Box 1179 (516)765-1801 TELEPHONE a Southold, New York 11971 1 �il 1��� SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL The Southold Town Conservation Advisory Council held its regular meeting Tuesday, January 21, 1986. at 8: 00 P .M. at the Southold Town Hall, Main Road, Southold, New York. Present were: Martin H. Garrell, Chairman John Holzapfel, Member Heather Cusack, Member Jeanne Marrine.r, Member Ralph Condit, Member Linda Cooper, Secretary Absent were: Betty Wells, Member John Tuthill, Member Also present : Mr. Glenn Heidtmann - Wetland Application No. 336 Heather Cusack questioned whether all discussion leading to a recommendation were included in the minutes given to the Trustees . The Secretary stated only the reasons sited in the actual resolution were transmitted to the Trustees with the recommendations . Heather felt more information should be transmitted in support of CAC 's recommendations of disapprovals . As a result of thb;�discussion, it was suggested that the minutes! to the December 19, 1985 minutes be amended to include the following : Wetland Application No . 193A - In addition to the reasons already specified for disapproval, the Council would like to include the issue of prior violations , the resulting difficultieswith navigation, and the area :contains significant marsh land as additional reasons for disapproval . On a motion made by Ralph Condit, seconded by Jeanne Marrine.r it was RESOLVED to approve the minutes, as amended, of the meeting held December 19, 1985. Vote of Council: Ayes : All Motion carried. Discussions : Mr. Glenn Heidtmann - Wetland Application NO. 336 - appeared before the Council, at the Council' s request. to answer questions Page 2 concerning his application. Mr. Heidtmann stated he had placed cones on his property to locate the well and cesspool . The well would be located on the front of the property and the cesspool would be located on the back as per Suffolk County Board of Health specifications . When questioned as to whether he had received a DEC Freshwater Wetlands Permit , Mr. Heidtmann stated he recieved letters from the Department of State and the Army Corps of Engineers stating that the matter was "out of their jurisdiction" . He is awaiting a reply from the DEC and will comply with their decisions . Mr. Heidtmann was asked if he would consider a natural vegetation buffer between the house and the marsh area. instead of planting a lawn. Mr. Heidtmann assured the Council he would comply with the Trustees ' decision in this matter. The Council was concerned that excavation and construction has already started on Mr. Heidtmann ' s property. Mr. Heidtmann assured the Council he had only removed brambles from the property , and used a bulldozer within a minimum of 15' from the wetland area. He stated he cleared an area of only- 100-1 x 90-' on the property of 100 ' x 1801 . He stated he has verbal approval from the Health Department but must await the Trustees ' decision before he can receive written approval from the Health Department . In conclusion, Mr . Heidtmann said he would abide by all concerned departments ' decisions, but he did state that he did not believe the area in question is a true marshland but is instead an "artificial sump" . REPORTS : LONG ISLAND SOUND STUDY representative Martin Garrell reported the Citizens Advisory Committee (CAC) steering committee Pias been very active. Objectives and activities of the study will be available to the press: Also research results are 'starting to appear. New York Department of State SIGNIFICANT COASTAL FISH AND WILDLIFE HABITATS representatives Ralph Condit and Heather Cusack reported the Southold group has expanded the original boundaries. The group felt the protection of wetlands in Southold Town is equally if-ftot,)more important than bird nesting. The group has extended the boundaries to take in the entire creek whenever possible. JOINT MEETING OF EAST END CONSERVATION BOARDS is being set up for Saturday, March 8, 1986 . Martin Garrell plans to invite conservation groups from Southampton Town, Shelt( Yr Island Town, East Hampton Town, Riverhead Town and Dave Newton from the S . C . Extension. Possibilities for a keynote speaker would be a representative from Ko.ppleman's office or Steve Englebright, environmental activist and County legislator The CAC secretary will write a letter to the Southold Town Board for use of the Town Hall and permission to use CAC funds for coffee and doughnuts . Page 3 OLD BUSINESS: Jeanne Marriner suggested, at some time, someone should contact an attorney (possibly retired or someone from out of town) to aid in drawing up changes to the Town Ordinances . These changes then could be presented to the Town Board for approval. Some of the issues she feels should be addressed k)-are lawn sprinkling and its effects with saltwater intrusion, and changes along those lines . Martin Garrell stated Councilman Paul Stoutenburgh would like the CAC to send a letter to the Town Board regarding the sensitivity of the Sebastian Cove area. Jeanne Marriner will draft the letter. NEW BUSINESS : Jeanne Marriner attended a meeting with the Shelter Island CAC, Shelter Island Supervisor, Dave Newton and Ruth Oliva concernig ground water and waste disposal. This group is planning a media blitz to educate the public and if the program is successful they may need Southold CAC' s help in the future. WETLAND APPLICATIONS RECOMMENDATIONS Wetland Application No. 319 of Ted Dowd is still tabled. A letter was sent to Mr. Dowd requesting his presence at a future meeting to answer-,,questions concerning his application . Wetland Application No . 333 of Dr. Vincent Claps remains tabled until a letter by John Holzapfel is sent and action is taken by the applicant . On a motion made by Martin Garrell, seconded by Ralph Condit it was RESOLVED to table Wetland Application No. 33.5 of John .J. Newman to drive pilings to shore up existing garage and second story to be added. The Council feels it must table this matter pending approval of the two story garage. It appears two story= buildings go against the deed and covenants. If the garage receives approval then questions will be asked re: Cesspool capacity and loading . increase re: Pilings If the second story of the garage is not approved, then it is not clear if pilings are necessary. It is not clear that the garage is not currently safe - simply repair the cracks in the floor. Rip rap looks sound as is. Page 4 On a motion made by Ralph Condit, seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 334 submitted by En-Consultants, Inc. on behalf of John xikis to construct 200 ± l . f. timber retaining wall from corner to corner of adjacent retaining wall and approx- imately 10 ' in front of failing gabion wall . Backfill with 2751 cubic yards of clean sand to be tracked in from commercial upland source. Proposed wall will be above spring H. W. Construct a 50 ' stone groin approximately50 ' west of east property line and pre- fill up-drift side with 40± cubic yards of sand and gravel to be trucked in. The Council feels the present wall is serving its purpose there is no need for bulkheading. Also of concern is the severe impact on the downdrift neighbors of the proposed groin. In addition, creation of additional land to an existing beach is contrary to the existing Wetlands Ordinance. In conclusion, the applicant should leave AS IS, the stones and. screens appear quite secure. The cove is sheltered from the northwest by a natural point . Vote of Council: Ayes: All Motion Carried. On a motion made by Martin Garrell, seconded *by Jeanne Marriner, it was RESOLVED to table Wetland Application No. 336 submitted by Glenn Heidtmann. The Council wishes to await .-.notice from the DEC regarding Freshwater Wetlands. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 337 submitted by John Schoenstein to approximately 40 yds of fill for proposed building. The Council disapproves because: 1. The creek is about to be designated as a significant habitat . It is critical to vast freshwater wetlands and uplands :1 as far north as Moores Woods. 2. The setback is not observed with care on the present lot . Rubble fronting on the creek and banks are already a hazard. 3. The building can be sited perpendicular to current plan. 4. Town ordinances are already in question due to expansion of facilities and previous variances . Vote of Council : Ayes: All .Motion carried. On a motion made by Heather Cusack, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No . 338 submitted by Costello Marine Con- tracting Corp . on behalf of Albert J . Breneisen to install 110 ' upper retaining wall 30' above MHW, install 75' lower retaining wall 25' above MHW and install '.20' x 40 ' swimming pool 50 ' above MHW. The Council recommends disapproval because the pool would be within the 75 ' setback requirement and represents a severe - Page 5 Y alteration of the shoreline contour. Without the pool the retaining wall has no function. The Council suggests an alternative by placing' a smaller pool on the north side of the house. Note of Council.:; Ayes: All Motion carried. NEW APPLICATIONS: The next meeting of the Southold Town Conservation Advisory Council was scheduled for Wednesday, February. 19, 1986 at 8: 00 P.M. at the Southold Town Hall, Main Road, Southold, New York. Group inspections will be made on Wednesday, February 19, 1986 . The group will meet at the Southold Town Hall at 3: 00 P.M. New. applications were as follows : No. 339 - Group Inspection No. 340 - Group Inspection No. 341 - Group Inspection No. 342 - Group Inspection There being no further business to come before the Council on a motion made by Ralph Condit, seconded by Jeanne Marriner, it was RESOLVED to adjourn the meeting at 9: 59 P.M. Vote of Council: Ayes : All, Motion carried. The meeting reconvened at 10: 03 P.M. to discuss Wetland Application No. 324. On a motion made by Martin Garrell, seconded by Heather Cusack, it was RESOLVED to Fable Wetland Application No . 324 _of Arthur J. Bujnowski. The Council reinspected the application at . the request of the Town Trustees . After another inspection and being alerted that there were objections by neighbors, the Council decided to table the application pending a meeting of all those neighbors concerned in the surrounding properties . They need to find a solution to best handle the problem of erosion and property loss. The Council feels the property owners need an expert in. littoral drift to advise on proper placement of groins .
