Southold Town Board of Appeals
After invest~tion and inspection the Board finds that the
applicant requests permission to construct accessory building in
sideyard 'area with insufficient Setback. The location of cesspools
prevents the garage from being located any further to the rear of
the property. The lot is triangular, facing on two streets;
cesspools are in the center of the rear yard. The setback will
be comparable to other homes in.the area. The Board agrees with
the reasoning of the applicant
The Board finds that strict application of the Ordinance would
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would nOtbe shared by all properties alike
in the immediate vicinity of this property and in the same use
district; and the variance will not change~ the~character' of the
neighborhood and will observe the spirit of the Ordinance.
THEREFORE, IT WAS RESOLVED Harold Kober, Eastwnod Drive
Extension & Holden Avenue, Outchogue, New York, be GRANTED permissi~
to construct accessory building in sideyard area' with insufficient
setback on property located: Eastwood Drive Extension & Holden Avenue,
Cutchogue, New York, as applied for.
