No. 5233—JOSEPH J. SNELLENBURG Property Location: 1935 Old Woods Path, Southold; Parcel 1000-87-2-21. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type ll category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The property is a described parcel located on a private road referred to as Old Woods Path, Southold. The lot is improved with a two- story frame house and accessory building, and contains an area of 15,540 sq. ft. adjacent to the developed area of Nunnakoma Waters, as shown on the survey mapped dated November 8, 2002 prepared by Peconic Surveyors, L.S. BASIS OF APPLICATION: The applicant has filed an amendment to Building Permit #28632-z for the proposed installation of a (partial) bathroom. The Building Department in its September 20, 2002 Notice of Disapproval disallowed the bathroom for the reason that the new garage building constitutes a second dwelling, a use that is not permitted under Section 100-31A. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: A Variance is requested under Section 100- 31A for installation of a bathroom facility, containing a toilet and a sink, in a new accessory garage building. This garage/barn is under construction and referred to in a recent Building Permit (#28632-z), and for which an amendment is being requested by the Building Department. REASONS FOR BOARD ACTION : On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the neighborhood or a detriment to nearby properties. The applicant's builder-agent confirmed that the owner is in need of a storage building with a lavatory and sink, and with climate-controlled Page 2—January 23, cud3 1. Appl. No. 5223—Joseph J. Snellenburg , 1000-87-2-21 at Southold cooling-heating, in order to properly store the files, books and other library material. There is no undesirable change because the use of the building shall be as an accessory use and is not proposed as a dwelling or sleeping unit. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is a retired Family Court Judge and attorney-at-law, planning to properly store his files and law books in a building detached from the home. The accessory building is located with setbacks greater than 30 feet from all property lines in the code required rear yard. 3. The requested variance is not substantial because the request is for a non-habitable, detached storage building in the rear of his dwelling. 4. The difficulty has been self-created because the building is already under construction and the building permit has been stopped pending this appeal procedure. 5. No evidence has been submitted to suggest that this minor variance will have an • adverse impact on physical or environmental conditions in the neighborhood. • 6. The action set forth below is the minimum necessary and at the same time preserves and protects the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to GRANT the variance, as applied for, and shown on the plans prepared by Environmental East dated September 18, 2002, and SUBJECT TO THE FOLLOWING CONDITIONS- 1. The new structure shall be used for storage accessory purposes only. 2. The new structure is for non-habitable use only. 3. Any utilities associated with this structure are for the purpose of preserving files stored in this structure, and not for any other purpose. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, ( r • Frage 3—January 23, Appl. Which directly abuts the applicant Snellenburg property to our west. This letter expresses our objection to the requested variance for a bathroom in a detached accessory `garage'. We are already very dismayed about the excessive size (22' x 37') and height of this so-called `garage' that is almost the size of the applicant's residence,and wonder about the purpose and legality of a bathroom in a garage. We can only conclude that granting a variance will ultimately result in a substantial second residential structure on a relatively narrow lot in an exclusively single-family residential area. In our view,the spirit of the zoning and the character of our beautiful neighborhood have already been compromised by the presence of a `garage' of this bulk. If the reguested variance for a bathroom and septic system are approved,there is no practical way to prevent a kitchen from being installed in the near future to create a non- compliant residential unit. We are afraid that inevitably there will be an incentive to convert a `garage' to a `caretaker's residence or similar use. The property will resemble an over-built and unsightly compound, with potential for future expansion. Also, we question whether the sensitive coastal environment can safely accommodate an additional septic system. In addition, it should be noted that the applicant's property is at the end of a long and narrow private dirt road. How will the fire department, ambulance. or police get there in inclement weather? Lastly. The Board should be reminded that in 1987 the property owner illegally installed a non-complying property line fence that became the subject of a retroactive request that was denied. In the current case we question the applicant's motives for constructing an oversized `garage' with a bathroom. To reiterate,we urge the Board to deny the variance request because we believe it will eventually result in a second residential area. If granted,this variance will detract from the character of the surrounding neighborhood and have an adverse impact on adjacent property values and safety. The applicant should take note of any conditions of approval, which may be indicated on the plan or enclosed herein. If a subsurface sewage disposal system has been installed,the applicant must submit a certificate from a licensed sewage disposal installer, attesting that the system has been constructed according to the criteria of the Department. 3. If a well has been installed as the potable water supply, then the applicant must submit a well water analysis completed within one(1) year by a certified lab, and a well driller's certificate completed by a licensed well driller. If the well or water quality does not conform to standards, corrective measures will be required as described in the Department's "Private Water System Standards." Please note: water treatment units may not be installed without prior approval of the Department. 4. If public sewers are utilized for the dwelling, the applicant must also submit one (1) copy of the sewer line inspection approval from the sewer district. In districts operated by Suffolk County, one (1) original of Form S-9,duly executed by the Suffolk County Department of Public Works, and one(1)copy of a Suffolk County Department of Public Works field sketch are required. 5. In public water is utilized, a tap letter from the appropriate water district indicating that service has been completed to the dwelling will be required. 6.
