By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous deeislons of the Building Inspector ( ) be confirmed ( ) be reversed. These lots are part of a subdivision which was set up in 1925 with 50ft. frontage. T~e applicant has 3 lots with a total of 150ft. frontage. The applicant wishes to divide the parcel in half and create 2 lots'with a'frontage of 78.95 ft. for each lot. The Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the district and will observe the spirit of the Ordinance. Form (Continue on other side) REASON FOR APPEAL Continued 1, STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces sary HARDSHIP because when the development was set up in d925, ~he had 50 foot frontages with the exception of those which fronted an arc of the raod; and a great many of the houses in the development are on 50 foot lots; therefore, it would be most difficu}t to d±soose of this property as one parcel and receive an adequate consideration. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because this is the only .ot ±n ti e vincinity with a~rontage of over JS0 feet. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because as stated in ?aragraph J~ the was set up on a 50 foot front lot basis and most of the houses a~e on one such lot.
