MEETING OF JANUARY 9, 2003

Property Location: 1300 Minnehaha Boulevard, Southold 1000-87-2-11
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review-falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is
implemented as planned.
PROPERTY FACTS/DESCRIPTION: Applicant's property has 72+- ft. along Minnehaha
Boulevard in Southold, lot depth of 115.40 ft. along the southerly property line and 101.20 feet
along the northerly property line. The lot is improved with a one-story frame house and
accessory frame garage, and accessory concrete slab structure, all as confirmed on the survey
prepared by Peconic Surveyors, P.C. updated January 10,2003.
. BASIS OF APPLICATION: Building Department's August 26, 2002 Notice of Disapproval for the
reason that the proposed second story additions are less than 35 feet from the front property line.
• FINDINGS OF FACT
The Zoning Board of,Appeals held a public hearing on this application on,December 12, 2002, at
which time written and oral evidence were presented. Based upon all testimony, documentation, '
personal inspection of the property, and other evidence, the Zoning Board finds the following
facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED:'Variances are requested under Section 100-244B for
the proposed second-story addition at 20.5 feet from the front lot line, at its closest point. (For
testimony and related information, please refer to the hearing record.)
REASONS FOR BOARD ACTION : On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties. The new improvements, as proposed,
do not extend beyond the existing footprint. This design is similar to those existing in this
residential community.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. Due to the undersized lot size and
limited side yards, this is a suitable plan for not expanding beyond the original footprint.
3. The requested variance is minimal and the front yard is preexisting at 20 ft. 5 inches.
4. The difficulty is self-created due to existing locations of buildings and utilities.

5. There is no evidence to suggest that this minor variance will have an adverse impact on
physical or environmental conditions in the neighborhood or district. With the proposed
new construction remaining in the same setback, and there being no new clearing of the
site necessary, there will be no impacts created to the surrounding community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Orlando,
seconded by Member Tortora, and duly carried, to
GRANT the variance as applied for, and shown on the plan prepared by DA Architecture
last dated 9/16/02, and survey prepared by Peconic Surveyors, P.C. October 4, 1095
(also updated January 10, 2003 as requested by the Board at the December 12, 2002
hearing for the record).
Vote of the Board: Ayes: Members Tortora (Chairwoman), Goehringer, Oliva, and Orlando.
(Member Horning of Fishers Island was absent. s' Resolution was duly adopted (4-0).

100 (Zoning), Code of the Town of Southold, the following hearing will be held by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold,
New York 11971, on Thursday, December 12, 2002, at the time noted below (or as soon
thereafter as possible):

CHAIRMAN: Good evening, could you state your name for the record?
DARIO AGARABI: Good evening, I'm Dario Agarabi I'm with the AR architecture for John
and Kathy Cheska.
CHAIRMAN: What would you like to tell us about this application?
MR. AGARABI: It's an existing nonconforming lot, smaller lot 7500 sq. ft. in a R-40 .
neighborhood the house itself a quarter to a third is within the front yard setback as it stands
now.
CHAIRMAN: 20' 5", or something like that?
MR. AGARABI: 20' 6" actually. The first floor again is an existing condition. What they
would like to do is add a 2nd floor to the existing footprint of the house. No new foundations, no
new extensions, basically just to take the existing roof, rip that off and create a new roof
structure with a higher peak allowing them to use the space within what would be considered a
2"d floor space. The front of the house has small porch, a three seasoned covered area, non-
heated space my guess that at some point in the past it was a porch. We'd like to create that as a
new porch in essence removing the structure that's there and creating a covered porch, front
porch way access.
CHAIRMAN: In the Notice of Disapproval when they say 20' 6" to the right-of-way they are
referring to Minnehaha Blvd. is that correct?
MR. AGARABI: That's correct.
CHAIRMAN: I was looking for a driveway. It was in the back of the house. I found no other
driveway. We are going to have to have a talk with those boys. Mrs. Oliva, any questions?
MEMBER OLIVA: All the houses are so close to the road there anyway and you're just trying
to make it a little bit bigger and give more moveable space to a tiny little house. It's kind of cute
really. I think the addition will be nice, I don't have any problem with it.
MR. AGARABI: That's exactly our impression.
CHAIRMAN: Mr. Orlando.
MEMBER ORLANDO: The existing footprint is being expanded or is it the same?
MR. AGARABI: No sir it's exactly the same.
MEMBER ORLANDO: Including the front porch then?
MR. AGARABI: Exactly.
MEMBER ORLANDO: Because I don't have a survey.
CHAIRMAN: Maybe you could give us one of those?
MR. AGARABI: As far as-
CHAIRMAN: Not tonight,just, we'd like to have it.
MEMBER ORLANDO: So the front yard setback now is 20' 6"?

hands I'll make a motion closing the hearing pending a receipt of a survey or site plan indicating
the placement of this house on this piece of property. Are you going to give us a survey or a site
plan?
MR. AGARABI: I'm going to see if we can get you a survey. I know we have an older survey
that the owners have given me. I can give you a copy of that.
CHAIRMAN: That would be helpful.
MEMBER ORLANDO: It's nice to have a certified, stamped survey saying that's the spot.
CHAIRMAN: I'm sure nothing has changed drastically there except for that little fence on the
one side.
