No. 5215 - RONALD CASSARA Property Location: 30185 Cabot Woods Road, Peconic; 1000-73.-4-1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 2.479-acre parcel is located on a private right-of-way referred to as Cabot Wood Road, off the north side of Middle Road (C.R. 48), in Peconic. The property is improved with an existing one-story frame house with wood decks and four accessory buildings, as shown on the on the June 29, 2000 survey, amended August 17, 2000, prepared by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's August 22, 2002 Notice of Disapproval, and Sections 100-33 and 100-230.4, denying a permit for (a) new additions and alterations to the existing dwelling at less than 100 feet from the closest bluff line and (b) a new accessory building in an area other than a rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 12, 2002 and January 16, 2003, which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The original plan prepared by Samuels & Steelman revised 8/21/02 proposed: (1) new additions and alterations to the existing dwelling at 14' north at the top of the bluff and 24'11" east to the top of the bluff, and (2)to demolish and build a new accessory garage (20' x 24') building at 6'7" from the side property line. At the December 12, 2002 hearing, the applicant through his architect offered increased setbacks for both structures, and on January 15, 2003, applicants' architect submitted a revised site plan proposing the following revisions: (a) a northerly setback at 40 feet from the top of the bluff for a new two-story frame residence with basement and wood porch, after demolishing the existing residence and filling the foundation, and (b) a new 20' x 24' accessory building at 8 ft. from the side property line. southwest of the dwelling Page 2—January 23, X '3 Appl. No. 5215—Ronald Cassera 73-4-1 at Peconic ADDITIONAL INFORMATION: Information was submitted by letter on December 12, 2002 from the Suffolk County Soil &Water Conservation District confirming the bluff face is very heavily vegetated overall, and although there are some glacial erratics and cobbles at the toe of the bluff, there is protection at the toe. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The setbacks of the dwelling will be increased from the present setback of 14' to a minimum of 40 feet. The garage setback is also increased from its present nonconforming location to a new location at 20 ft. in conformity with the code for a side yard setback line. Visually, the garage is in front of the dwelling and not in a side yard. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. 3. The relief requested is substantial, but the grant of alternative relief reduces the amount of relief necessary to utilize the existing ground areas that have been disturbed due to existence of the existing dwelling construction and established landscaped areas. 4. The difficulty has been self-created, since the applicants became aware of the conditions of the buildings, site and codes when the property was purchased. 5. No evidence has been submitted to suggest that the alternative relief noted below will have an adverse impact on the physical or environmental conditions in the neighborhood. Applicants are proposing several drywells for adequate containment of roof runoff, and will maintain good ground cover necessary to prevent erosion or drainage toward bluff areas. The applicant has obtained Trustees Coastal Zone Management Permit#5602 dated July 24, 2002. . 6. Grant of the alternative relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of a new home and garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Tortora, seconded by Member Oliva, and duly carried to • •Page 3—January 23, 20us Appl. GRANT the relief requested as applied for regarding the location of the new dwelling construction as shown on the site plan prepared by Samuels & Steelman revised 1/15/03; and to GRANT alternative relief to locate a new garage a minimum of 20 feet from the side property line, and in the yard area shown on the site plan revised 1/15/03. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. CASSARA RESIDENCE AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because there is ample separation between this house and garage and surrounding houses. At the far end of a long, private dirt road, this house and garage are invisible from any public space, except, in the case of the house, from the beach. The new construction on the beach side of the house will be within the pre-existing, non- conforming footprint, thereby minimizing visual impact from the beach. If anything, the proposed improvements will add value to the surrounding houses, by upgrading existing, substandard structures. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because the existing house and garage lie wholly within the required setback. Therefore any addition or significant modification, whether as a second floor or as an enlargement of the footprints, will violate the zoning ordinance. The only alternative to the area variance is to demolish the entire existing house and garage and move them a great distance back from the water (100 foot setback line is shown on SITE PLAN), or forgo the project entirely. (3) The amount of relief requested is not substantial because, as stated above, the entire proposed addition is both within the existing footprint (second floor) and away from the bluff edge and out of the Coastal Erosion Hazard Zone (first and second floor of house and garage) (4) The variance will NOT have an adverse effect nor impact on the physical or environmental conditions in the neighborhood or district because the proposed construction will be located away from the "bluff', so it will not have any greater impact on the sound beach than does the existing house and garage. The bluff is stable and no eroding. CHAIRWOMAN: If you give the board members a moment to review that because we do have so many last minute things coming in. We are showing 40' from the top of the bluff on the north side. What's the closest setback on the east side Tom? It's kind of hard to see here. MR. SAMUELS: I would say it's 25'. CHAIRWOMAN: And we have the garage that will be moved over a full 20'. MR. SAMUELS: Is that something that you wanted on time? CHAIRWOMAN: We had discussed that since it's complete rebuild. MR. SAMUELS: Right. In other words, the garage wouldn't meet the sideyard setback because it's in the front yard? CHAIRWOMAN I'm trying to see where you are going to be now. If you move it back, MR. SAMUELS: I guess that would be considered a front yard, therefore it needs to be the side yard because it's an accessory apartment in the front yard. If it has to be it can be I mean it's a little tight there with other things, but as you see there's lots of side areas so if it needs to be 20'. CHAIRWOMAN: You'd probably have to be a little bit to the southwest, but I think we can meet that. I don't have any questions, Member Oliva? MEMBER OLIVA: It's as far back as you can get it? MR. SAMUELS: It is. MEMBER OLIVA: I went up there yesterday and looked, I'm so leery about bluffs I really am and it's not in terribly good condition. It's a beautiful spot and I just worry about people's safety frankly. MR. SAMUELS: What is the condition of the bluff'? Was there a response from the Soil and Conservation folks? I'd be interested. CHAIRWOMAN: We do have that on the record, do you have a copy of that? MR. SAMUELS: I don't. Maybe 40' seems close, but our sense is that that bluff is not eroding and hasn't, we just met the 40' that was mentioned at the last meeting. CHAIRWOMAN: I can give you a brief summary. They did a sight inspection and the bluff is heavily vegetated overall toe of the bluff on the beach many glacier and cobbles which offer some protection does appear the height does not appear high tide reaches the toe of the bluff storm tides may reach, but there's no stabilization present here on either side of the bluff that has been cut downhill they are only cut about 4' from the bluffs surface, they are suggesting that they should be cut down at the bases. It's standard procedure as you know and root system left in tact. Several trees along the right top of the bluff should also be cut down. MEMBER ORLANDO: They are saying it's basically in good shape,just the drainage needs to go into leeching pools. MR. SAMUELS: Right. MEMBER ORLANDO: That would enhance the erosion. MEMBER OLIVA: There's also that gully there. MR. SAMUELS: That's actually the high point, or the line of the bluff is the high point then it slopes back away from it and the further the house moves away from the bluff actually the lower the land is and it's actually in a way interrupting natural even this location is interrupting natural drainage that goes into that ravine so we need to grade around that sort of carefully in order to make sure that, that's another reason we'd like to leave it closed to the bluff edge so it's not even lower on the site and therefore more in a hole MEMBER OLIVA: I do understand what that can be because that can erode away. CHAIRWOMAN: Do you have any questions Member Oliva? MEMBER OLIVA: No. CHAIRWOMAN. Member Orlando? MEMBER ORLANDO: No. CHAIRWOMAN: Member Goehringer? MEMBER GOEHRINGER: No. CHAIRWOMAN: Mr. Horning? The bluff face is very heavily vegetated overall. At the toe of the bluff and on the beach there are many glacial erratics and cobbles, which offer some protection. It does not appear that high tide reaches the toe of the bluff. Storm tides may reach it and there is no toe stabilization present hear or to either side of the lot. There are few trees on the bluff face that have been cut back, however they are only cut about four feet from the bluff face surface. These should be cut down at their bases and the root systems left intact. Several trees are right along the top edge of the bluff and should also be cut down at their bases. At this time the Bluff appears to be in relatively stabile condition. The house downspouts are exiting onto the ground surface and the grade around the house flows to the east where surface water runoff flows down the dirt path. A minor amount of erosion is evident along the Dirt Path, which may be eliminated by containing the roof runoff into drywells from the downspouts. The yard is in good sod cover and the drainage way that contains the Dirt Path is well vegetated with ground cover and grasses. Additions to the house will increase surface water runoff. Downspouts from the roof should be directed into drywells, which will reduce the impact on the Dirt Path. SAMUELS: It is. MEMBER OLIVA: I went up there yesterday and looked, I'm so leery about bluffs I really am and it's not in terribly good condition. It's a beautiful spot and I just worry about people's safety frankly. MR. SAMUELS: What is the condition of the bluff? Was there a response from the Soil and Conservation folks? I'd be interested. CHAIRWOMAN: We do have that on the record, do you have a copy of that? MR. SAMUELS: I don't. Maybe 40' seems close,but our sense is that that bluff is not eroding and hasn't, we just met the 40'that was mentioned at the last meeting. CHAIRWOMAN: I can give you a brief summary. They did a sight inspection and the bluff is heavily vegetated overall toe of the bluff on the beach many glacier and cobbles which offer some protection does appear the height does not appear high tide reaches the toe of the bluff storm tides may reach,but there's no stabilization present here on either side of the bluff that has been cut downhill they are only cut about 4' from the bluffs surface, they are suggesting that they should be cut down at the bases. It's standard procedure as you know and root system left in tact. Several trees along the right top of the bluff should also be cut down. MEMBER ORLANDO: They are saying it's basically in good shape,just the drainage needs to go into leeching pools. MR. SAMUELS: Right. MEMBER ORLANDO: That would enhance the erosion. SAMUELS: That's actually the high point, or the line of the bluff is the high point then it slopes back away from it and the further the house moves away from the bluff actually the lower the land is and it's actually in a way interrupting natural even this location is interrupting natural drainage that goes into that ravine so we need to grade around that sort of carefully in order to make sure that, that's another reason we'd like to leave it closed to-the bluff edge so it's not even lower on the site and therefore more in a hole.
