Located: 645 Glen Court, Cutchogue. SCTM# 1000-83-1-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Located: 645 Glen Court, Cutchogue. SCTM#83-1-7 Inspected by: Shannon Wright, Carol Brown, Maggie Merrill The CAC does Not Support the application due to the inadequate setback of the in-ground spa from the top of the bluff of 41'. The CAC questions whether the spa is actually an in- ground swimming pool. Vote' of Council: Ayes: All Motion Carried Cantrell, Elizabeth From: Robert Herrmann <rherrmann@enconsultants.com> Sent: Thursday, March 24, 2022 4:52 PM To: Cantrell, Elizabeth Subject: RE:Acharya revised plans and project description Elizabeth,I'm sorry for the second email, but I should have said that we would only be comfortable proceeding administratively if the Board intends to approve the application as submitted,as the applicants would not want to forfeit their opportunity to be heard if the Board has any questions or concerns. From: Robert Herrmann [mailto:rherrmann@enconsultants.com] Sent: Thursday, March 24, 2022 5:02 PM To: Cantrell, Elizabeth Subject: Acharya revised plans and project description Elizabeth, As discussed by phone, the ZBA resolved to approve the proposed 64 sf spa but did not approve the proposed garage addition. It is therefore my understanding that in order for the Board to process our wetland application at their April meeting,we will need to eliminate the addition from the application that's already been submitted to you. To that end, please be advised that we wish to withdraw, without prejudice, the proposed garage addition at this time,as reflected on the attached site plan prepared by Barrett Bonacci&Van Weele,PC,last dated March 22,2022. Hard copies will be delivered to your office by Tuesday of next week. And the application project description should be modified to read as follows: Construct an 8' x 8' in-ground spa(in place of former chimney and existing grade-level masonry patio area),with 6'-high pool- enclosure fencing and 8' x 6' drywell for spa discharge, all as depicted on the survey/site plan prepared by Barrett Bonacci& Van Weele, PC, last dated March 22,2022. As discussed, please let me know if the Board finds that the application would now qualify for treatment as an administrative wetlands application. Please note, however, that we would only be comfortable proceeding administratively if the Board intends to approve the application,as the applicants would not want to forfeit their opportunity to be heard if the Board has any questions or concerns. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): Neither the proposed spa nor garage addition would adversely impact the adjacent bluff, shoreline,or tidal surface waters of Long Island Sound. The bluff is well vegetated and stabilized both at its toe and crest by retaining walls. The proposed 64 sf spa would be located 1)adjacent to the existing house,in place of a former chimney and existing patio area;2) approximately 41 feet from the retaining wall stabilizing the top of bluff;and 3)more than 140 feet from the surface waters of Long Island Sound. Therefore, while the spa would increase Town-defined lot coverage by 0.63 percentage points,it would not add to the impervious surface area of the property nor increase the property's erosion risks or risk of increased runoff. And with a minimum bluff setback of 95 feet, approximately half of the proposed 184 sf garage addition would be located outside Chapter 275 jurisdiction. Together the two structures would increase lot coverage by only 248 square feet. Nevertheless,to mitigate any risk of increased runoff toward Long Island Sound, drywells would be installed in connection with both the spa and garage addition to capture and recharge any associated potential runoff. Any potential increase in runoff would also be mitigated by the flat slope between the dwelling and top of bluff that is maintained and stabilized by the existing retaining wall, landward of which will be a 10-foot wide non-turf buffer established in association with recently issued Wetlands Permit No.10062. And a temporary project-limiting fence would be installed to contain site disturbance and limit potential surface runoff during construction. 4 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. The proposed 64 sf spa would be located 1) adjacent to the existing house, in place of a former chimney and existing patio area; 2) approximately 41 feet from the retaining wall stabilizing the top of bluff, and 3) more than 140 feet from the surface waters of Long Island Sound. Therefore, while the spa would increase Town-defined lot coverage by 0.63 percentage points, it would not add to the impervious surface area of the property nor increase the property's erosion risks or risk of increased runoff. And with a minimum bluff setback of 95 feet, approximately half of the proposed 184 sf garage addition would be located outside Chapter 275 jurisdiction. Together the two structures would increase lot coverage by only 248 square feet. Nevertheless, to mitigate any risk of increased runoff toward Long Island Sound, drywells would be installed in connection with both the spa and garage addition to capture and recharge any associated potential runoff. Any potential increase in runoff would also be mitigated by the flat slope between the dwelling and top of bluff that is maintained and stabilized by the existing retaining wall, landward of which will be a 10-foot wide non-turf buffer established in association with recently issued Wetlands Permit No. 10062. And a temporary project-limiting fence would be installed to contain site disturbance and limit potential surface runoff during construction. The limited project scope and proposed mitigation in the context of the existing site conditions thus make the project consistent with the goals of LWRP Polices 4, 5, and 6, namely the protection against flooding and erosion damage; protection of water quality; and protection of the quality and function of the surrounding Town of Southold ecosystem. -SEE ATTACHED ADENDUM- Attach additional sheets if necessary Policy 7.
