Located: 1700 Hyatt Road, Southold. SCTM# 1000-50-1-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. • The 10' wide non-disturbance buffer established in a 2012 Wetland Permit (7737A) has been cleared. Planting the area with irrigation dependent, fertilized species is counterproductive to the benefits of a non-disturbance buffer. • The proposal to create a Non-Disturbance area seaward of the top of bluff with existing vegetation to remain natural with selective hand pruning in order to maintain view shed is contradictory. The area is already protected by Board jurisdiction. Hand pruning would be defined as a disturbance. • Are the plants selected drought tolerant? Drought tolerant species are recommended. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: Damon Hagan, Assistant Town Attorney John G. Stein,Chairperson = Town Hall,53095 Main Rd. Lauren Standish,Secretary its P.O.Box 1179 Southold,NY 11971 Telephone(631)765-1889 Fax(631)765-1823 Conservation Advisory Council Town of Southold At the meeting of the Southold Town Conservation Advisory Council held Wed., April 6, 2022 the following recommendation was made: Moved by John Stein, seconded by Caroline Burghardt, it was RESOLVED to NOT SUPPORT the application of JOHN COSENZA for the landscape plan for the backyard within 100' from top of bluff. Natural regrade and remove firepit and flagpole and use natural bounders to maintain grade. Remove part of existing retaining wall located across lot. Located: 1700 Hyatt Rd., Southold. SCTM#50-1-5 Inspected by: John Stein, Caroline Burghardt The CAC does Not Support the application for the as-built structures. There is an extreme concern with the recent removal of the trees within 15' from the top of the bluff. The removal has destabilized the bluff and this entire area should be re-planted with the same diameter trees. Vote of Council: Ayes: All Motion Carried . y - DiSalvo, Diane From: Patricia C. Attached revised project description and cross section of"curb"detail to help illustrate how the slope will be treated. There is a retaining wall now built when the house was constructed and this retaining wall is being removed (as stated in the project description)and the slope is being made more natural. The Board will understand this plan when they do their site inspection.
