No. 5227— Charles and Maureen Bucket Property Location: 2695 Little Neck Road, Cutchogue; 1000-103-10-2.1. This is a request for a Variance under Section 100-33 based on the Building Departments Notice of Disapproval. Applicant is proposing to construct an accessory swimming pool in an area other than a rear yard. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 2.039-acre parcel is located on the west side of Strohson Road and the east side of Little Neck Road in Cutchogue. The property is improved with a two-story dwelling with attached garage as shown on the April 14, 1998 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's September 16, 2002 Notice of Disapproval denying a permit to locate a swimming pool structure in a front yard area instead of a rear yard as required under Code Section 100-33C. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning. Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: ' Applicants wish to construct a 20'x 40' swimming pool behind their-dwelling, at +- 361 feet from the easterly (front) property line facing Strohson Road and +740 feet from the existing house. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed 20 x 40 ft. swimming pool is proposed +-361 feet from the south property line and 40 ft. from the existing house, which is not uncommon in this community. The parcel has a depth of +- 535 feet, and is ka Page 2—January 23,2003 Appl.No.5227—C.Buckel 103-10-2.1 at Cuchogue 150 ft. wide. Because the property has two front yards and two side yards, there is no definition in the code for a rear yard for placement of accessory buildings without a variance. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The swimming pool by code is not permitted in the side or front yard, and this parcel has two front yards. 3. The variance requested is minimal. The proposed pool location meets or exceeds building setbacks for rear yards, and the parcel has a broad depth, with a great distance from the unimproved road. , - 4. The alleged difficulty was self-created since the property was purchased with knowledge of two front yards. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The lot is not located on or near a bluff or natural waterway, and minimal vegetation removal will be necessary for the pool installation. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Tortora, and duly carried to GRANT the Variance as applied for and shown on the survey dated April 14, 1998, with applicant's sketch of the pool location. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. This is a request for a Variance under Section 100-33 based on the Building Department's Notice of Disapproval. Applicant is proposing to construct an accessory swimming pool in an area other than a rear yard. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 2.039-acre parcel is located on the west side of Strohson Road and the east side of Little Neck Road in Cutchogue. The property is improved with a two-story dwelling with attached garage as shown on the April 14, 1998 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's September 16, 2002 Notice of Disapproval denying a permit to locate a swimming pool structure in a front yard area instead of a rear yard as required under Code Section 100-33C. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a 20'x 40' swimming pool behind their dwelling, at +- 361 feet from the easterly (front) property line facing Strohson Road and +-40 feet from the existing house. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed 20 x 40 ft. swimming pool is proposed +-361 feet from the south property line and 40 ft. from the existing house, which is not uncommon in this community. The parcel has a depth of +- 535 feet, and is 44 $a • O. Page 2—January 23,2003 Appl.No.5227—C.Buckel 103-10-2.1 at Cuchogue 150 ft. wide. Because the property has two front yards and two side yards, there is no definition in the code for a rear yard for placement of accessory buildings without a variance. 2 The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The swimming pool by code is not permitted in the side or front yard, and this parcel has two front yards. 3. The variance requested is minimal. The proposed pool location meets or exceeds building setbacks for rear yards, and the parcel has a broad depth, with a great distance from the unimproved road. 4. The alleged difficulty was self-created since the property was purchased with knowledge of two front yards. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The lot is not located on or near a bluff or natural waterway, and minimal vegetation removal will be necessary for the pool installation. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Tortora, and duly carried to GRANT the Variance as applied for and shown on the survey dated April 14, 1998, with applicant's sketch of the pool location. I'm trying to put a swimming pool in my quote backyard and I haven't got one. What I'm requesting is I guess to have my backyard redefined somehow or another. BUCKEL: It's a unique situation I think because of the way the property was subdivided. MEMBER ORLANDO: This is a 2-acre lot not to be subdivided in the future, no plans for that? MR. BUCKEL: That is correct. MEMBER ORLANDO: This is just ironic, 2 front yards. MR. BUCKEL: Yes,just because of the way they laid the property out in order to get 3 lots out of the 7 acres. MR. OLIVA: Did you know about the paper road? MR. BUCKEL: Yes it's on my survey and I knew it was there although when I visited the property, I think it was part of the subdivision plans initially probably to allow access to the other houses on the water, maybe on a later date,but it's a peculiar situation I understand. Had I connected the pool to the house it wouldn't have been a problem. I don't want the pool that close to my house and I don't want that much decking. I want to open my options for maybe a sunroom later, so I just wanted to have the pool in the backyard. MEMBER ORLANDO: There's no plans in the future to unmerge the lots that were originally from a subdivision. MR. BUCKEL: That's not possible. MEMBER ORLANDO: No other questions. That road in the back is just put on the surveys at the time the 3 lots were subdivided. My property happens to span from Little Neck Road to that paper road. I think it's a pretty straightforward issue. There are 2 requests for the existing house. It's a 3-bedroom 1 1/2 story house built about 1958. This house is pre-existing nonconforming now with the new setback distances. When it was built it was 10' side yard total of 25 on the west side that's one of our 1.7, we're extending the existing setback- CHAIRWOMAN: That's 11.6 existing and you're proposing with a 1-story addition that will bring it to 11.7. MR. FEILER: They are on a slightly angled location there it would give us 1/10th of a foot more than the minimum amount - 11.6. This is an addition to the front bedroom. There's one bedroom on the first floor, two bedrooms on the second floor. There's really no alternatives to add on to this addition, no other places to go except towards the front yard. Let's see, relief there is 3.3' request to the new setback minimum of 15' on the west side the existing side yard is 28.7. We are requesting an eight foot addition to that side into the sideyard it would give us 20.7'.
