The Board is not in agreement with the reasoning of the applicant. The Board feels that the applicant has adequate property on which to locate all of the proposed facilities. REASON FOP, APPEAL ( ) A Variance to Section 280A Subsection 3 CX ) A Variance to the Zoning Ordinance ( ) is requested forthe reason that increasing the front setback from the present 25'-0" to the Zoning Ordinance requirement of 35'-0" to the nearest point of the structure from the street property jeopardizes the length of use of pool facility and structure due to erosion of shore line. ~omn (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sa~ HARDSHIP because it would require shifting the house north on the side toward the Sound and the edge of the bluff which drops off sharply to the beach. Moving the. house in this direction wo~ld necessitate relocating the proposed pool to the side of the house where it would receive t~inim~m protection from the projecting Wing of the house and be closer to the adjoining Property ~thus affording less privacy to this owner and adjacent property owner. The property is on the Sound approximately 50' above the shore line, Over recent years erosion' has been at an intense rate and it is therefore necessary to build the stz~cture a sufficient distance from the cliff edge.Thus the proposed str~ct~re is caught in the middle between the cliff (and erosion) and strict application of the Zoning Ordinance. It would appear more reasonable and possible to waive strict application of the Ordinance than to change'nature. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because .Lots 2 and 3 (this property) are shallower, in;~depth from the street to the' bluff than the other two lots on the water front~ These four lots are the only properties of 16 in this development area on the bluff overlooking the Sound .... 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because only a pozc. ion of the garage would intrude on the 35'-0" setback. This part of the structure is only one-story high,and grade at this point is lower than the street. The rest of the house, part of which is two-stories, is set well behind the required 35'-0" line. The house siding is to be cedar finished to weather a natural soft gray to blend with .the s~rroundings and other older structures of the area. Basicaly we require a 35 foot OR average setback in the block for any dwelling. A total of 25 foot in sideyards - no side less than 10 feet. A rear yard of at least 25 feet. The Minimum house would be 850 square feet of living area. Copies of the zoning ordinance are 25¢ each. A permit is required from the Health Dept for cesspools and well.
