Southold Town Board of Appeals
After investigation and inspection the Board finds that the
applicant requests permission to build new one family dwelling with
reduced front yard setback. The Board is not in agreement with the
reasoning of the applicant. The Board feels that the applicant has
adequate property on which to locate all of the proposed facilities.
The Board finds that strict application of the Ordinance
would not produce practical ~ifficulties or unnecessary hardship;
the hardship created is not unique and would be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance would change the
character of the district and would not observe the spirit of
the Ordinance,
THEREFORE, IT WAS RESOLVED Gregory Dawson, 54 West 16th
Street, New York City, New York, be DENIED permission to build

is requested forthe reason that increasing the front setback from the present 25'-0" to the
Zoning Ordinance requirement of 35'-0" to the nearest point of the structure from the
street property jeopardizes the length of use of pool facility and structure due to
erosion of shore line.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sa~ HARDSHIP because it would require shifting the house north on the side toward the
Sound and the edge of the bluff which drops off sharply to the beach. Moving the. house
in this direction wo~ld necessitate relocating the proposed pool to the side of the house
where it would receive t~inim~m protection from the projecting Wing of the house and be
closer to the adjoining Property ~thus affording less privacy to this owner and adjacent
property owner.
The property is on the Sound approximately 50' above the shore line, Over recent
years erosion' has been at an intense rate and it is therefore necessary to build the
stz~cture a sufficient distance from the cliff edge.Thus the proposed str~ct~re is caught
in the middle between the cliff (and erosion) and strict application of the Zoning
Ordinance.
It would appear more reasonable and possible to waive strict application of the
Ordinance than to change'nature.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because .Lots 2 and 3 (this property) are
shallower, in;~depth from the street to the' bluff than the other two lots on the water
front~ These four lots are the only properties of 16 in this development area on the
bluff overlooking the Sound ....
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because only a pozc. ion of the garage would intrude on
the 35'-0" setback. This part of the structure is only one-story high,and grade at this
point is lower than the street. The rest of the house, part of which is two-stories,
is set well behind the required 35'-0" line. The house siding is to be cedar finished
to weather a natural soft gray to blend with .the s~rroundings and other older structures
of the area. In addition the drive approach and planting is such that the house will be
screened from the road.

15th RE: Dawson at Birch Hills lots 2&3
Please be advised that we used the State Building Code as our
building requirements.
Basicaly we require a 35 foot OR average setback in the block
for any dwelling. A total of 25 foot in sideyards - no side less than
10 feet. A rear yard of at least 25 feet. The Minimum house would be
850 square feet of living area.
Copies of the zoning ordinance are 25¢ each.
A permit is required from the Health Dept for cesspools and
well. On reverse side of enclosed a?lication forms are minimum require-
ments~ detailed specs can be obtained from the Co~ty health dept
county center, Hiverhead.

We are the architects for Mr. Gregory Dawson who has
recently purchased Lots 2 and 3 in the Birch Hills Development and
contemplates building on them. We would like to know if you have
a local building code or use the State Code also do you have any
special requirements such as set backs for buildings or septic
tank fields, etc. In addition we would appreciate knowing if there
are any other utilities besides electric available.
