No. 5238—THEODORE and ANN LAOUDIS Property Location: 405 Kimberly Lane, Southold Parcel No. 1000-70-13-20.35 (20.21 and 20.32 combined) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the easterly side of Kimberly Lane in Southold, and consists of a total land area of 48,630.57 sq. ft. and lot width of 188.28 feet. The property is improved with a single-family dwelling, and accessory structures (tennis court, cabana, swimming pool, pergola) as shown on the survey prepared by Joseph A. Ingegno, L.S. November 17, 2000, updated January 24, 2003. BASIS OF APPLICATION: Building Department's September 29, 2002 Notice of Disapproval denying a building permit for construction of a carport addition to the existing dwelling for the reason that Code Section 100-30A.3 requires a minimum 50 feet setback from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a carport addition 26.3' x 40.4' with variable setbacks at 29.7 ft. and 40.4 ft. from the westerly front property line facing Kimberly Lane, shown on the January 24, 2003 survey map prepared by Joseph A. Ingegno, L.S. and site maps prepared by Bohn Associates, Inc. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition to the garage apartment was moved within the front yard area because of the established Page 2—January 23,2003 Appl.No.5238—T and A.Laoudis 70-13-20.35 at Southold (existing) cabana and large in-ground swimming pool, which was in place at the time of applicant's purchase of property. This is the reason for the July 29, 2002 Notice of Disapproval, indicating a front yard setback of 27.5 feet from the front property line. The proposed addition is an elevated, second-story height level drive-thru carport, or porte- cochere. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the lack of footage between the established swimming pool and existing new garage apartment, the applicant proposes a porte cochere as an addition in the front yard area of county tax lot 20.35. This structure is designed to be an enhancement to the existing front wall of the garage apartment, thereby actually shielding it from view from the road. The addition could be placed in another area by attaching it to the front wall of the primary structure, however, the structure would be freestanding and would require additional variance for any other location on this lot. 3. The amount of relief granted is not substantial based on its proximity to the front lot line and size of the lot, however, a prior variance application rendered by this board temporarily merges the two parcels (house lot to the south and lot to the north containing the garage apartment, swimming pool, compound and tennis court, thereby making one entire compound.) Total lot area is +- 3.14 acres. 4. The variance may have an adverse effect on the physical conditions in the neighborhood because of the size of the proposed structure and its location to the front property line. However, due to the reasons stated above and the location of the primary dwelling and related structures as proposed, the impact can be minimized. For the record this parcel and related parcel, county tax map #20.4 are waterfront lots, each containing a primary dwelling unit contiguous to each other and attached by a covered trellis and walk. With this in mind, the environmental impact of construction must be lessened adjacent to the waterfront and proposed construction fostered toward the center of the property. 5. The alleged has been self-created., based upon the existing and new construction on this lot (20.35), which places the proposed attached porte cochere in the front yard. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a porte cochere addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. • a gage 3—January 23,2003 Appl.No.5238—T and A.Laoudis 70-13-20.35 at Southold RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Orlando, and duly carried to GRANT the Variance as applied for and shown on the plan prepared by Bohn Associates submitted at the 1/16/03 public hearing and January 24, 2003 survey map prepared by Joseph A. Ingegno, L.S., subject to the following CONDITIONS: 1. That at no time should the new construction be placed any closer to the front property line than proposed herein. 2. That an evergreen buffer shall be placed and maintained between the porte corchere and the front property line, as follows: a) The evergreen buffer shall commence approximately 20 to 25 ft. before the start of the roof of the porte cochere and run a length parallel to the angle of Kimberly Lane to 25 feet past the porte corchere. b) The evergreens should run staggered a minimum distance apart to allow for growth. c) The evergreens shall be a minimum height of 8 - 12 ft. and continuously maintained. 3. The porte cochere shall be lighted internally only, with no external flood or glare of lighting directed toward any property line. 4. The Board of Appeals reserves the right to review the screening buffer and lighting before a Certificate of Occupancy is granted by the Building Department. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Reason for Appeal Continued Zoning Board of Appeals re: Laoudis (lot) Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. Premises contains existing house/garage, tennis court and pool used by adjacent residence . ZBA granted relief for a tennis Court and fence (Appeal 2313 dated August 4, 1977) , the pool was constructed prior to subdivision of the parcels . A variance was granted on May 2 , 2002, appeal No 5077 for the house with garage on the subject parcel making the accessory structures conforming. The addition of the house and garage increases the lot coverage accordingly. The covered drive-way was shown on the architect' s plans, however, he measured the setback of the covered drive (porte-cochere) from the street rather than the property line . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The variance should have been included in the original submission, was shown on the architectural plans, but the surveyor did not show the roof line as lot coverage and setback. No one noticed the difference between the two drawings . 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The properties have been used as one parcel since the date of the subdivision. The property is being remodeled and the driveway entrance is designed to have the garage look more like a residence . The architectural design of the structure would be severely compromised. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The property is very large and has been developed, no adverse affect will be made to the physical or environmental conditions . The entrance would be approximately 50 feet from the street, behind the fence, and is in keeping with the manor style of the main house . 5 . The alleged difficulty was not self-created. The applicant intended to have the entire design included in the original variance application. The zoning board reviewed the design and the pillars were staked and footings poured when the Zoning Board addressed the original variance application. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . PATRICIA MOORE, ESQ: I have Mr. Bohn here who you recognize from last time he's the architect on this project. This project is probably a headache to you as it is to everyone else who's involved in it. The whole project has not changed dramatically since it's original inception just little tinkering back and forth had caused the problem along the way. When the plan was submitted to the building department originally it was just so voluminous and so complicated that they didn't realize that there was a roof overhang. The portico is the carport in layman's terms the carport. The sanctions or the foundations for the carport were poured and when the surveyor came in they showed the setback that was not in conformity because when the building department didn't realize that that was encroaching into the front yard it didn't get included into the variance. So here we are after the fact after the house which is essentially the caretakers house. It's 3 bay garage with living quarters above it. In a sense when they first came to me it was supposed to be so we could avoid variances because to put a garage on a separate piece of property requires a variance because it's an accessory structure without a principle structure so we put the living quarters above it. Obviously went through all the processes of health department and such and low and behold we didn't avoid many variances anyway. The building is now the garage is built so you can see it's quite tall. Architecturally it's not designed without that portico. The gatehouse into the property and the compound and it helps reduce the mass in relationships to the low roofs that also circulate around the north side and the street side of the building. CHAIRWOMAN: This is for the front yard setback of 27' correct? MS. MOORE: Yes. CHAIRWOMAN: If we could possibly to make this as short as possible, where is 27'on the drawing? MS. MOORE: 27'is at the end of the overhang. MEMBER ORLANDO: It's on a corner. CHAIRWOMAN: And the foundation is poured for the 3-car garage? MS. MOORE: The 3-car garage is there. The portico, the sanctions you can see on the cross- sections, this little drawing. The foundation poured to hold up the structures- MEMBER OLANDO: They are within 50'. CHAIRWOMAN: Right now what we are looking at is half of the portico that is non- conforming? MS. MOORE: This is just the carport because the building itself is conforming, but you have to go and see it, it's not very attractive right now because it is just a tall building without architectural integrity on the street side. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence,the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION. The applicant's property is located on the easterly side of Kimberly Lane m Southold and consists of a total land area of 48,360.57 sq.ft.and lot width of 188.28 feet. The total above- grade covered area of the lot is more particularly detailed as shown on the Maps AO-2 and AO-2B prepared Page 2—May 2,2002 ZBA Appl.No.5077—T.and A.Laoudis Parcel 70-13-20.35(20.31,20.32 combined)at Southold by Bohn Associates,,lac. This lot is,improved with the.following structures: cabana, tennis court,and swimming pool. ADDITIONAL INFORMATION. At the time of the site visit,work activities at both north wings of the dwelling on Lot 4 started(after leveling the old rock foundation of the dwelling),with placement of the new partial foundation. New and existing, uncovered patio areas and landscaped areas in front of the dwelling were also started(see plans on file). No construction was commenced on site improvement for the proposed new garage building,and no site improvements were started for the covered walkway REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 (area variances),the Board has considered the benefit to the applicant if the variance is granted, as weighed against any detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Applicants are reconstructing the existing large,two-story home as well as other improvements, and all improvements are within keeping of the neighborhood. The surrounding dwellings are comparable in size and stature, and this structure will have no undesirable effect on the neighborhood. Applicants prefers to conform to the code by keeping the two parcels as separate lots, providing for one residence on each of the two lots,for a total of two dwellings on 3+acres. (If the lots were merged, the minimum side setbacks to the present dividing lot, and the lot coverage relief, would no longer be necessary, however,the applicant would only be able to have one dwelling on 3+-acres (both 20.35 and 20.04 if combined as one lot). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Since the adjoining lot is also owned by the applicant,the side yard encroachment created by the covered stone walk and overhang of the north wing of the main house can only be addressed by an area variance with conditions and restrictions related to both properties. 3 The variance granted herein is substantial due to the extensive nature of the improvements. 4. The difficulty has been self-created. The swimming pool and tennis court are the major lot coverage areas,as compared to the size of the other proposed covered structures. 5.
