CONSTRUCTION REQUIREMENTS (a)Type of building No building shall be erected,altered,placed orpermitted to remain otherthan one single-family dwelling not to exceed two and one half(21/2)stories in height and a private attached garage'for not less than two(2)nor more than three(3)cars. (b)Accessory buildings No carport or other accessory structure of any kind may be erected except:0)an attached garage,or (2)an accessory shed to house pool and/or garden equipment. Such a structure must blend with the main house and not exceed one hundred(100)square feet in size. (c)Swimming pools Private swimming pools,in-ground only,may be constructed on any lot provided that they are situated In the rear yard only and that no portion of any such pool or its appurtenances be closer to the rear or side lot lines than thirty(30)feet. (d)Dwelling square footage requirements No dwelling shall be permitted on any lot unless the living area,exclusive of open porches and garages, is at least two thousand(2000)square feet for a one-story building or twenty-five hundred(2500) square feet for a two-story structure_ Any exceptions must be approved in writing by the Architectural Review Committee. No dwelling shall exceed four thousand(4000)square feet in total living area without the express written approval of the Architectural Review Committee. -3- (e)Setback requirements Unless shown otherwise by setback lines on the filed map,no part of any building and/or structure, except uncovered steps,stoops,terraces,patios and chimney breasts shall be located on any lot within seventy-five(75)feet of the street line of the lot,nor within thirty-five(35)feet of the sidelines)of the lot,abutting another privately owned building lot,nor within fifty-five(55)feet of the rear line of the lot. In the case of a corner lot,a building shalt be required to comply with the front yard restrictions on one street front only,provided that the width of theyard abutting the street other than that upon which the lot fronts shall be not less than fifty(50)feet.In all cases.front setbacks shall be in general alignment with the front setbacks of neighboring houses. (f)Approval of construction plans The Architectural Review Committee shall preside over and enforce compliancewith all applicable covenants and restrictions.All plans for new buildings,accessory structures,additions,modifications, decks,fences and pools must he submitted to the Committee for approval before construction can proceed.Such approval,which shall be not be unreasonably withheld,shall be based on the judgments of the Committee as to whether the proposed structure will be consistent with,and not detract frgm,the esthetic character of the community. As a guideline,structures should be neo-colonial in design orof such a design to be harmonious therewith.Specifically,structures should be gabled with roofing and siding of traditional materials, brick or stone chimneys,and double-hung or casement windowswith colonial lights or grilles.Any departure from the use of traditional siding and/or roofing materials shall require the approval of the Architectural Committee. (g)Building modifications All permitted accessory structures and additions or other modifications thereto,and any modification of the initial residential Building,including any breezeway or other structure connecting an addition to the main dwelling,shall conform in architecture,material and color to such dwelling. Any attached addition to the initial residential dwelling shall not project more than five(5)feet beyond the front wall of the structure as originally approved.and in no event shall such projection extend beyond the setback requirements set forth above. (h)Construction regulations All exterior construction,painting and grading shalt be completed within one(1)year after beginning construction,which beginning shall be determined by a written notice from the property owner to the Architectural Review Committee. Driveways must be designed so as to accommodate a minimum of four(4)parked cars. During construction or modification of any building and/or structure permitted under paragraphs(f) and(g)above,debris and waste shall be confined to the building site by maintenance of(a)portable toilet facilities for construction workers,(b)cartage disposal containers such as"dumpsters"and(c) barrier fencing such as"snow fence"an the perimeter of the building site. No construction work shall be performed on any Sunday.except work by the owner,nor shall construction work of any nature begin before 7:OOAM on any day of the week -4- 5.RESTRICTION ON DIVISION AND USE OF LOTS No lot shall be subdivided without prior approval of the Southold Town Planning Hoard,Zoning Board of Appeals or other governmental agencies.This provision shall run in perpetuity. 6.RESIDENTIAL USE OF LOTS No lot shall be used except for residential purposes only. 7.SIGNS No sign of any kind shall be displayed to the public view on any lot except signs indicating house number,name of occupant and/or a security company_ &ANIMALS No animals,livestock or poultry of any kind shall be raised.bred or kept on any lot,except that dogs, cats or other household pets are permitted,provided that they are not kept,bred or maintained for any commercial purposes.ALL pets must be housed in the main residence only. 9.TRAILERS,TENTS AND SHACKS (a)No house trailer or motor home shall be located on any lot,except temporarily with the permission of Association officers.No vehicle with commercial registration shall be located on any lot,with the exception of small farm or pickup trucks. No vehicles with commercial signs or logos are permitted on any lot.Lawn tractors,mowers,carts,barrows,mopeds and motorcycles must be garaged.No unlicensed automobiles,or automobiles under repair or dismantled may be stored on any lot unless garaged. (b)No tent.shack or other such structure shall be located an any lot except in accordance with paragraph 4(b)above.Tents for occasional social events are permitted as long as they are taken down within seventy-two(72)hours after the events_Play tents.playhouses and recreational equipment for children are permitted,but must be located in the rear yard.on the ground and must comply with setback requirements. 10.ANNOYING AC71VMES No noxious or offensive activity shall be carried out upon any lot,nor shall anything be done thereon which may be or may become an annoyance to the neighborhood,examples being burning garbage, leaves,tree trunks,etc.or playing of Loud music. Drones may only be operated on the owners property and must be kept below the roof level of the house and not cross onto or fly over anothers property,as this could be considered an invasion of a person's privacy. -5- 11.TRASH No garbage,rubbish or garden waste shall be dumped or allowed to remain on any lot,or in the drainage area,park and wetlands of Country Club Estates.Garbage and refuse for collection must be contained in closed containers,either garaged or shielded from view by low decorative fencing or shrubbery. 12.CLOTHESLINES Clotheslines are forbidden anywhere on the grounds of Country Club Estates property that are viewableto the public and/or neighbors. 13.FENCES Approval must be secured from the Architectural Review Committee with respect to type and placement before installation of any fence. No fence isto exceed four(4)feet in height unless approved by the Architectural Committee. 14.BOATS AND BOATTRAILERS No boats,personal watercraft,snowmobiles or traiters for same shall be stored an any lot unless garaged,nor in the park and wetlands of Country Club Estates. 15.GRADING The elevation or grade of any lot shall not be changed so as to materially affect the surface grade of the surrounding tots. 16.ROAD AND PARI(FACILITIES (a)Surface water drainage system Roads within the subdivision have been constructed in such a manner that the area constructed, sloped,shaped,graded and seeded so as to provide a surface water recharge system for the proper drainage of surface water within such subdivision.in orderto ensure that such drainage system shall function properly,the following covenants and restrictions are hereby imposed upon the area of each lot abutting a road in the subdivision to a distance of twelve(12)feet therefrom(herein referred to as the drainage area),which restrictions shall run in perpetuity. 1. The owner of each lot shat!maintain the drainage area thereon free from leaves,debris and other matter which may impede the flow and/or percolation of surface water over and into the drainage area. 2. No trees,shrubs,plantings or other vegetation except grass shall be planted or maintained in the drainage area without the written consent of the Country Club Estates Property Owners' Association and the Planning Board of the Town of Southold. 3. No sand,gravel,loam or other material shall be deposited in the drainage area.nor shall any material be removed therefrom without the written consent of the Property Owners'Association and the Planning Board of the Town of Southold. 4. No fences or other structures shall be placed or maintained in the drainage area without the written consent of the Property Owners'Association and the Planning Board of the Town of Southold. 5. The Town of Southold shall have the right to enter the drainage area and to construct,maintain, -6- repair and remove such drainage pipes.culverts.catch basins,sumps and other facilities and to perform such excavating,filling,grading and seeding operations as any be deemed necessary for surface drainage purposes. (b)Park and marsh area As indicated on the subdivision map,a park and marsh area has been set aside by the original developer,COUNTRY CLUB ESTATES,for the use of lot owners,their guests and invitees. (c)Use of park and marsh area All owners of lots are hereby granted the right to use the parkand marsh area,in common with others, at their own risk,pursuant to reasonable regulations from time to time promulgated by the Country Club Estates Property Owners'Association. No sanitary facilities shalt be constructed or installed within one hundred(100)feet of the marshland. No structures,duck blinds,backstops,goal posts,basketball,standards,or other fixed athletic equipment are permitted in the park.drainage area or wetlands of Country Club Estates.No boats,boat trailers,mopeds,dirt bikes,motor scooters,motorcycles,house trailers,campers,tents.automobiles or recreational vehicles are permitted in the park,drainage area or wetlands of Country Club Estates. Use of the parkland for special events and community activities is permissible with the approval of the officers of the Association. Each member agrees to comply with any regulations for the use of the park and marsh facilities as may be enacted by the Association. 17.WINDMILLS AND TOWERS No windmill for the purpose of pumping water or producing power,and no towerfor transmitting or receiving radio or television signals shall be located on any lot in Country Club Estates. 18.MAINTENANCE OF ENTRANCE GATES (a)Lots 1,2,3,4,5,6.14 and 29 have had Installed upon them decorative split-rail fence and/or entrance gates by the developer.The purchasers of said lots shall take them subject to same and agree that said fences and/or gates shall not be removed except to provide space necessary for a driveway entrance. (b)The decorative split-ra€t fences along Moores lane,landscaping at the entrances and in the circle on Country Club Drive shall be maintained by the Association. 19.TREES Property owners agree that Honey Locust trees planted on lots fronting Moores Lane and Country Club Drive shall be maintained in good condition and not removed unless damaged or diseased.All trees damaged or destroyed due to disease or weather are expected to be removed in a timely manner by the Individual.lot owner.The Association will assume responsibility in case of damage to the tree in the circle on Country Club Drive and to trees in the park and marsh area. -7- 20.WALKWAYS,DRIVEWAYS.LAWNS AND GARDENS Walkways and driveways must be maintained free and clear of any debris,overgrown-grass and weeds, hazardous material orweather-related damage. All types of damage must be repaired as soon as possible to ensure public safety on walkways and driveways.Lawns and gardens are expected to be kept in a neat,orderly manner.Lawns should be mowed weekly during the growing season.Front yard gardens should be kept free and clear of debris and overgrowing weeds so as to create a clean appealing visual.Excessive statuary in front yards should be kept to a minimum. 21.SNOW REMOVAL Property owners who opt for snow removal,including hiring a private contractor,should be mindful not to Infringe,blockor cause damage to their neighbors'property. 22.UTILITY EASEMENTS An easement along the roads on the map of CountryCtub Estates and over anyother area necessary is hereby expressly reserved for conduits and all proper and necessary attachments for electric, telephone,water,gas and cable television service,provided that such easement shalt be over areas designated by municipal or public authorities. 23.FOREGOING RESTRICTIONS All of the foregoing restrictions are intended to cover onlythe plots shown on the map of Country Club Estates and are not extended to any other property. 24.MODIFICATIONS.TERMINATIONS orANNULMENTS COUNTRY CLUB ESTATES PROPERTY OWNERS ASSOCIATION hereby reserves the right to modify, terminate or annul any of the covenants in whole or part without the consent of any persons.
