, motion was offered by Member Oliva, seconded by Chairwoman Tortora, and duly carried, to GRANT the variance as applied for and shown on the plan dated 5/2002, Job #02-19, by Peter T. Podlas, A.I.A. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, r Page 3—April 3, 2003 Appl. Our proposed addition plans will convert an existing one-story, to car garage into a two- story structure that is attached to our existing two story main living space. The addition will become our master bedroom suite and allow us to increase the size of our children's bedrooms. The attached plans have been rendered by an architect, are attractive, improve the appearance of our home, and benefit the neighborhood. A front porch has been added to the project, which further enhances the appearance of the project but fully complies with side and total setback requirements and does not require a variance. 2) Plans as drawn are attractive, in keeping with the style in our neighborhood, and conforms to modern building standards. In order to comply with the recently amended single side yard set back requirements it would be necessary to lop 3' off of the new, second story only, creating an irregular, ugly structure. These changes would cause extensive expensive changes to plan rendered in 1991 which were drawn in full compliance with existing codes which would render the project infeasible. 3) THE AMOUNT OF RELIEF REQUESTED IS NOT SUBSTANTIAL: The original plans were drawn in 1991 when single side yard requirements were 10' and total side yard requirements were 25'. Our existing home was built to those requirements and was in full compliance. Presently there is a single story, 2-car garage on the south side of the property attached to our two-story cape. The proposed addition adds a second story over this preexisting structure with no increase to the footprint of the preexisting structure. The code was amended in 2002 requiring 15' of single side yard setback and 35' of total side yard setback. Dear Sir or Madam, We have been planning a second story addition over our garage for quite awhile and have recently decided to press forward with the project. We had an architect draw the plans ten years ago and recently had the architect review them for building department code changes. Last year Southold town changed its side yard set back rules to a total of 15' any one side and 35' total for new construction. The old standard,the standard when our house was built,was 10' with a 25' total. Hence our garage on the South side of our property would not meet the standard.Now here's the difficulty. When Southold Town wrote the code they did not grandfather for existing construction. So if we want to build anything new over our existing garage,to meet the new code, we would have to set back the second story 2 feet(actually 1.5 feet) from the existing garage. We had our architect try to comply at considerable expense but the structure looked absolutely ridiculous. Previously submitted were the plans which we believe are not only attractive but enhance and complement our neighborhood while fixing our cramped second floor bedroom situation. We originally submitted the plans in August of 2002 and received a letter of disapproval requiring a variance for 1 foot of side yard setback. We submitted the variance request on October 2,2002 based on that requirement and paid the $400 fee. Due to an anticipated New York State Building code change effective 12/31/02 which is expected to increase building costs by at least a third we had or Architect draw up plans which included the 1 foot setback as a backup since the additional cost could impede our ability to go forward with the project. The amended plans cost us$300 more adding to an already expensive process. We did not like the new plans and believe it is unattractive but were forced go this route due to the circumstances. On December 2nd we were again disapproved as the Building department had re-measured and decided that we were now short two feet instead of one foot noted in the disapproval letter of October 2nd. Or architect again redrew the plans again adding another$300.00 to the process and now the structure became completely unacceptable. We again would like to reemphasize that we are building over an existing structure that was fully in compliance when the house was built in 1972. We have gone to considerable expense to have a structure designed that is attractive and solves or interior design difficulties. We appreciate you consideration in this matter.
