The Permittee,Southold Sunsets,LLC 4200 Kenney's Road Southold New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages',or claims for damages,of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense,defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. S. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work shall.cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the,work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. I will not further waste the Trustee's time recounting the years-long series of events; you are well-familiar with the history of the Kenney's/McCabe's community's opposition to several iterations of this project. I write not only to oppose the current application, but to make the point that this application is a bell-weather to what the Trustees can expect to start happening with increasing frequency if the application is allowed to stand. Just like what was done here, properties will (and already are) be purchased to be turned into short-term rentals, with wildly inappropriate opening bids (applications)made for large houses, accepting the risk that the Trustees will bring the project back down to earth. No loss for the developer, except for the Trustees and the community's time and effort. Then, when the community has expended years opposing a project, the build will commence, go past what was approved, and then the community and the Trustees will have to expend yet more time fixing the problem. Many won't have the energy to do that, or many developers just won't get caught. That is not a sustainable or fair way to conduct this process. Developers/applicants need to understand that their projects MUST follow the law from the first application, MUST be built to the exacting standards set forth in their permits, and ANY material deviation is liable to be rejected and removed, at their expense. The Kenney's/McCabe's community knew, seven years ago, exactly where 4200 Kenney's was headed—destruction of primary and secondary dune, disruption to the already- stressed natural habitat, and contentious back-and-forth over the final dimensions of the project. I wrote this to you almost exactly four years ago in connection with this application: "we still have serious questions about . . . how the actual demolition and re- construction of the premises (separate and apart from the final state of the new home)would be accomplished without damaging the surrounding dunes, which presently sit, in some cases, mere inches from the existing structure." "Southold Sunsets LLC" swore up and down to you that it was not a concern. All would be fine. They were wrong. Or they knew, and made an agreement with you that they had no intention of honoring. The Trustees, through hard work and significant time commitment, incorporated the community's concerns, and yet here we are in 2022, doing this yet again. Enough is enough. This same issue was brought up in December as I am sure you are aware, and at that time there was a letter from myself and comments from Carol Brown of the Conservation Advisory Committee. This application was denied and frankly nothing has changed with this current application. I understand that there need to be a place for the propane tank, yes there should be a driveway however the greatest infraction exists with the destruction of the dune and the planting next to the driveway with non native vegetation and the slate patio that has been placed in the middle of our fragile dune system. As was stated in the Dec 2021 Minutes on this matter the dune was completely intact prior to this project. The trustees were very generous in granting this project only to be blind sighted with these "as builds" that were not part of the original plan. I personally would like to see the patio removed, all non native plants removed and replanted in its entirely with our native American Beech Grass. This beach grass should be planted on at the minimum of 12"on center and not the 18" on center as proposed. The non native tall shrubs on the west side of the property should also be removed and beach grass planted. We planted the Kenney's Beach parking lot area 600ft x 15ft. in January 2002 and it was planted on 12 inch centers and it still took many years for it to become established to what it is today, a viable living dune.
