No. 5240 - Scott&Julia Osler. Parcel 1000-111-7-3. Location of Property: 2145 Haywaters Road, Cutchogue. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. BASIS OF APPLICATION: The basis of this application is the Building Department's Notice of Disapproval dated October 9, 2002, amended December 16, 2002 and January 13, 2003, concerning applicant's submission of a building permit to construct additions and alterations to the existing dwelling. The reason stated in the Notice of Disapproval is that the setbacks are proposed at less than 15 feet from the side lot line and less than 35 feet for both side setbacks. The existing setback is noted as +/-4 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request a Variance under Sections 100-242A and 100-244, based on the concerning proposed additions/alterations to the existing dwelling, portions of which will be less than 15 feet from the side property line, and less than 35 ft. total side yards, on this 25,003 sq. ft. nonconforming sized parcel. The applicants' survey revised 1/13/03, prepared by John C Ehlers, L.S. shows new foundation dimensions of 22' x 29.8' proposed at the south end (garage area), and new deck, replacing the existing steps, stoop and patio, and a new Bilco door proposed at 5.5 ft. from the southerly side yard. The new setback for the foundation is confirmed by the surveyor to be 4.6 ft. (or +/- 4'7" plus 1 or 2 inches larger with siding). The setback of the new deck is 10.8' from the southerly side yard, exclusive of the Bilco door. PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the east side of Haywaters Road, Cutchogue. The property is also referred to as Lot#376 on the Map of Section D, Nassau Point Club Properties, Inc., consisting of 25,000 sq. ft. in area. The property is improved with a one-story frame house with attached garage and accessory shed as shown on the map as surveyed 11/24/97, revised 12/9/97 and 1/13/03. Page 2—January 23, am., ZBA Appl. No. 5240—Scott and Julia Osler Parcel 1000-111-7-3 at Cutchogue REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new addition of 22 ft. by 29.8 ft. will mirror the existing footprint and will not increase the existing setback of 4.5 ft., so there will be no undesirable change in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some other method feasible to pursue than a variance. The applicant wishes to expand due to a growing family need on a small lot. This reconstruction is not unreasonable and provides an opportunity that is feasible for applicant that outweighs the benefit to the public. 3. The requested variance is substantial and representing a 10'6" reduction from the 15 ft. code requirement for a minimum 15 ft. side yard setback. 4. The difficulty has been self-created, because the homeowner bought the existing house in a nonconforming setback location at 4'6" from the southerly side lot line. 5. There is no evidence that the grant of the variance will have an adverse impact on the physical or environmental conditions in the neighborhood or district. With the proposed new construction remaining in the original established setback (existing footprint), no new clearing of the site will be required. 6. Grant of the requested relief is the minimum necessary and adequate to enable the applicant to enjoy the benefit of the new reconstruction,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION OF THE BOARD. In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to Grant the variance as applied for, as shown on the survey map dated 1-13-03 prepared by John C. Ehlers, L.S. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, Page 3—January 23, 2003 ZBA Appl. Southold,NY 11971 Re: Request for consideration Ladies and Gentlemen: We would like to detail the events that have occurred and why we are pleading for consideration. In June 2002 our architect told us she thought we may need a variance for our renovation and that she had spoken to someone in the building department who agreed. We quickly notified that same person she spoke to in the building dept. of our intentions to renovate. Upon seeing our survey, preliminary drawing, and hearing our plan he indicated we would need a variance. We got the necessary papers, and applied for a disapproval on June 21, 2002. A few days after we dropped off our paperwork, the building dept. employee whom we had previously spoken to about needing a variance, left a message on our answering machine saying, "good news you do not need a variance". (We still have this message saved on our answering machine). This person told us to get our final drawings done and then submit them along with the building application for the permit. (The application for disapproval was sent back to us and is included within.) On Sept. 13, 2002,we tried to drop off our application and drawings and explained exactly what we were doing. A second party at the building dept. told us we needed a septic survey. This was a late Friday afternoon, so we were not able to set the wheels in motion until the following Monday. When trying to arrange for our septic survey, we were asked by the company we found to do the survey which one of two survey types we needed. Upon calling the building department, no one knew. We had to call our architect and engineer to help us determined that we, in fact, did not need a septic survey On Sept. 16, 2002 we completed the application and handed it, along with the drawings, into the building department. At that time they indicated the deck shown on the plans was outside the existing"footprint"and within 15 ft of the property line which meant we would need a variance. We had the deck removed from the plans. This took 1 week. On October 3,the person at the building dept. we have been dealing with through this entire process apologizes and says he made a mistake back in June. He explained this is an increase in non-conformity and we would, after all, need to apply for the variance. They are supposed to be the experts and help the local homeowners like ourselves who are inexperienced in the area of construction and codes avoid these kinds of mistakes and delays. THIS HAS COST US TO LOSE A MINIMUM OF 3 MONTHS!! Continue Pg. 2 Pg. 2 Now, since we did not pursue the variance further in June, as instructed by the building dept., we are facing a hardship. We have committed to a winter rental, which could run into an expensive part-time summer rental. We have a three yr. old girl and a 7 month old girl. It is not a consideration to have them in the house while construction and carpentry is underway. Our contractor has indicated he may have to take other jobs and may not be available if the variance takes until January to get resolved. Not to mention if December/January are harsh we may be delayed on setting the foundation. We have a home equity line of credit with specific and non-changeable terms. This will cause a financial hardship for sure. All of this is the result of the building dept. previously instructing us that it was not necessary to get a variance. Please let me be clear, we are not asking to bend the code to let us slide, we are just asking to be put in line where we should have been had the building dept. not ill-advised us to forget about applying for a variance. Until last Thursday we were planning on a mid-October start date. Now we are pleading for any and every possibility to be positioned in the schedule so that we can get the variance completed sometime before mid-December. This will be a loss of two months rent and other expenses, but it will significantly ease the hardship we are facing if we can be given this consideration. MEMBER GOEHRINGER: Madame chairperson I had a long discussion with Mr. Osler sometime ago regarding this application and I don't know if he wants to go into the entire situation,but these people have been run around. CHAIRWOMAN: I kind of read through the record. Essentially you thought that this did not need a variance and then apparently what happened is you decided to do a whole new foundation there. MR. OSLER: I think there was a big miscommunication. We went to the Building Department and explained to them what we were doing. We had a preliminary plan. The house we are talking about originally I believe it was a ranch with a detached garage. The previous owner attached the garage with a roof and made it a breezeway between the house and my garage. There's no foundation, there's no footings, there's nothing under there. We are now a family of we have 2 kids and we just converted a master bedroom into a living room, so we are living in very tight quarters. We are trying to give ourselves a living room so we can get some space. The idea was to just take down the existing garage and breezeway and build a big family room in it's footprint. We went to the Building Department and explained all this and because we are going to dig down for footings anyway, we are going to put a basement there. CHAIRWOMAN: Will that be a full basement over the 22x29' new addition? MR. OSLER: Yes right now it's just a slab and we are going to put a basement under there. At first the Building Department told us we might need a variance and our draftsperson told us we might need a variance, so we applied for one in June. Then I got a message on the phone from someone in the Building Department saying hey, I've got good news, you're building on the same footprint you don't need a variance. So we went with our plans and brought them in the middle of September. We gave them in took no exception except that now we have a deck and they said hey the deck is inside the setback so you need a variance for the deck. I said forget it I'll take the deck off and we will apply for a variance at a later date because we wanted to get this thing going so we could build through the wintertime because as everybody knows, rentals during the summertime are prohibitive. That was the whole intent. When we re-submitted the drawings with the deck crossed out, the Building Department said you know we have to apologize, we didn't grasp what you are doing here, you do need a variance. CHAIRWOMAN: What apparently triggered it is the fact that you are demolishing that part of the building and you're doing all new construction putting in a full basement. MR. OSLER: It's an increase in nonconforming. The house is what you are calling an existing nonconforming. The existing house is relatively small and owners are interested in making it into a full time house by mainly adding a master bedroom which is the addition on the front of the house adding an attached garage inside of the house and a deck in the rear. The problem arises from the fact that the ROW from Williamsburg Road runs through the middle of the property and the house was originally built very close to the existing canal. As a result of those 2 things, the additions that we are applying for a variance for. The additions are not unreasonable and the change in appearance of the property will not be significant from the standpoint of the visual impact on the front/road side of the property, the only addition will be the garage. There will be vehicles parked in that area now so I think that will be an improvement as far as the neighborhood is concerned.
