Cochran, Councilman George L. Penny IV, Councilwoman Ruth D. Oliva, Councilwoman Ellen M. Larsen, Town Clerk Judith T. Terry, Town Attorney James A. Schondebare. 9':10 A.M. - Board met with Charles Graves, the Board's CSEA contract negotiator; Executive Administrator Victor Lessard and Sr. Building Inspector Curtis Horton to discuss litigation; and Police Lieutenant Stanley Droskoski to .discuss possible litigation. 10:25 A.M. - Professor Walter Smith met with the Board historic archaeological sites with the Town. He advised the Town Board that Fort Corchaug_is a National Historical Site on the National Register, a site that may be soon under consideration for a sub.= division. Professor Smith said that Fort Corchaug is the only indian fort in if this part of the country, and suggested :the Board hire a part-time archaeologist to begin to identify historical sites to be preserved and explore funding for the Town's purchase of certain sites. 10:.45 A.M. - Bernard Heinisch appeared before the Board to urge them to see that the North Fork Housing Alliance goes to bid for the construction of the proposed 14 affordable 'homes resulting from the affordable housing lottery. He said an ad was run in a local newspaper rquesting proposals from builders, and about a month later the Alliance awarded the contract for the homes to Two Bears Builders without reveal'lng the price of each home.---Community Development Administrator ~lames McMahon,~present 'during the discussion, advised the Board that the daughter of Mr. Heinisch was one of the lottery winners and Mr. Heinisch wanted to build her home, which Mr. Heinisch denied. Mr. McMahon explained that the price of each home would vary considerably as the homeowners would be allowed deduc[ions for portions of the work they would do themselves.~--Mr. Heinisch again urged ithe Board to see that the Housing Alliance seeks competitive bids before proceeding any further with the project. 11:00 A.M. - For Discussion ltesm: {1) Memorandum from Historian Antonia Booth requesting permission for :the League of Women Voters to use a color picture re- production of the Southold Town Bicentennial Quilt as '~a postcard to sell as a fund- raiser. Town Board agreed. (2) Letter from Huntington Town Supervisor Toni Rettaliata notifying the Supervisor of a recent court decision ~oncerning zoning. (3) Request from Ground Water, Inc. to install one additional test well on Town property at '. Fishers Island (see resolution no. 24). (4) Letter from Legislator Gregory BlaSs requesting Board's input on placing two Southold TOwn projects in the Suffolk County Capital Budget for .1988:~'(see resolution no. 25). (5) Letter from .Greenport Pul3Iic ~chools concerning a proposed Student Interns.hip Program to begin in Septembe.~, .198.8 (see resolution no. 26). 11:25 A.M. - Board reviewed proposed resolutions for the Regular Meeting. 11:30 A.M. - Accountant John Cushman introduced Dave Riba and Tom Secreto of Triangle ConsUlting, who' made a presentation to the Board on the recent IBM computer system upgrade which can be accomplished at Town Hall by replacing the current central processing unit. They will prepare a proposal for the Board to review. 12 Noon - Recess for lunch. JUNE 28, 1988 1:45 P.M. - Work Session reconvenedand the Board met with representatives of Hawkins, Delafield & Wood, the Town's bonding counsel: Gerald Fernandez, Eric Peterson and Ron Grosser, to discuss methods of financing the proposed solid waste/ composting facility. Town Attorney Schondebare will meet and discuss further and make recommendations to the Board. 2:45 P.M. - William Gillool¥, Community Development Di~rector for the Village of Greenport~ met with the Board to request a firm commitment on the proposed recreational mooring facility to be constructed partially on Southold Town property by the Village at the,~'foot of Beach Road on Sterling Creek, Greenport (see resolution no. 28)'. 3:00 P.M, - Work Session recessed to~. hold the Regular Meeting. ~ REGULAR MEETING 3:00 P.M. Moved by CouncilwOman Larsen, seconded by the Entire Town Board, WHEREAS, the Student Councils o~ Greenport and Mattituck Schools are the c~loverning bodies of the student population; and WHEREAS, the members of the Student Councils of Greenport and Mattituck displayed civic pride,, concern for the appearing of the community and local waterfront; and WHEREAS, the Student Council and student bodies of Greenport and Mattituck High Schools-assisted in meeting the needs of the community by assisting the Southold Town HighWay Department in the Annual S~srin~ Beach~31ean-up b~ actively volunteer- i_ng the contribution of man hours and man power; and WHEREAS, ~the Town. SUPERVISOR MURPHY: Okay, moving on to the first item on your agenda, which is reports, lid Ilke to notify anyone that they are on file in the Town Clerk's Office for anyone who~s interested in reading them. 1. At this time ! would like to ask the Councilmen if they have anything further to report. Ruth? r COUNCILWOMAN OLIVA: Thank you very .much, Frank. On June 15th I attended the. Commerce. and tndustry ~ommittee meeting which George will report on. On June 16th we hacl a Housing Committee which Jean will report on. On June 20th I Went to Hauppauge for tl~e Special Groundwater Protection Area by the Long Island Regional Planning Board and we had a presentation by Sarah Mahlon of the Suffolk Coudty Water'~.Authority, and a presentation by the staff as to what they have done up to date. On June 20th I also attended the Planning Board meeting. On June 21st we had a Water Revitalization' meeting with Valerie Scopaz Shaw and Peter Walsh from the State. On._J.uoe~.22nd we had an Open Space Committee meeting. We had two people come in who hope to have something ac~.uired at Laurel Lake. We will perhaps ask for a clarification of their:'deeds and perhaps an appraisal. I think their asking price is. too high. And then we will work on a form similar to what the Farmland Preservation .Program had to give to applicants, and Valerie gave us an excellent presentation of just what is being proposed fo~ subdivision all over Town. She did a really good job. On June 22nd we had a Water Advisory Committee meeting where we had a presentation by Joe Baler about where the contaminents area and how it is spreading through the Town and he did a really fine job of getting some very v~alua'ble information to the committee, and we will ha~e another meeting on July 5th~. On June 24th we had Housing Committee, which again Jean will report on. And on June 27th I attended the Greenport Utility Committee meeting last night Where'we' had tour of some of th~ different facilities. Thank you very much. SUPERVISOR MURPHY: Thank you~ Ruth. George? COUNCILMAN PENNY: Yes, on the 15th we had a Commerce and Industry Committee meeting. The points of discussion were the time limits--the recommendation by the Commerce and Industry Committee for time limits to be set for the review cycle,or applications before the Planning Board, and we suggested this be incorporated into the Site Plan Review. The Chamber of Commerce--when I Say the Chamber of Commerce I mean...~; the Commerce and Industry Committee--recommending acquisition of parking area~ .n Southold ivillage which we're starting to research now. Also they're hoping for--we've got a communication from them today--better directional signs for the Southold village parking. We discussed the Master Plan status, and also the need for more screening at the Greenport Tourist Booth. We also discussed possible JUNE 28, 1988 limits on peddling in Southold Town. And I see some of the committee members are here now, and we discussed the--or the Commerce and Industry Committee discusse~ recommending a policy to the Town Board to use local contractors for municipal work, which I highly support. On the 22nd I attended the Water Advisory Committee which Ruth has already reported on. Thank you. SUPERVISOR MURPHY: Thank you, George. Jean? COUNCILWOMAN COCHRAN: Yes, as Ruth mentioned, and George, the Affordable Housinq Committee has been meeting and we're reviewing the Affordable Housing Law. We did have a meeting on the 16th and the 23rd, and we are scheduled again for July 7th at 3:0'0 P.M. We haven't completed our task yet because we spent ~ a great deal of ,time each time we meet on different sections and the nros and cons.!.~ On June 30th we had a Recreation Advisory meetin~]~ Attending were the ~eniors ~ and ou-r handicapped and Ken Reeves oUr ReCreation Director, and we reviewed the summer program which is in place, and also took any ideas and suggestions from those _involved for the winter program. On the 21st the Recreation Department and the Recreation~__Committee, Councilwoman Earsen and myself, along width Lieutenant Oroskoski and our Town Clerk .Judy, T.er~-y, we met with~the Lifeguards-and the Beach Attendants an~ reviewed the handbook with them and went, through the operations of working with the beaches for the summer. ! feel that we are, in pretty good shape. It's organized. We're hoping ~that we have a good summer ~t all tt~ beaches. COUNCILWOMAN OLIVA: May I' just add, Jean, I 'thought that was an excellent booklet' that was put out by the Rec. Department for rules and regs for the Beach Attendants and what have you. It was really very~ very well done~ SUPERVISOR MURPHY: I agree, it was. COUNCILWOMAN COCHRAN: Tha~nk~.:you. Most of the credit goes to Ken (Reeves). Actually the State is beginning to mandate certain things in relation to our beaches, and it was a handbook that we had to comply with, arid it was very well received by the Lifeguards and the Attendants. So I think Ellen would agree, w~'re looking forward to a ~good summer season. SUPERVISOR MURPHY: Can you guarantee nice weather? COUNCILWOMAN COCHRAN: No, not possible. SUPERVISOR MURPHY: Good sunny days on the beach. COUNCILWOMAN COCHRAN: Right. Yesterday Ellen, myself and Jim McMahon went up to Poughkeepsie for a Affordable Housing Conference. It was, in my mind, mediocre. We have brought back some materials. As many conferences go you spend 'more' time discussing the problem then you' do in discussing the solutions. Also I had the pleasure of attending the~Senior Citizen play on the 23rd. It was a fun day, and they certainly put a lot of work and effort into the production. That's about it, Frank. SUPERVISOR MURPHY: Thank YOu, Jean. Ellen? COUNCILWOMAN LARSEN: Thanks, Frank. On June 16th and 23rd, as Jean has already reported on, the Housing Committee met. Specifically we started looking at the ordinance to clarify the language of the existing Affordable Housing Oistrict zoning to produce and promote an expeditious and coordinated review with the Town Board on the Zone change and the Planning Board on Site Plan Approval. Our main goal is to clarify it_ both to the existing agencies within the Town and for. the applican.tS who are applying for AHD zoning changes. On the 27th, which was yesterday, Jean, Jim and I traveled to Poughkeepsie'for a day Conference on Affordable Housing]. The primary focus was the counties of Nassau and Suffolk and the counties in the lower and mj~d-Hudson Valley. region who are all suffering from affordable housing Crunch. I 'thihk What We have'in'common is that many of our areas of the ithese coun'ti.~S are season'al vacational areas that a~¢ommodated the tourists from ~the metro~i,~ta region who have become a second~-home buyer within these counties and has-Subsequently forced the price of housing higher'~. ._ Also .a ong with upzon ng in many of the out-I ying co;[tn~ties to two acres and_sometimes above. What the conference did cover was the mandate by the S'tate~of Ne~ York on providing for affordable housing in the terms of exclusionary zoning, and. exclusionary zoning limits the capacity for a toWn.to provide affordable .housing[: for its residents. Southold Town; of course, does have an AHO 'zone in'the law, but we are obliged to provide for affordab e housing. Another thing that I Was .able to get out of the conference Was the question that has been frequently asked, what is the definition of affordable housing.;? According t0 the people who work on state levels, county levels, local levels, affordab~ housing is two times the yearly income of the median average in the area. So if the median income for Southotd Town is somewhere around $30,000, then an affordable house price range would be two and a half times that. A~apartment is 30% of the income. After you start reaching a higher percentage than that, then you're hitting the 211 JUNE 28, 1988 vulnerability of local, rural, and in our case almost suburban resident to secure affordable housing in his own town. So there's an influx and a leaving of the area. In the case of New York City, their's being a 'higher rate of homelessness. 'these people just are homeless or on the streets. They can't find housing. In areas such as ours we're seeing, a migration out of our area and the metropolitan area for people who don~t have housing. I thought it was worthwhile. I came back happy that I attended. On the 21st, as Jean has already reported, we orientated approx- imately 20 Beach Attendar~s and Lifeguards who will. be employed by Southold Town for the first time. Then the following FridayF-it's not Town business, but it's fun business-'-the'Judges, the local Judges in Suffolk County had a gathering over at Pete Hannabury:'s 6n Shelter Island, so ! jumped' in the boat and Went over to the Town dock and Pete had made arrangements for me to tie up there. Had a beautiful evening with some of my fellow ~Judges. Stayed overnight and worked my way wearily, back through the fog two weeks ago Saturday. It was miserable out. there.. Got home in time for a wedding. And on FiShers Island our Walsh Park AffordaBle Housing project is plugging along. We're having problems with the DEC because of an Osprey nest is right in' the .way and we can't put any shovels in the ground until the 3rd of August I think is the date that they set up. And this past Saturday Fishers Island for the first time--we're:had a Boy,s State caqdidate before, but normally they've gone to Connecticut,. but this year the S-outhold American Legion. :wanted a Boy's State candidate to go to the New ..York group, so i brought the boy over to Orient Marina on Saturday--late Saturday afternoon and Judge Tedeschi, whose son is also is up--they're up at Boy's State now-~met me at the marina and the boy, Oavid Zanghetti from Fishers Island, stayed over with Fred and his family Saturday night and then they left 'Sunday morning. We're getting quite active on the Island now. We have two Troopers there, and I just signed my June report, my Justice Report, and it's the first time it's. been in four figures in a long time. 'So it is getting active on the Island. And tomorrow there are two gentlemen from Fishers Island that want to get a New York State License and they're flying over-- I'm meeting them at Mattituck Airport early in the morning, going out to Riverhead, and they'll, be flying back with me. So all in all Fishers Island is till on the map, Frank, thank you. SUPERVISOR MURPHY: Thank you, Raymond. As you can see everybody's been pretty.'bUsy... ] Would.just like to make one other comment and that was I attended the DEC puSlic I~ear!ng on the new regulations for landfills, and as usual ~ they re~,rite regulations some people foul up and they did it again, and we were able to spot'these. It just about knocked out composting, which they had no intention of doing, and .~ think it was just a mistake on their part and they promised to correct it. O~r consultant H2M and myself did appear and told them what we thought. I Would also jus~ to comment--th~ other night my wife and I attended the Greenport Rotary's 40th Anniversary, and this~ is the second club--about a month ago we attended Southold's, and it 'really is something to have a.service club like that being so active, two of them in the Town, for 40 years, and the original president for the first two years in G.reenpor:,t is still a member which is even more spectacular--and a very active member, Reg Hudson. Hopefully we'll~be able to correct some of these problems. COUNCILWOMAN LARSEN: May I just comment on Cablevision? SUPERVISOR ,MURPHY: Sure. COUNCILWOMAN LARSEN: We've discussed in the past that Cablevision, unless y.ou put y~our~-report in. writing, that we are not notified. Is there anyway that we can deal-with Cablevision to have them log telephone complaints then? SUPERVISOR MURPHY: That whole contract would probably have,:to be :redone.~. COUNCILWOMAN COCHRAN: It's in the contract only written notification of any complaints, so what I try to do is tell people that have a complaint is to do it in writing and not by telephone. SO we really don't see the real numbers. COUNCILWOMAN LARSEN: People feel that they're paying a bill and they shouldn't have to write a letter. COUNCILWOMAN COCHRAN: Exactly, the phone is more convenient. IV'. PUBLIC HEARINGS, SUPERVISOR' MURPHY: There are two public hearings beginning at 3:30, 3:30 - A proposed "Local Law in relation to Boats, Docks and Wharves". 3:35 .- A proposed "Local Law in relation to Peddling and Soliciting". V. RESOLUTIONS. SUPERVISOI~ MURPHY: it is not time for the public hearings so we'll move on to resolutions. I-,would just like to remind the:.~udience of our policy of the Town. Under the SEQR process DBM who is applying for an Affordable Housing project change of zone will also have to be before the Planning Board for a subdivision. If as a result of such investigation the character and business responsibility of the applicant are found to be satisfactory, the Chief of Police shall endorse on. the application his approval and return such application to the Town Clerk, who shall issue a license to the applicant, Such license shall contain the signature and seal of the issuing officer and shall show the name and address of said licensee, the kind of goods to be sold thereunder, the amount of fee paid, the date of issuance and the length of time the same shall be operative. 3. COUNCILWOMAN LARSEN: Yes, ,I'd just.like to~'comment that Greenport's Bill Gillo0ty from the Village of Greenport came'~a_'nd spoke with us and their Local Waterfront Revitalization Program is in place and they were entitled to $50,000 in grants, at which part will be applied to the railroad dock in Greenport to provide boat tie- ups and a park and another $27,000 has been provided to--what we just authorized by res01ution--a grant for a baymen's dock in Greenport. Southold Town is moving in the direction of completing their own Waterfront Revitalization Program through committee. We hope to have it in place as soon as possible, and that will entitle us to State grants that come from the Federal government. So there's benefit in movi.._~ right .along and getting it in place. Okay, that's what we're here for. We would like to know--and I have spoke with both you..and Mrs. Cochran. What can be done about parking--you know, where we're concerned right in the heart of Southold? What can be done about, parking in Southold Town?~ You know, years ago I came out here from Huntington, 25 years ago, so I've been here a long time. But the Town of Huntington, which part of'of my family are living, they have been doing quite a bit and they did quite a bit in'Huntington. The Town Board, the Town of Huntington, initiated parking for the village of Huntington which actually helped save the Town of Huntington village.~fro~ ~the shopping malls out on 110. So my point with regards to that and being here is to find out what can be done about getting some parl~ir~g. I don't know if it's up to us, up to you, or what we can all do together? SUPERVISOR MURPHY: As you ~realize, we've tried to negotiate with one of the property owners and they are not interested in selling either to you, to us, or to anybody, and we~ve brought up the question of could we condemn the land? Yes, we can condemn'the land, but no one has--no land has ever been condemned in Southold Town. We are looking into another piece and the Town Attorney is going to,talk to the owner about purchasing~ if:h~'s-irite~ested.. 'iThe man knocked out our lease several years ago, he wasn't interested,, but maybe he is now. We're trying. BILL VERME: I~ know you are. I know you and Jean we spoke to, and I guess Ellen we~ have too, and you've been trying. That's our main concern, just some- thing so we just don't relax and sit back and then say we're sorry. WORK SESSI~N 4:15 P-.~M. - The Town Board met with memb~.~s of the Planning Board, Open Space Committee, Water Advisory Committee and Farmland Committee to discuss the disposition of the 'la-~-~--set aside in cluster s~u-[~divisions which has historically been deeded to the subdivision's homeowner association. Town Attorney Schondebare has contacted other east end towns to determine how they handle these situations. Riverhead is just beginning to look at it,. East Hampton has tried municipal ownership, but iS not happy with that method, Southampton requires a certificate of incorporation from the homeowner's association if 'the open space is to be retained by the assoc- iation. Often, rather than do this the developer will deed the land to the town who then can lea~e it for agricultural purposes, use it for recreation~ or install site wells.
