BARGAIN AND SALE DEED
THIS INDENTURE is made as of the /T day of February, 2022, by Marratime
Capital, LLC, a New York limited liability company having an address at 71 15th Avenue, Sea
Cliff, New York 11575 (hereinafter called "Grantor") in favor of Michael Choi and Kelly Choi,
having an address at 225 5th Avenue, Apt. 7S, New York, New York 10010 (hereinafter called
"Grantee").
WITNESSETH:
That Grantor, in consideration of Ten ($10.00) Dollars and other valuable consideration
paid by Grantee,the receipt and sufficiency of which are hereby acknowledged, does hereby grant
and release unto Grantee, and the heirs or successors and assigns of Grantee, forever:
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate,lying and being in the Town of Southold, County of Suffolk, State of New
York more particularly described in Schedule A attached hereto (the "Property");
together with all right, title and interest, if any, of the Grantor in and to any streets and
roads abutting the above described property to the center lines thereof,
together with the appurtenances and all the estate and rights of the party of Grantor in and
to said premises;
together with,and subject to, all of the rights, obligations,easements,restrictions and other
provisions set forth in the Declaration of Covenants and Restrictions dated September 7,
2013 recorded September 13, 2017 in the office of the Clerk of Suffolk County at Liber
00012929, Page 418, together with the By-laws and Rules and Regulations of the Estates
at Royalton Homeowners Association, Inc., as each of the same may be amended from
time to time and any amendments thereto are hereinafter (collectively, the "HOA
Documents"); all of which shall constitute covenants running with the Property and shall
bind any person having at any time any interest or estate in the Property, as though recited
and stipulated at length herein;
subject also to such other liens, agreements, covenants, easements, restrictions, consents,
other matters of record as pertain to the Property as a matter of public record;
TO HAVE AND TO HOLD the same unto Grantee, and the heirs or successors and
assigns of Grantee, forever.
Grantor covenants that, except for the HOA Documents, Grantor has not done or suffered
anything whereby the Property has been encumbered in any way whatever. This covenant is for
the personal benefit of Grantee only and cannot be assigned to,exercised by, or inure to the benefit
of any other person or entity, including, without limitation, any insurer of Grantee's title or
successor to Grantee's interest.

AMENDED
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of
Southold, County of Suffolk and State of New York, known and designated as Lot No, 9 on
a certain map entitled, "Map of Estates of Royalton", filed in the Office of the Clerk of the
County of Suffolk on February 22, 2018 as Map No. 12105. Said lot being more particularly
bounded and described as follows:
BEGINNING at a point on the Easterly side of Royalton Row distant 536.10 feet Southerly
from Cox Neck Road;
RUNNING THENCE North 58 degrees 29 minutes 47 seconds East 175.00 feet;
RUNNING THENCE along the arc of a curve bearing to the right having a radius of 599.63
feet a distance of 133,69 feet;
RUNNING THENCE along the arc of a curve bearing to the left having a radius of 800.00
feet a distance of 57.02 feet;
RUNNING THENCE South 68 degrees 03 minutes 53 seconds West 182.28 feet to the
Easterly side of Royalton Row;
RUNNING THENCE along the easterly side of Royalton Row the following (2) courses and
distances:
1) Along the arc of a curve bearing to the right having a radius of 100.00 feet a
distance of 7.87 feet;
2) Along the arc of a curve bearing to the left having a radius of 424.63 feet a distance
of 154.21 feet to the point or place of BEGINNING.

Grantor, in compliance with Section 13 of the Lien Law of the State of New York,
covenants that Grantor will receive the consideration for this conveyance, and will hold the right
to receive such consideration,as a trust fund for the purpose of paying the cost of the improvements
at the Property required to be made by Grantor and will apply the same first to the payment of the
cost of such improvements before using any part of the same for any other purposes.
Grantee hereby accepts and ratifies the provisions of the HOA Documents and agrees to
comply with all the terms and provisions thereof.
The Property is intended for use as a one family dwelling.
The Property being conveyed herewith being the same premises described in deed made
by 55 Cox Neck Road Realty, LLC, recorded in the Office of the Clerk of Suffolk County on
December 11, 2020, in Liber 13082, Page 56.
The term "Grantee" shall be read as "Grantee" whenever the sense of this indenture so
requires.
