Southold Town Clerk SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 15,087 sq. ft. parcel is located on the south side of Island View Lane, a private road. The property is improved with a one- story frame dwelling and accessory shed as shown on the survey prepared by John C. Ehlers, L.S. dated 6-19-2000, revised 2-8-02. BASIS OF APPLICATION: Building Department's June 6; 2002 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit to construct a deck addition at the rear of the existing dwelling. The reasons stated in the denial are that there will be a single side yard of less than 10 feet, and minimum total side yards of less than 25 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants applied for a 10 x 15 ft. deck with attached 6 x 8 stairs at the rear of their dwelling with total side yards of 8.5 feet (5. ft. on the east side and 3.5 ft. on the west side), as shown on the John C. Ehlers survey dated 6-19-00, revised 2-8-02. ADDITIONAL INFORMATION: Applicant stated at the February 20, 2002, that an "as built" easterly deck had existed for many years, but was removed in 2000 to bring the deck into conformance with the code requirements and for the C.O. of record prior to their purchase. The westerly deck had also existed for many years, and had a 3.5 ft. setback from the westerly side property line. On July 25, 2001, the Town Trustees issued a Wetland Permit #5389 for the rear deck, and on May 15, 2002 the NYS Department of Environmental Conservation issued a permit with conditions for the deck. About June 4, 2002, the applicant applied for a building permit to construct the easterly deck, and on June 6, 2002, a Notice of Disapproval was issued by the Building • t t • • Page 2—March 12,2003 Appl.No.5192—Bell and Buckheit 57-2-14 at Greenport Department. On July 10, 2002, applicants filed a variance application. In September 2002, the applicants stated that they completed the easterly deck, "as built," with a 5 ft. setback from the easterly property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The granting of this variance will not produce an undesirable change in the character of the neighborhood, or be a detriment to nearby properties. The proposed deck extension measures 8' x 12', which is not uncommon in this community. Both adjacent neighbors have attached decks to their houses; the neighbor adjacent directly to the northeast has a deck less than 10 feet from their side lot line. The applicants' parcel is approximately 42 feet wide in the area of the principal building, and any addition will require a variance because of the established nonconforming setbacks. The easterly rear deck extension will not create any further increase in the non-conformity of the pre- existing side yard setbacks of this principal dwelling at 3.5 ft. on the west side and 5 ft. on the east side. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance. The applicant is filling an empty corner located at the rear of the house, and the new deck construction is a continuation of an existing rear deck. 3. The requested variance is substantial. There is a 50% reduction for a five ft. setback on the east side instead of the 10 ft. minimum, and total side yards at 8.5 feet instead of 25 feet. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because the applicant proposes to build an open to the sky, 8' x 12' raised deck, which will be at least twenty-five feet from the edge of a tidal wetlands area located in the southerly section of this property. There will be no disturbance to nearby wetlands by this raised, open deck construction, and the adjacent area is heavily wooded. 5. The difficulty for the applicant is not self-created, but is related to the non-conforming, narrow 42.50 ft. width of the applicants' property. • 6. The relief offered to this applicant is the minimum determined necessary for this applicant to enjoy the benefit of a deck extension, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. • • Page 3—March 12,2003 Appl.No. 5192—Bell and Buckheit 57-2-14 at Greenport RESOLUTION/ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Chairwoman Tortora, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for and confirmed by the applicant during the February 20, 2003 public hearing, SUBJECT TO THE CONDITION that the 8' x 12' easterly deck in the rear yard not be enclosed and shall be open to the sky, and shall not be expanded in any way (other than with side setbacks set forth in the survey prepared by John C. Ehlers revised 2-8-02). This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Applicants propose a deck addition at the rear of the existing dwelling with a single side yard of less than 10 feet, and minimum total side yards of less than 25 feet. 1375 Island View Lane, Greenport; Parcel 57-2-14. CHAIRWOMAN: Is someone here who would like to speak on behalf of the application? DAVID BELL: I'm David Bell. I bought this house 3 years ago in Greenport and at the time I looked at the house and up until the day before the closing the house had a deck that went along the whole length of the back of the house. The day of the closing an attorney called me and said you can't close on this because only half the deck is legal so they said we are tearing down the whole deck and I said don't do that can't we just do half of it the half that's illegal. They said no we have to tear the whole thing down. Page 2 February 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing CHAIRWOMAN: This is the owner? MR. BELL: The attorney for the owner. I said I'll go and tear it down myself so it's within code. They said I couldn't because of insurance. Anyway to make a long story short I went out there tore it down. When I tore it down there were French doors that opened up onto part of the deck that was missing and part of the deck that was open. So we started the process to legalize the deck then and it's been almost 2 1/2 years. I had to go to the Trustees, to the DEC, the army core of engineers, then I went to the Building Dept. and said I'm ready and they said no you're not, you need to go to the Zoning Board. Before all of this I went to an agent to see if they could do all of this because I'm not a builder, I don't know all this stuff and it was almost blackmail to get somebody do that and it was almost$4,000 to have somebody do the permitting for me and said I can't do that so I started the process myself and the way that and I don't mean to landbast you or anybody around here but the way the agencies work together has been very difficult as someone who doesn't know the process because I was ready to build that. It was September this year I was going to the building permit I had everything ready to go and they said no you need to go to the zoning board and it might be because I don't know the variances and the laws need to happen but as a tax payer and somebody who just lives in the county it's a very difficult process to get this done and it's been 21/2 years now. CHAIRWOMAN: I'm sorry it's been 2 1/2 years and let's just get a clear record of what's happening. It's my understanding and you just stop me anywhere along the line the former deck was located 5' from the east property line that is gone? MR. BELL: Gone. On September 2nd the new deck was completed. CHAIRWOMAN: Now we have an "as built" deck. There was no CO for that it. This is the deck on the east side but that is the deck that was there was no CO for that when you purchased it. The other deck which connects to it on the west side is the legal deck. I think we are getting somewhere. Let's keep going along so the deck on the west side the legal deck is set 3.5' from the side property line and there is a CO on it. MR. BELL: Yes. CHAIRWOMAN: We are going to say it's an as built deck at this point. Let's try to firm up some other numbers. We have a setback 5' on the east property line and 3.5 on the west so that would give us a total side yard of 5 and 3 is 8.5'. That's what we need to firm up. I'm going to see if the board members have any further questions or any questions. Mr. Horning. MEMBER HORNING: Could you go into a little more detail as to you submitted a photograph with your application there were some pilings there minus that portion of the deck and now there is another deck there. BELL: Yes I had to tear it down before the closing. The deck was one long piece with 4 pilings right before the closing I had to go cut off the deck and there were 2 pilings that were that I just left there. MEMBER HORNING: And you did this last September. MR. BELL: That was 2 1/2 years ago. MEMBER HORNING: 2 1/2 years ago you took that deck off, left the pilings and then this past September you re-established the deck there without a permit. Why? MR. BELL: Partly out of frustration also because I have 2 doors on the back of the house that I couldn't even use because they opened up to a 4' drop off the back of the house. MEMBER HORNING: You could have put a temporary stairwell or something. I was just curious how it got build again. Thank you. MEMBER GOEHRINGER: Normally if the house Mr. Bell didn't extend out to that point I would not be so inclined to grant this application because of the fact that I think 5'is a little tight to get to your rear yard but I guess the neighbors all get along down there and somewhere along the line you'll have to use somebody else's. MR. BELL: Actually my neighbors were telling me as I was tearing it down they kept telling me just build it back up no one will ever know and I said we are just trying to go through the right process. One other thing is this deck that I had to tear down had been there since at least 1967, but I couldn't find aerial photos to go back that far but we did have not documentation but we had the neighbors that lived there that long and had been there since 1967 but I couldn't find anything that documented that said that except my neighbor said he bought his house in 1967 and it was there then. MEMBER GOEHRINGER: You have no intentions of enclosing this deck in any way? MR. BELL: No, it's going to remain open. MEMBER GOEHRINGER: In that respect I have no further questions. MEMBER OLIVA: You have the whole deck the across the whole way or just half the deck? MR. BELL: Now it's the whole back of the house. CHAIRWOMAN: Did you replace the part that was illegal did you marry that or is all new? MR. BELL: The whole thing has been replaced but it's been replaced in the footprints of the old plus the new part that I'm applying for. It depends on where you're standing. On the east side it might be 54"but at the other end it's only- CHAIRWOMAN: If you could get that other information, it doesn't have to be right this minute, but if you could get that information so when we address this we are going to say permission to replace an XYZ size deck. In September 2000, Richard Buckheit and I purchase the house at 1375 Island View Lane in Greenport after owning another house in Greenport for several years. Part of the appeal of the house was the deck that existed along the entire front(waterside)and wrapped around to west side of the house. A couple days before we closed on the house, our attorney told us that the deck was"illegal"and did not have all of the permits needed to receive a certificate of occupancy. We were told that only one half of the deck was legal. The owner said that they were going to tear the complete deck down so we could close on the house as scheduled. We considered this very impractical since the house had doors that opened to the deck. Without the deck,the doors were unusable. This would leave a drop of 3- 4 feet at both doors. The owner agreed to let Rick and I go over to the house and tear down the illegal part of the deck,which we did. We closed on the house in September 2000,and since that time have been trying to obtain the permits to build to deck back to it's original lines. This process started with the Southold Town Trustees to the New York DEC to the Southold Building Department and now to the Southold Zoning Board. The New York DEC found aerial photos of the old complete deck dating back to prior to 1978. When Rick and I tore the illegal portion of the deck down,we left the pilings with the thought that we would get the proper approvals and have the deck rebuilt. All of the houses in this area are very close together, all houses have decks on the water side of the house,and the neighbors agree that it was unnecessary for us to go through these procedures to build the deck back to the original,but we have. Upon the request of Linda Kowalski, I am confirming that the largest area needed for the stairs on the south side of the deck would be 6'x 8'(48 sq.ft).
