PROPERTY FACTS/DESCRIPTION: The applicants' 9,955.25 sq. ft. parcel has 64 fl. of frontage along the north side of Pequash Avenue and 153.22 feet lot depth along the west side. The property is improved with a one-story frame dwelling with enclosed porch and wood deck as shown on the October 1, 2002 survey prepared by Kenneth M. Woychuk, L.S. BASIS OF APPLICATION: Building Department's October 28, 2002 Notice of Disapproval, citing Code Section 100-244B, in its denial of a building permit to construct additions to the existing dwelling with total side yards at less than 25 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new addition at the rear of the dwelling as shown on the preliminary (undated) drawings prepared by Arthur Lasky, Architect. The new addition is proposed at 11.9 feet from the northwest side yard at its closest point; both side yards will be 22.3 feet total (measured at its closest points of 11.9 ft. and 10.4 ft.). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is established with modest homes set on mostly non-conforming lots in a R-40 zone. The applicants' property is improved with a one stow dwelling with deck on a 9,955 sq. ft. non- conforming lot. Applicants have applied for a new master bedroom suite extending in Page 2 - March 20, 2003 Appl. No. 5271 - A. and B. Dworkowi~z 137~2-17 at Cutchogue line with the existing dwelling in a northwesterly direction with a proposed side yard setback of 11.9 feet instead of the existing side yard setback of 12.2 feet. 2 The benefit sought by the applicant cannot be achieved by some other method feasible to pursue other than a variance. The applicant is limited in his ability to add an addition due to his non-conforming lot and the existing setbacks. 3. The alleged difficulty has been self-created as the applicant was aware of the non- conformity of the lot when it was purchased. 4. The variance is not substantial as the side yard setback will be 11.9 feet instead of the existing 12.2 feet according to plans prepared by Architect Arthur Lasky and the survey of Kenneth M. Woychuk, L.S. dated October 1, 2002. Total lot coverage will be 19 percent. Total side yard setbacks will be 22.3 feet, not 22.9 feet as the Notice of Disapproval states. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on the physical or environmental conditions in the neighborhood. Without a variance, the applicant could not expand his home. 6. Grant of the requested relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of an addition to a single family residence while preserving the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering ail of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to GRANT the Variance as applied for and shown on the drawings (undated) prepared by Arthur Lasky, Architect, SUBJECT to the Condition the applicant shall provide the Building Department with foundation survey for the new addition that depicts the new side yard setback of 11.9 feet on the northwesterly side. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. CHAIRWOMAN: I'm just referencing the Notice of Disapproval I need to do that because maybe it's an oversight but I'm not sure. That was not noticed in the NOD. ls that something you added after you presented your plans to the Building Dept.? MR. DWORKOWITZ: No, I think it's in your copies. CHAIRWOMAN: Quite honestly the BD did not find any fault with that to us. We can't address that. That's not to say they won't in the future but for your own information. The addition, what you are replacing, was a fbrmer deck. MR. DWORKOWITZ: No, the addition is right next to the deck. CHAIRWOMAN: I'm talking about on the east side where you have existing proposed porch. MR. DWORKOW1TZ: That's already there. MEMBER OLIVA: You just want to enclose that and make a room out of it as I understood your plans, correct? MR. DWORKOWITZ: No that's alrcady enclosed. MEMBER OLIVA: I know it's enclosed, but I'm saying I think you are going to make a kitchen or something in there? MR. DWORKOWITZ: No, it's already like a den. CHAIRWOMAN: The existing setback of the house which you are going to continue that line against on the west side you have an existing setback of 12.2' because the property is slightly angled even though you will be following the line of the house that's going to give you the new setback of 11.9'. Have we got all the facts here? MR. DWORKOWITZ: Yes. MEMBER OLIVA: 1 was down there and looked at it and didn't see any problem with it and you're more or less in compliancc with the rest of the houses on that block. MR. DWORKOWITZ: In fact the neighbor to the west, his house is set back about 75-80' we have a letter from him saying the addition would be fine. MEMBER HORN1NG: No questions. MEMBER GOEHRINGER: Mr. Dworkowitz I just want you to be put on notice that I would not be in favor of any further reductions after the construction of that northerly property line which was I guess northwesterly property line because of the need at times to get into your rear yard area possibly with heavier construction so in this particular case it's no problem, you're in line with the house, but I just think you have steps on the opposite side and you have 10.4' but I think we are getting to that reduction situation where I think you need to keep those property lines open on at least that side of the house. MR. DWORKOWITZ: This definitely would be it. CHAIRWOMAN: l just wanted to clear one thing up because it did say the survey shows a porch and the plans show an existing dining room and den and there's also talks about demolishing that has that already been done? MR. DWORKOWITZ: No that wouldn't be dcmolished at all, that's actually part of the house. It was originally a carport whcn they first built it in the 50's.
