No. 5261 —.HENRY F. SANTACROCE, JR. Property Location: 2520 Pine Tree Road, Cutchogue 1000-104-2-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 21,344+- sq. ft. parcel is located on the east side of Pine Tree Road at Peconic, shown as Lot 36 and part of Lot 37 on the Map of Nassau Farms, Map #1179. The property is improved with a single-family dwelling with attached garage (and 'as-built' deck addition). BASIS OF APPLICATION: Building Department's October 30, 2002 Notice of Disapproval, citing Code Sections 100-242A and 100-244B, for the location of the "as built" deck addition, for the reason that a portion of deck is less than 50 feet from the rear property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Variances are requested under Sections 100-242A and 100-244B for a deck 14 ft. by 30 ft. on an angle parallel with the rear of the existing dwelling and 33'5"from the rear property line at its closest point. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No apparent ill effects appear to exist affecting surrounding neighbors. The deck addition is at the rear of the dwelling and has a rear yard setback greater than the existing setback of the house at the southwest corner(28'6"). .T Page 2—January 23, 200.0 Appl. No. 5261 —Henry F. Santacroce, Jr. , 104-2-12 at Cutchogue 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The deck addition is built. It is not possible to build a deck in a reasonable location at the rear of the house that would meet the code's 50 ft. minimum setback, and there are no accessory structures existing in the rear yard. 3. The variance granted herein is substantial in relation to the code's 50-foot minimum rear yard requirement and represents a 33+- percent reduction. 4. The alleged difficulty has been self-created because construction took place without the required town permits. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The applicant is utilizing the rear access from the only available exit at the rear of the house. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition to a single-family residence while preserving and protecting the character of the neighborhood and will remain open to the sky. RESOLUTION/ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for and shown on the survey prepared August 15, 1995 by Anthony W. Lewandowski, L.S., with the condition that the deck shall remain open to the sky. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Variances are requested under Sections 100-242A and 100-244B for a deck 14 ft. by 30 ft. on an angle parallel with the rear of the existing dwelling and 33'5" from the rear property line at its closest point. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No apparent ill effects appear to exist affecting surrounding neighbors. The deck addition is built. It is not possible to build a deck in a reasonable location at the rear of the house that would meet the code's 50 ft. minimum setback, and there are no accessory structures existing in the rear yard. 3. The variance granted herein is substantial in relation to the code's 50-foot minimum rear yard requirement and represents a 33+- percent reduction. 4. The alleged difficulty has been self-created because construction took place without the required town permits. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The applicant is utilizing the rear access from the only available exit at the rear of the house. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition to a single-family residence while preserving and protecting the character of the neighborhood and will remain open to the sky. Then they told me I had to come here. I'm here requesting a variance for the setback in the backyard. One of the reasons why I'm requesting a variance is that my house is situated so far back on the property when I purchased it and the corner of the house, they tilted the house so they could I guess view the water and that corner of the house itself is even closer to the back line which is 28'6".
