No. 5105 — MARY ROMAN and ELLEN BIRENBAUM Property Location: 740 Poquatuck Lane, Orient 27.-3-4.5 BASIS OF APPLICATION: Building Department's January 10, 2002 Notice of Disapproval, under Zoning Code Section 100-33 for the reason that the new garage is proposed in an area other than the required rear yard. AREA VARIANCE REQUESTED: Applicants request a Variance to locate a proposed 22' x 27'5" accessory garage in a yard area defined under the zoning code as a side yard. The total height of the accessory garage is shown at 13 ft. (see plans prepared by Susan B. Gardner, Architect revised 6/21/01) and being located at 71+- feet from the east (northeast) lot line and 92+-feet from the northerly lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicants' property is a 5-acre parcel referred to as Lot 3 on the Minor Subdivision Map of"Kings Bay Partners"with access over a private 50 ft. right-of-way at the north end of the property, which right-of-way extends from King St. More details about the dimensions and property are shown on the survey prepared June 5, 1998 by John C. Ehlers, L.S. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Three acres of the property is reserved for preservation as open space and views to the south of the building envelopes within the subdivision. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property to the west has a garage in a front yard. If the applicant's garage were attached to the existing dwelling, the view to the north would be obstructed for the neighbors. 3. The relief requested is not substantial. The property is five acres in size and the location of a garage in the requested area allows setbacks greater than the code requirement (when a rear yard location). � 4 Page 2-May 16, 2002 ZBA#5105—M. No evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of the additions, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Chairman Goehringer, and duly carried, to APPROVE the variance, as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1) The accessory (garage) building shall be for storage and as an accessory for the owners' use as permitted under the Code and shall under no circumstances be used as sleeping or habitable quarters at any time; 2) The accessory (garage) building may contain a changing room and electric. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
