Property Location. 115 Sound Drive,Greenport; Parcel 1000-33-4-60. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: Applicants' property is a 24,884 sq. ft. lot with frontage along three streets: 173.21 feet along the east side of Sunset Lane, 236.83 feet along the south side of Sound Drive, and 49.21 feet along the west side of Sound Drive. The lot is improved with a one-story dwelling and accessory swimming pool as shown on the survey dated September 9, 2002 prepared by Peconic Surveyors,P.C. BASIS OF APPLICATION: Building Department's August 7, 2002 Notice of Disapproval, concerning two proposed deck additions, one with front yard at less than 40 feet and the other F with a rear yard at less than 50 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: A Variance is requested under Section 100-244B for permission to reduce the northerly front yard setback at 33.6 feet for a deck addition, and a rear yard setback at 30.3 feet for a second proposed deck. The northerly front deck is 6' x 29.8 ft. in size; the rear deck is 12' x 28' in size, as shown on the site survey prepared by Peconic Surveyors dated September 9, 2002. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is primarily developed with older homes on small non-conforming lots, many with setbacks that do not meet today's code requirements. The applicant has a non-conforming lot of 21,780 square feet and two front yards. Page 2—January 23. 2003 Appl. No. 52237—V. Speleotes 33-4-60 at Greenport , 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than a variance. The property is comprised of 21,780 square foot corner lot. Applicant's single family dwelling has an existing front yard setback of 39.6 feet and a rear yard setback of 37.2 feet. Without a variance the applicant would not be able to construct a two story deck on the front of the house or a deck on the rear of the house. 3. The variance granted is substantial in relation to the code requirement. However, it is not substantial in relation to the existing setbacks of other single- family dwellings in the neighborhood. The proposed front deck will be 33.6 feet from Sound Drive and the rear deck will be 30.3 feet from the rear yard line. The proposed decks will not be an obstruction to other dwellings in the neighborhood. 4. The alleged difficulty has been self- created because the applicant was aware of the non- conforming lot when he purchased the property. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on physical of environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a addition front two-story deck and a rear yard deck addition to his dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because the porch and decks being requested are typical with respects to other homes in the area. They are a common feature to homes here and as a result will not affect the character of the neighborhood. Question #2. The benefit sought, CANNOT be achieve by any other method than an area variance, because the uniqueness of the property having (3) front yards (Sunset Lane, Sound Drive and Sound Road) along with the overall peculiar shape of the property, forces us to contend with multiple setback conditions requiring an area variance in order to add them. The front additions will square of that portion of the house (along Sound Drive) that is currently set back 35 feet. The remaining portion of the house is set back an additional 6 feet. Our purpose is to square off the front by adding a deck/porch to the house that is flush with the portion already set back 35 feet. Please refer to tabulated "Sketch" section and see SKETCH# 1 regarding front condition described above. The rear deck is located in the only place a rear deck can be added to this particular house. Its location is fixed due to existing construction. The egress to and from the deck is from the family room (just north of the garage). The other rooms that face the rear yard are the bedrooms and the kitchen, which are not suitable for egress to and from the deck. Please refer to tabulated "Sketch" section and see SKETCH # 2 regarding rear condition described above. Question #3. The amount of relief requested is not substantial because the footprint of the house is being increase by 179 sq. ft. to square off the front of the house (by the walkway) along the Sound Drive side of the house. The proposed rear deck footprint is 12 feet x 28 feet, which is a 336 sq. ft. increase. The lot coverage was originally 17% and would become 19% with the deck additions. VASSILLIOS SPELEOTES: I'm Vassillios Speleotes and the reason for this application is what I wanted to try to do we had a fire this past spring and wanted to basically rebuild the house and with the addition of my 4`h child right before the fire and we needed some room added to the house and as you can see the property's like almost a diamond shaped property and I have like 3 front setback conditions. What I was trying to achieve is just squaring off the front of the house the existing portion of the bedroom already is at 35' setback from the road and what is was trying to do is square off the house by adding a front deck there. CHAIRWOMAN: A 2-story deck on Sound Drive? MR. SPELEOTES: That's one part of it. On the rear I know there's a 50' setback condition however there's already areas of the house you can see that encroach upon that. What I was trying to do is possibly add a rear deck in and if permitted be able to bring it as far to the edge of the garage to also create a squared off effect there. The one that's set 19'back from sunset. CHAIRWOMAN: It's kind of confusing because the survey did not match up with some of the figures on the notice of disapproval. It's possible the survey was done after the notice though. The deck addition, you have an existing setback of a rear yard setback of 37.2 correct? With the 28x12' deck that would bring it down to 30.3, is that correct? MR. SPELEOTES: With the additions that I'm requesting my lot coverage would still be under the 20%. CHAIRWOMAN: Mr. Goehringer. As you indicated this is a reopening of a hearing we had back in November at which point we presented our application to re-separate two 20,000 sq. ft. lots from approximately a 1.6 acre lot provided you with our rationale at that time that these, my client has paid taxes separately on these two lots for many, many years that there's a lot in-between which they sold off some time ago and the single family home has been constructed on there. We have contracts on both of these lots, actually contingent upon us obtaining the necessary waiver of merger and for other applications and we are back here to address any questions that the board may have. CHAIRWOMAN: Mr. McLaughlin we had discussed this application with legal council and it was our feeling that we would not look favorably on this application in terms of a waiver of merger for a number of reasons that all go right to the code. The lot appears to be substantially smaller than it would be creating lots that would be smaller than those existing on the neighborhood by very nature of the contract. On lot 3 the contract calls for the seller to provide 2000 cubic yards of fill under of statutes and under the provisions we are supposed to examine under the waiver provisions one of them is there will not be substantial filling. The Chairman also read letter from Town Clerk stating that notification by certified mail was made to: Corbett Jones. - THE CHAIRMAN: The application is accompanied by a County Tax Map indicating that applicant's lot is roughly triangular in shape with 49 feet on Sound Atealu'e~;•plus 237 feet on Sound Drive, and 173 feet' on Sunset Lane. It is in an area of generally small lots although the adjoining lot to the south is similar in size. A sketch furnished by the applicant indicates that the pool would be on the Sound Avenue side. ROBERT BERGEN: This seems to be the best location. MR. ROBERT DOUGLAS: We don't want to involve any of the good, big trees there. After investigation. and inspection the Board finds that applicant requests permission to construct. private ,swimming pool. in front yard area of property located at Sound Road., Sound Drive and Sunset Lane and also requests permission to use 5 foot fence for pool in front yard area. The findings of the Board are that applicant has a' unique hardship due to the shape of his lot. The Board agrees with the applicant that this is the best location fo•r a swimming poplx and also agrees that a 5 foot fence is preferable to a 4 foot fence in this particular instance. AOlicant has three. front yards. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary' hardship; the hardship created is unique and Would not be shared by all properties alike in the immediate vicinity of this property and in the same' use district; and the variance Will not change the character of the neighborhood, and will observe the spirit of the Ordinance.
