MCLALCHLIN,'his wife, both residing' at 129 Commnwealth Street, Franklin Square, New York PSYNCT SECTION BLOCK LOT party of the second part, Ism fir= WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable-;consi tion paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,' ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beingirF at Mattituck, Torun of Southold, County of Suffolk and State of New York, bounded arra described as follows: BEGINNING at a point on the center line of a 31 foot private road knaan as Maple Avenue at the northeasterly corner of land now or formerly of ,John Mutttt, said point of beginning being 380.77 feet easterly along the center ` line of said Maple Avenue from its intersection with the easterly side of Granit Avenue; ruucuig Thence along said center line of Maple Avenue North 750 44' West, 115.67 feet to land now or formerly of Frances M. Ehrite; running thence along said land South 190 51' East, 505 feet to the approximate high water rretrk of Long Creek as of 1917, thence southerly along said high water mark of Long Creek, the tie line of which bears South 43 39' West, 89.67 feet to said land now or formerly of Martina and Paul Suter; thence along said land North 230 26' West, 557.36 feet to the point or place of BEGINNING. TOGETHER with a right of way over Maple Aventle from the northwesterly corner of the premises westerly 380.77 feet to Grand Avenue. AISO with a right of way over the northerly half of Maple Avenue abutting the northerly line of the premises. SUBJECT to a right of way over the southerly half of Maple Avenue across the northerly end of the premises. BEING AND INTENDED to be the same premises conveyed to the party of the first part by deed dated 11/6/72 and recorded in the Suffolk County Clerk's Office on 11/10/72 in Liber 7280 cp 75. SUBJECT to a mortgage held by Southold Savings Bank dated November 6, 1972 and recorded in the Suffolk County Clerk's Office in Liber 6545 page 390 in the face amount of $29,500.00 on which there is now due the sum of $23,067.77 and interest. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and t3 said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party, of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a gust fund to be applied first for the purpose of paying the cost of the improvement and will apply tete same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture 5o requires.
