Re: Dock and launching area in Mud Creek
Dear Mr. Schoenhaar:
The Board of Trustees has inspected this site and we request that you
secure your boat to the north side of the dock as there is sufficient
water for docking at that location. This will assist neighbors with the
launching of boats between docks.

Re: Boat docking facilities
Dear Dr. and Mrs. Perlmutter:
It has come to our attention that you may not be aware of the
Southold Town Code in regard to boat docking facilities.
Please be advised that according to the Southold Town Code, Chapter
100.31(3) a b c, boat docking facilities for the docking, mooring or
accommodation of non-commercial boats, are subject to the ~ollowing
requirements: '~

There shall be docking or mooring facilities for no more than 2
boats, other than those owned and used by the owner of the
premises for his personal use.
(b) The Town Trustees shall approve new boat docking facilities.
Boats at such docks shall not be used for overnight sleeping
purposes.

Gentlemen:
i was distressed at the unreasonable nature of the request
contained in the August 7, 1989 communication from the Board of
Town Trustees. The facts are as follows:
a) My 28' boat draws 31 feet of water from the water
line to the tips of the two fixed rudders.
b) The water on the south side of my dock is deeper
than the north side; never the less, ingress-and
eg'ress is difficult at low tide. (EXH. lalblc)
c) Going north from my dock, environmentally sensitive
vegetation takes over and any type of docking is not
practical. (EXH id)
d) The north side is used to keep my other boat; a
shallow draft 14 foot outboard, which is high and
dry at low tide. (EXH. lblc)
e) Granted that "title" does not include creek bottom,
it is interesting to note that my boat, on the south
side of the dock essentially falls within the exten-
sion of my southern property line. (EXH. 2 & SURVEY)
f) Although not limited to the facts aforementioned, it
is apparent that it is unreasonable and unwarranted
to limit my "quiet enjoymentr of deed and dock.
It would be presumptious on my part to suggest what the com-
plaintant could do, rather I would set forth certain facts for
your consideration:
1)
To my south, there exists bulkheaded slips for (5)
boats, in addition to another 70 feet or so of low
bulkhead, for a total of some 140 feet. (EXH. A1A2A3)
4)
There is an area to the south of the (5 slips
that is devoid of vegetation. (EXH. B)
Other property owners have ramped over to pro-
tect sensitive vegetation in accordance with
published TRUSTEES guidelines. (EXH. C)
The launching of any boat over wetlands is
damaging to the environment and shoUld not be
permitted. (EXH. B, D1, D2)
In summation, the facts do not warrant any limitation
on.the reasonable use of my property, and further, that the
complaintant be "requested" to cease and desist damaging the
wetlands both on his property and mine.
