EXECUTIVE SESSION
Present: Supervisor Francis J. Murphy, Councilman George L. Penny IV, Council-
woman Ruth D. Oliva, Councilwoman Ellen M. Larsen, Town Clerk Judith T. Terry.
Absent: Justice Raymond W. Edwards (bad weather), Councilwoman Jean W. Cochran
(out of town). Also present: Town Attorney James A. Schondebare.
9AM-The Board met with Charles Graves, negotiator for the Town Board, to discuss
the CSEA negotiations. .
WORK SESSION
10:10 A.M. - Edward Siegmann, on behalf of the Mattituck Senior Citizens Club,
met with the Board to request them to come out against the tax law regarding condo-
minium real estate taxing structure (see resolution no. 31).
10:15 A.M. - The Town Board held two hearings pursuant to Chapter 90, Unsafe
Buildings, of the Code of the Town of Southold: Henry A. Pollak, south side Route
25, Laurel, and Ciacia Estate, corner of Route 25 and Pipes Neck Road, Greenport.
11:00 A.M. - For discussion items: (1) Request from the Tree C0mmitee to remove
inactive member Bonnie Urban and appoint Ronnie Wacker to fill the vacancy. Board
agreed to advertise for applicants (see resolution no. 19) since there is currently
a vacancy due to the resignation 'of Alice EckeFt. (2) Request from the Southold
Town Police Benevolent Association, Inc. for the Town Board t~ support the "1/60th"
bill which is presently before the State Assembly and Senate. Board wishes comments
from Accountant Cushman and Police Chief Winter before taking a position. (3) Request
for Town Board to go on record in support of Senate Bill No. S.2369 to amend the
Banking and other state laws relative to ~authorizing the deposit of certain public
funds of political subdivisions and school districts [see resolution no. 20). (4) Request
for the purchase of stationery and envelopes for the Tree Committee. Accountant
Cushman will asked to create a budget line and allocation for a resolution at the
May 31st meeting. (5) Discussion concerning attendance and arrangements for the
August 3rd Fishers Island Town Board meeting. (6) Applicastion of Sang Lee Farms,
Inc. for a trailer permit (see 2:00 P.M. discussion with Richard Lee (also see reso-
lution no. 23). (7) Discussion of fees of bond counsel. Town Attorney Schondebare
asked that this be held .until May 31st Board meeting. (8) Letter from the Southold
Town Fire Chiefs Council requesting permission to use a building-located at the
southwest portion of the disposal area for a 'smoke house for the training of volunteers.
Supervisor would like to check with the County first since they have been using
the requested building. (9} Resolution from the WaIer Advisory Committee requesting
the Town BOard to reaffirm their.position on the use of the If4% sales,tax (see reso-
lution no. 21). (10) Request from Fishers Island for the app0intment of Safe BTi
Mosquito Cor~trol., Program emplo eesy (see re~oluti0n ~o 223 (1i) Supervisor Murphy

11:20 A.M. - George Desmarias, H2M Group, met with the Board to review the Draft
Request for Proposals for a _Solid Waste/Sludge Composting Facility, and the time
schedule which calls for proposals to be submitted on July 28th. The Board was
requested to submit sugcj~sted changes :to the RFP by the end~ of next week so the
final product may be .printed and m~iled ~o Men,dots. '

!~:10 P.M. - Discussed litigation and personnel with Town Attorney Schondebare.
12:40 P.M. - Recess for lunch.
2:15 P.M. - Work Session reconvened and Board met with Richard Lee, San9 Lee
Farms, Inc., who requested approval of a trailer for housing a field/greenhouse
supervisor at his 26600 County Road 48, Cutchogue, site. Mr. Lee stated that rents
are too high in the area and a house trailer would be an economical solution. Mr.
Lee was advised that house trailers are only permitted in the Town under special ~
conditions and for housing due to high rents is not a permissible condition (see
resolution no. 23).
2:30 P.M. - Board audited outstanding vouchers.

A Regular Meetin9 of the Southold Town Board was held on Tuesday, May 17,
1988 at the SouthOId Town Hall, Main Road, Southold, New York. Supervisor Murphy
opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: Good evening. I would like to officially call this meeting
to order. The first order of business will be a resolution to approve _the audit of
the' bills of May 17th.

SUPERVISOR MURPHY: Okay, the first item on the agenda are Reports. These
Reports are all on file in the Town Clerk's Office for anyone who would like to read

9. CounCilmen's ~Reports. At this time I would like to ask the Councilmen
if they have anything special to report, starting on my right with Councilman Penny.
COUNCILMAN PENNY: Yes, Frank. I met with the Town Board and Dave Emilita
and reviewed the Generic Impact Statement and the results of the hearing on the
Master Plan. Tha~ was on the 10th. And last night attended the Water Advisory.
Committee meetin9. Thank you.
SUPERVISOR MURPHY: Thank you, George. Ellen?---I might commen~ at this time,
two Town Board members are out of State. One's in Colorado and one's in Philadelphia.

COUNCILWOMAN LARSEN: Thank you, Frank. I attended the meetin9 of theCode
Committee that was chaired by Councilwoman Oliva, where our main agenda item
was to review a proposed updating revision of our Site Plan Ordinance. Site plan
approval is required on all new commercial structures, any change in its use, or
any major additions. In its review the Planning Board looked at the property's
drainage, lighting, traffic flow, parking, buffer areas, and landscapes. The Planning
Board currently feelS that the site plan ordinance needs updating, seeing as it was
written in 1965, or a little bit after that, so we were dealing with that mainly at
that meeting. On Tuesday, May 10th, the Town Board met with Dave .Emilita, the
Environmental Planner, who's working on our Master Plan, to go through the format
that we will be following for adoption of the GElS to the Master Plan. On Wednesday,
May 11th, Councilwoman Oliva and myself held office hours again. I~d like to invite
anyone from the public who would like to attend. We're at Town Hall, at least one
of us, usually both of us, every Wednesday from 2:00 to 5:00 P'.M. On Thursday,
May 12th, there was a joint meetin9 of the Highway Committee and the Planninq
Board~ ~hich ~vas chaired by Councilwoman Cochran. Sidney Bowne, the engineer,
the Town Attorney, the Planning~.B~o, ard members, and myself, Councilwoman Oliva,
and Councilwoman Cochran were pre_sent to review the minor subdivision road specs.
The Planning Board found that they were developing an inconsistent pattern of roads
within the Town of Southold., so they asked the Highway Committee to come up with
some specifications that will a~ply to minor subs. We referred what we've come
up with to the Town Attorney and it will go from tH.ere to the Town Board. On
the evening of May 12th I attended League of Women Voters' Annual Dinner at the
General Wayne Inn. The guest speaker was Dr. Thomas Wickham, who spoke on
his agricultural experiences and philosophies that he accumulated with 25 years
exp~.-~ence living abroad and working with agriculture in third world countries.
It was a very interesting evening. He's a wonderful speaker. On Friday, May
13th, Highway Superintendent Ray Jacobs, a representative of the Suffol~ County
Department of Public Health, Councilwoman Cochran and I, along with Ken Reeves,

did a tour and inspection of all our Town beaches, there are six of them. We reviewed~
them for compliance with the Suffolk ~County Sanitary and Health Codes. We found
generally that the beaches and the buildings associated with the beaches were in
very good condition. There are some minor improvements that have to be made--normal
and usual repairs. We also found out at the time that the Town has to develop
an emergency response plan to drowning and medical treatment that are nor required
due to new State regulations. Ken Reeves, who is the head of our Recreation Depart-
ment, will be working with the Board of Health to develop them for Southold Town.
We had one bit of really nice news from Ray Jacobs in that the Student Council
from Mattituck and Cutchogue'worked in the beaches in that area and gathered over
200 bags of garbage for pi~:k Up bY the HJghway Department. 'This Was a tremendous
help to an already overloaded Highway Dep~'rtm~nt s~aff. ~'Later that day we found
out that Greenport was going down to clean Gull Pond. We were very disappointed
in Gull Pond, ma.nly because of the vandalism that's there.~ '['he Highway Departmef~
has gone to the extent of installing public Phone bOoths at'least three times and
they're ripped oul:. There was a lot of'g~-~ffiti~ ~a~lot of b~ok~n glass down there,
bUt on the other hand the Student CoUncil fron~ GreenPo~t~haS volunteered to paint
the building, it just turned out that the Highway Department had already gotten
down there. I hope that We can publicly'congratulate th~ Students ~prior to the
opening of the Town beaches. At 2:00 .P.M. of that §ame~. ~ft~noon, S~pervisor Murphy,
Town Clerk Terry, Ken Reeves~ myself and Councii~oman ~bchran attended our
Senior Citizens' Sports Awards where the various senior citizen clubs compete against
one another in tournaments for different sports and they have a good time. They
had a great time. It was a nice afternoon. Yesterday, Monday, May 16th, I attended
a Water Advisory_ Committee meetin~ with Counci man Penny and Counci wo~nan Oliva.
We have a new and enlarged Water Advisory Committee that consists of people from
the scientific community, people from the business community, and member~ of the
farming community. We felt we have a very well-rounded .board right now so every
aspect can be addressed. The first meetin~ that they hel~! they were given a great
deal of literature to review on Suffolk County water ~Upp~y, ali the many studies _
that have been done, and the past work of the Water Advisory Committee. They
were asked to digest that and come to this Water Advisory' Committee meeting wi~h
any questions that they may have. Their questions were all discussed among them-
selves and it was agreed at the next meeting that they will look at~ directly, the
proposed Core Watershed Area for the Town and Come back~ to the committe~ with
their feelings on that. The only other thing I'd like to say, Frank, is since we've ~,~
been involved with the Landfill, and Frank took us down !0 the Town Dump a few
weeks ago, where he badge of equipment that W~s s6i:tlng out and filtering
out areas that had been previously ~ used as dump sites--filled areas of the dump~an~~
as they were digging this up we were told that it was an area that was filled al~:~t
25 years ago, and we became really aware of how plastic can sit 'in the Landfill.
Plastic was being dug, it was sitting there very nicely. And now just to show how
a town job can get you, I was at a nice dinner out to a restaurant on Saturday :
and had a wonderful meal, and as the waitress came with butter in little plastic
container and, of course, instead of enjoying the dinner ! thouqht about this plastic
that's going to end up in our Landfill, and I wanted to say, "~hy didn't you just
slice the butter and put it on a plate and save us from another few inches?" But
to go from not so good to good, I had a bluefish dinner tonight--the bluefish are
in and that's really living. Thanks, Frank.

JUSTICE EDWARDS: Thank you, Frank. I did not make any of the meetings--the
earlier Work Session today. It was difficult getting over from the Island--no flying,
and it takes two ferry boats and got into Town Hall after the second Work. Session.
I was also over here on the 10th at 9:30 for a 9:00 o'clock meeting, which I came
in at the tail end of. Nothing was loss, I did go down to the Motor Vehicle and
do my. thing for the people on the Island, and also found out that the Department
of Motor Vehicles will be comin9 over to the Island on Town Father's Day to do the
high school students that have had their driver s ed, and to upgrade any New York
State license holders on the Island who want to go from a Class 5 to a 3, .2 or what~
And they h~e-consented to do that on Town Father's Day~, which is a big~ big
help. They wi!l not do anything for the peo~!e off-island, the seasonal people..
It's strictly for the residents of the !sland, which is really a help to the people,
specially the kids. I mean for th~em ~to take their driver's ed over on Fishers Island
and New London and have to go do~n to White Plains and drive around there to
do their test, it's a bugger for them. So they're happy, and of course some of
the contractors--people who have to upgrade from a 5 to drive the oil trucks and
so forth and so on. State Police are are on the Island. Had my first lobster poacher
in last week and it cos~ him $145.00 for fishing in New York waters without ~the
proper permits and so forth, and the local Iobstermen are very happ~ about that
because the Department of Environmental Conservation had a brand new boat, ~it
must be close to $100~000. It's a beautiful thing, and they've made three or four
trips to the Island and th~ local Iobstermen are really looking for some enforcement
out there which we haven't had for the past couple years. So they're very happy
about that. The activity on the Island has been pi_~king up. People are there on

the weekends and a lot ~f. therr~ar~e~.st-ay;i:~$~,;~he;~kids are out of school. They've
all started their jobs over there. The iob market is wide open on the Island. Of
course housing is down, but most of~ these kids' parents do have homes on the Island
and they're tucked in for the summer and away they go. There's been a program
set up by the 'Fishers Island Conservation people, and With some help, I believe
from the Town and from the County, they're digging Wells out there to look down
and see' what we have for an aquifer. They've dug PrObably fifteen wells on the
Island, driving down. two inch casings. They've found some bad water, but they've
also found some excellent water. It looks like one of the best wells that theylve
found is within 50~ feet of the six~ inch water main, ,'of the water

problems with the w~ter Island, they ,have to' redo"the reservoir, and
in order.~o redo ~he;reservoir it will have to be done off season:and'they have to
have a source of water where they can drain down the reservoir and still be able
to pump into the mains. So they're looking for-a s. At Ieast
they have one of.them. I tasted the water Saturday excellent
quality. But just to go a little further in how a person water quality, !
had my little grandson with me--I don't know if you rememt~er last meeting I said
we were taking my boat back from Greenport, which we did~ had a beautiful trip--
left Brewers at 11:00 o'clock and were on the Island . and I showed
him a little spring [hat we have on the Island. We call and
this water b~bbles °~t of there two or three gallons a min~ peopl~e tell me
that this is a d~e !~nderneath the Island, and it's h believe that this
water's been coming-~ut 0f there for years and years and, to ,me it's
got to come from Connecticut someplace. I don't see how ~,e. re could be that much
water, fresh water. But my grandson, when I showed hl~ the spr~ng, I~e drank
from it and he looked at it how clear it was, but when welwer~t! dow,n to ithis new
well that they dug a~id he tasted that, he said, "You knoW,, ,Gramp~!~. thi~ tastes
different." And he's right. There's a little bit of iron to, the !Whitney
Spring is crystal clear and beautiful tasting. Enough on cut
over an emergency tAlephone system on the Island, that I
talked about ~vith Mr~. Clavin who's the President of the We

if they're in trouble can go and pick up the phone and Island,

SUPERVISOR MURPHy: Thank you, Raymond. I would just like to add, yesterday
there were a group c~f Rotary Exchange business people th~ visited Town Hall,
and they had planned to stay about two hours on their iti~rair~, and needless to
say we spent about an hour and a half talking about garbage.' ~:Fhey were from
the Philippines, and they have basically the exact same problems on the Philippines
that all of Lon~ Island, New York and this country are i~A~:f~a!ly facing, !and it was
really quite interesting to talk to them. They were very i~tePested in what we were
doin9, and that brings me to a couple of programs that we ,have in Southold Town.
Tomorrow we should get our final approval from the DEC on our Househo. ld Hazardous

Waste Storage Building. They re coming on a final mspectr(~n. We had a, Battery
Collection C~)ntest amgng the ~rade schools in Southold To~ and it was ~mazing,
almost 10,000 household batteries were collected in about a ~eeks time. Now, the
largest single source bf contamination of heavy metals, lea~'~~, cadmium, m~rcury,
zinc, come from household batteries, and you could imagin~'lhow much coA~amination
that could contribute to our groundwater with these 10,0~0: ~atteries put in one
spot. So fa~ we've collected about four or five 55 gallon diriums. We have contacted
a firm in Albany. It looks like some of these batteries ha~ great recycl:ing value,
and some have .a great cost to get rid of them, but the co$,,t~ on the who e program
will probably almost be a washout. It might"~ost us a litti~ s0mething, ~u~ tl~ ~ost
in the long run to .the taxpayer ~d-future generations on
metal contamination in the Landfill, in the ash from

I would like to cerement these are all on file in the Town Clerk's Office and they

SUPERVISOR MURPHY: Under Item III we have one communication from Gre~t Blass
concerning matching funds for water quality treatment districts.
IV. PUBLIC HEARINGS. (Four at 8:00 P.M.)
V. RESOLUTIONS.
SUPERVISOR MURPHY: Since we have our or five minutes before the public hearings,
we'll move on to Item V on the agenda, Resolutions. I would just like to comment
at this, time that anyone in the audience who would like to comment on any of the
proposed resolutions may do so at this time. We would ask anyone who would like
to address, the Town Board on any other matter to wait until after we finish the
resolutions and the final reports of the Councilmen and we will open up the meeting
for a time where anyone can address the Town Board on any other matter. -So at
this time I'd like' to ask anyone in the audience if they have anything to say about
any of the proPosed resolutions? Over on my left? In the middle? Over on the
right? (No response.) Hearing none, we'll move on to the first resolution which
is to accept a bid.

RESOLVED that the Town Board of the Town of Southold hereby accepts the bid-.
of Southold Lumber Co., Inc., in the amount of $8,850.31, for supplying the Town
with the necessary materials and hardware for the construction of Clam Racks.

SUPERVISOR MURPHY: Number 2 is to appoint Joseph Wysocki as a part-time Public
Safety Dispatcher, at a salary of $6.50 an hour. I offer that resolution.

RESOLVED that the Town Board of the Town of Southold hereby appoints Joseph
S. Wysocki as a part-time Public Safety Dispatcher, effective immediately, at a salary
of $6.50 per hour.

SUPERVISOR MURPHY: I would like to comment at this time that Mr. Mullen saved
the Town on year before and last year's insurance premiums, we got a refund of
over $166,000. I think he's done a fantastic job and publicly 1 would like to thank
him for the great job he has done.

in support of the policy of asking the State Legislators to change the real property
tax law. A resolution in support of this. Does anyone have any objection at this

SUPERVISOR MURPHY: Ray, this is dealing with condominiums and the unfair
assessments. We want to offer our support to ask the local delegation to change
this in Albany. Okay?

in support of the efforts of the Suffolk County United East End Seniors Council
who are attempting to secure legislation to amend the New York State Real Property
Tax Law to provide that single family residential properties and residential cooperative,
condominium and rental properties be assessed at the same ratio; and be it further
RESOLVED that a copy of this resolution be transmitted to New York State Senator
Kenneth P. LaValle and Assemblymen Joseph Sawicki, Jr. and John L. Behan.

SUPERVISOR MURPHY: Ellen?
COUNCILWOMAN LARSEN: Yes, one other thing. As most of you know who have
been involved with ~reading the local papers, we've talked quite about among the
Town Board members about the brown algae. There was a Peconic,Bay Task Force ·
that was formed that's comprised both of 'technical task force and a citizens advisory
task force. The technical task force deals with all the scientific data. The citizens
task force deals with educational policies. As a result of the Peconic Bay Task
Force efforts, in particular one lady· Mrs. Marriner, who's been very active with
them, they have submitted a tentative agenda for a Peconic Ba/y Day, which willy
be held on July 29th and July 30th. .They will have many,many events for this
day. They hope to have shoreline tours, different bays events, such as sailing
and rowingf a presentation made by sports fishermen, by seafood businessmen,
by boatersr by people involved with finfish culturing, people directly involved
in tourism, the baymen themselves, the Trustees. They plan to bring the DEC
down and involve a whole overall day devoted to the condition of the Bay, the
organism itself and the dynamics of the Brown Tide, the habitat and the productive-
ness. They're only getting started right now. I don't know if I can legally solicit
contributions. Can you do that that? I Can't do that. Okay. But they have
an educational committee that is devoted to just their promotion and-making everyone
aware that this is going to be available. So, I'm very proud of them. This will
be the first time it's ever been done locally and I'm sure that they'll get quite
a bit of involvement all the way around. Thank you, Frank.
SUPERVISOR MURPHY: Sounds like a very good program, Ellen. Thank you.

COUNCILMAN PENNY: Yes, I'm delighted to see that we have a second application
b~fore us fo~-~ an affordable housing program in the Town of Southold. We have
a second site which' has been submitted for ~rutiny. I'm heartened to see that.
developers have chosen,' rather than to take the 1/4 acre lot outline which is in
our Affordable Housing Law, and~'h~ve upgraded the lot sizes to 1/2 acres, which
will be available, hopefully, at some~time next year if everything goes through,
at a price somewhere between $26,000 and $27·000. This will give an opportunity
for qualified young people in our community to have a chance to -stay here. They'll
be able to buy a lot and eventually build their own house, or the builders will
come in and work for t~. But this is a big step. It took us a long time to
put the law together and response has been slow up until now, but now things
are starting to c~ to a head and I think there is a future for affordable housing
in Southold Town. Thank you.
