WHEREAS, DECLARANT is the owner of certain real property located on 4200
Kenny' s Road, Town of Southold, County of Suffolk, State of New York, described in
the Suffolk County Tax Map as District 1000, Section 54, Block 4, Lot 3 which is

more particularly bounded and described as set forth in Schedule "A" annexed hereto,
hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the "Trustees") pursuant to
Chapter 275 of the Town Code of the Town of Southold or its successor, and various
activities conducted upon the property may thus be subject to the regulation and
approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT therefore. made application to the Trustees for a permit
pursuant to the Wetlands Law of the Town of Southold to undertake certain regulated
activities; and
WHEREAS, as a condition of the granting of a Wetlands Permits No. 10169 &
10169C to undertake such regulated activities, the Trustees required the DECLARANT
to expand approved area of planting American Beach, grass to cover all additional
.areas approved @ 12 " on center; that the entire remaining property be established
and perpetually maintained as a non disturbance buffer, to remain in perpetuity
once re-vegetation is complete; and as depicted on the revised survey prepared by

12, 2023.
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as follows :
1) Upon the substantial completion of the aforementioned permitted activities
there shall be revegetation with American Beach Grass and that the entire
property shall be established and subsequently maintained a "non disturbance
area" as defined by Chapter 275 of the town Code: to wit:
"A vegetated area , as designated by the' Town of Southold Board of Trustees,
immediately landward of the wetland boundary, shoreline structures, or other
line designated by-.the Trustees where no operations maintenance, placement,
of signs or other activities may take place , except that man-made debris may °
be removed from such area by hand without the permission of the Board of
Trustees". An application for a wetland permit may be submitted for the removal
of harmful , "invasive " or non-native vegetation; and as depicted on the
survey prepared by G & A Land Surveying, Inc. , received on May 18, 2023 and
stamped approved on June 12, 2023 under the Town of Southold Board of Trustees
Permit Nos . 10169 & 10169C, dated June 15, 2023. ( see Schedule C annexed
hereto )
2) These covenants shall run with the land and shall be binding on the
DECLARANTS, heirs, assigns, purchasers, or successors in interest and may
only be modified after a public hearing and upon resolution of the Trustees .

TERMS AND CONDITIONS

The Permittee,Southold Sunsets,LLC 4200 Kenney's Road Southold New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages',or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension inay be made to the Board at a later date.
3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents,and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
S. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be.no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work
shall.cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the,work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in `
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

TERMS AND CONDITIONS

The Permittee, Southold Sunsets, LLC 4200 Kenney's Road, Southold, New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work
shall.cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in `
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

The Board of Town Trustees took the following action during its Regular meeting held on
Wednesday, June 15, 2022, regarding the above matter:
WHEREAS, Michael Kimack, on behalf of SOUTHOLD SUNSETS, LLC applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code,
Coastal Erosion Hazard Areas, application dated February 15, 2022, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Inconsistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program
Policy to the greatest extent possible through the imposition of the following Best Management
Practice requirements: the issuance of a permit for the structures; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
June 15, 2022, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111
of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of SOUTHOLD SUNSETS,
LLC for as-built above ground 500 gallon propane tank (30"x8', 20sq.ft.); as-built raised wood
platform for AC unit and electrical for I/A system (3'x9', 27sq.ft.) on east side of dwelling; as-built
on grade dry laid slate walkway on east side of dwelling (4'x46', 184sq.ft); as-built on grade dry
laid slate walkway not to exceed 4' in width on north side of dwelling (4'x47', 188sq.ft); as-built
partial concrete walkway with added dry laid slate walkway with landing (4'x46', 184sq.ft.) along
west side of dwelling; as-built Belgian block surround for gravel driveway (±140 linear feet)
along south and east sides of dwelling; as-built gravel driveway (±635sq.ft.) along south side of
dwelling; remove existing mulch surrounding planted vegetation; remove existing fire pit;
8'x12.2' (97.6sq.ft.) shed has been removed and not replaced; wood walkway along portion of
easterly side of dwelling has been removed and not replaced; and to expand approved area of
planting American Beach grass to cover all additional areas approved @ 12" on center; that
the entire remaining property be established and perpetually maintained as a non-disturbance
buffer, to remain in perpetuity once re-vegetation is complete; and as depicted on the revised
survey prepared by G&A Land Surveying Inc., received on May 18, 2023, and stamped
approved on June 12, 2023.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Re: Application for"As Built" Wetlands Permit by Southold Sunsets LLC
Dear Trustees,
I write in connection with the public hearing to take place April 13, 2022 regarding 4200
Kenney's Beach, and the current application. I will not further waste the Trustee's time
recounting the years-long series of events; you are well-familiar with the history of the
Kenney's/McCabe's community's opposition to several iterations of this project.
I write not only to oppose the current application, but to make the point that this
application is a bell-weather to what the Trustees can expect to start happening with increasing
frequency if the application is allowed to stand. Just like what was done here, properties will
(and already are) be purchased to be turned into short-term rentals, with wildly inappropriate
opening bids (applications)made for large houses, accepting the risk that the Trustees will bring
the project back down to earth. No loss for the developer, except for the Trustees and the
community's time and effort. Then, when the community has expended years opposing a project,
the build will commence, go past what was approved, and then the community and the Trustees
will have to expend yet more time fixing the problem. Many won't have the energy to do that, or
many developers just won't get caught.
That is not a sustainable or fair way to conduct this process. Developers/applicants need
to understand that their projects MUST follow the law from the first application, MUST be built
to the exacting standards set forth in their permits, and ANY material deviation is liable to be
rejected and removed, at their expense.
The Kenney's/McCabe's community knew, seven years ago, exactly where 4200
Kenney's was headed—destruction of primary and secondary dune, disruption to the already-
stressed natural habitat, and contentious back-and-forth over the final dimensions of the project.
I wrote this to you almost exactly four years ago in connection with this application:
"we still have serious questions about . . . how the actual demolition and re-
construction of the premises (separate and apart from the final state of the new
home)would be accomplished without damaging the surrounding dunes, which
presently sit, in some cases, mere inches from the existing structure."
"Southold Sunsets LLC" swore up and down to you that it was not a concern. All would be fine.
They were wrong. Or they knew, and made an agreement with you that they had no intention of
honoring.
The Trustees, through hard work and significant time commitment, incorporated the
community's concerns, and yet here we are in 2022, doing this yet again. Enough is enough.

Dear Trustees: In regards to the recent posting located on this property and the"as build" request. This same issue was
brought up in December as I am sure you are aware, and at that time there was a letter from myself and comments from
Carol Brown of the Conservation Advisory Committee. This application was denied and frankly nothing has changed with
this current application.
I understand that there need to be a place for the propane tank, yes there should be a driveway however the greatest
infraction exists with the destruction of the dune and the planting next to the driveway with non native vegetation and the
slate patio that has been placed in the middle of our fragile dune system.
As was stated in the Dec 2021 Minutes on this matter the dune was completely intact prior to this project. The trustees
were very generous in granting this project only to be blind sighted with these "as builds" that were not part of the original
plan.
I personally would like to see the patio removed, all non native plants removed and replanted in its entirely with our native
American Beech Grass. This beach grass should be planted on at the minimum of 12"on center and not the 18" on
center as proposed. The non native tall shrubs on the west side of the property should also be removed and beach grass
planted.
We planted the Kenney's Beach parking lot area 600ft x 15ft. in January 2002 and it was planted on 12 inch centers and
it still took many years for it to become established to what it is today, a viable living dune.

Michael Kimack on behalf of SOUTHOLD SUNSETS, LLC requests a Wetland Permit and a
Coastal Erosion Permit for the as-built above ground 500 gallon propane tank (30"x8', 20sq.ft.); as-
built raised wood platform for AC unit and electrical for I/A system (3'x9', 27sq.ft.) on east side of
dwelling; as-built on grade dry laid slate patio and walkway on north and east sides of dwelling
(±677sq.ft.); as-built partial concrete walkway with added dry laid slate walkway with landing
(±100sq.ft.) along west side of dwelling; as-built Belgian block surround for gravel driveway (±140
linear feet) along south and east sides of dwelling; as-built gravel driveway (±635sq.ft.) along south
side of dwelling; as-built outdoor shower with 4'x4' wood floor (16sq.ft.) adjacent to east side of
main staircase against deck surround; remove existing much surrounding planted vegetation;
remove existing fire pit; 8'x12.2' (97.6sq.ft.) shed has been removed and not replaced; wood
walkway along portion of easterly side of dwelling has been removed and not replaced; and to
expand approved area of planting American Beach grass to cover all additional areas approved @
18" on center. Located: 4200 Kenney's Road, Southold. SCTM# 1000-54-4-3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with
the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The as-built structures were constructed without Board of Trustee review or permit.
The removal of features and restorations of areas furthers Policies 4 and 6.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

2022 the following recommendation was made:
Moved by Carol Brown, seconded by Maggie Merrill, it was
RESOLVED to NOT SUPPORT the application of SOUTHOLD SUNSETS HOLDINGS
LLC to legalize amended landscape plan and as-built features and features to be
removed, including an above -ground propane tank, raised wood platform for AC unit and
electric for I/A system on east side of dwelling, on-grade laid slate patio and walkway,
partial existing concrete walkway with added dry laid slate walkway with landing, Belgian
block surround for gravel driveway, outdoor shower with wood floor, removal of existing
mulch surrounding planted vegetation and removal of existing fire pit. Expand approved
area of planting with American beach grass to cover all areas shown on landscape plan.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
