Project Description: Replace existing 91 sq.ft. deck with new wood deck, 199sq.ft.
(9.5'x20.9') located between the top of the bulkhead and the bottom of the slope.
Findings: The project meets all the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an
Administrative Permit allows for the operations as indicated on the site plan prepared by
Ural Talgat, Architect, last dated March 15, 2022, and stamped approved on April 13,
2022.
Special Conditions: Deck to be on-grade; the use of stainless steel hardware
fasteners used in construction.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code, a Wetland Permit will be
required.
This is not a determination from any other agency.

Re: LWRP Coastal Consistency Review for of MELISSA KATZ REVOCABLE TRUST

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The Board issued a Wetlands Permit(7682) in 2011 that required the removal of the
deck. In 2021, a second permit was issued for the parcel that does not mention the
deck.The deck remained in its original location in 2016 and is shown on the April 2022
aerial photos.
An unpermitted structure cannot be replaced. The proposed deck is located within a
FEMA VE—Velocity Hazard area and would be subject to loss from storm events.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
