CONSERVATION ADVISORY COUNCIL
The Southold Town Conservation 'Advisory Council met at
8: 00 P .M. , Tuesday, May 13, 1986 at the Southold Town Hall .
Present were: Martin Garrell , Chairman

Wetland Application 'No. 352 sub.mitt~ed by Richard Cantwell to
remove fill for area s-o placed by contractor .to the outside of
the 75" jurisdiction area of the tidtlands . Be it further
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland application No.' '352 and recommend applicant resubmit
application with clarification in regard to the difference between
the Trustee application and the DEC permit .

report for a proposed run-off survey,.. and study.

Martin Garrell reported on the State of the Sound Conference
he attended. Data from their studies will be made available soon.
The Circle the .Sound Cruise is planned for late summer and
a large conference is scheduled for October.
Heather Cusack attended the Environmental Quality Bond Act
meeting held in Hauppauge. The meeting was attended by mostly
East End representatives .
A large Suffolk County map was marked with existing parkland
and with the' parklands the State and County would like to acquire.
The were several parcels marked in Southold Town for proposed
acquision.
The Act earmarks 1 . 2 billion dollars for cleaning up toxic
waste dumps and 500 million dollars for land acquision.
The Bond issue will be on the ballot in the November election.
Until NOvemb.er the group will be meeting monthly in Riverhead.
Heather Cusack also attended a Pine Barrens Conference at
StonyB.rook. Among the speakers were guests from Maryland and
New Jersey who spoke .about preserving land and groundwater.
Some means of- doing this include transfer development rights
and 2% Real Estate Tax,
Jeannne Marriner reported on the Planning Board meeting she
attended. Th-e tw-o main topics of discussion we're th.e Norris
condos and Marina Bay.
The Marina B.ay has cut down the size of its project to
50 permanent slips and 44 transient slips.
Th.e Norris condo proposal is still set at 95 units .

Martin Garrell reported that .h.e had a discussion with. Jay
Tonski_ of Sea Grant. Mr . Tonski would like to speak to the
CAC Th.urs.day, June 19 , 1986 at 7 : 30 P .M.
Mr. Tonski will also be in contact. with Ralph.- Condit to
do on site inspections of Wetlands Applications: No . 369_ and No . 372
which are for proposed groins..

On a. motion made by Betty Wells , seconded by RAlph Condit, it was-
RESOLVED to recommend to the Southold Town Trustees dppro'val of
Wetland Application "No. 367 submitted by frank 'Licari to
construct. walk, ramp, and float at waterfront .

On a motion made by Martin Garrell, seconded by Jeanne Marriner, it was
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No . 375 submitted by Charles A. Mebus to remove
from the creek sand and dirt brought in by the highway storm drainage
pipe. The CAC also wishes to- notify the Trustees that a sump
is available to take the sewer run-off . Drainage may be altered
at the property, to go into the sump and cease the run-off into the
bay.

RESOLVED to recommend to the Southold Town Trustees disapproval
of wetland applcatiori 'No.'. 378 submitted b.y, Costello Marine Contract-
ing Corp . for 'Ethel and" Ar't'hur 'Town to install a 100 ' timber bulkhead
10 ' above HWM as close to the bluff as possible with (2) 10 ' returns .
50 c.y. of fill to be trucked in. There is no erosion problem,
th.erefore no need is shown to nece�s-itate" installation of a bulk-
head. Also there is no -bulkheading immediately adjacent to either
side of the property, therefore the Council does not want to see
a precadent set .

On a motion made by Martin Garrell, seconded by Ralph Condit, it was
RESOLVED to recommend -to the Southold Town Trustees approval of
wetland application No . 377 aulrmitted by Albert Roke to construct a
4' x 20 ' fixed dock leading to a 3 ' x 15 ' ramp leading to a 6 ' x 15 '
ramp, Said fixed dock shall be a minimum of 4' over existing marsh.

On a motion made b.y .Ralph. Condit , seconded by Martin Garrell , it was
RESOLVED to recommend to th.e - Southold Town Trustees disapproval
of wetland application 'No'. '378 submitted by 'L'ouise 'Moyle to reface
existing bulkh-ead by attaching new to existing. The CAC sees no
reason for a new b..ulkh.ead and damage to th.e marshland would occur
of 'th.e bulkhead was to be placed where proposed.

On a motion made' by Martin Garrell, seconded by Ralph Condit , it was
RESOLVED that any recommendation of disapproval for wetland application .
No . 379 submitted by J. H. " Geideman 'for Helmut Spitzenberger would
be moot, the work has been completed. The CAC does strongly recommend
that the Southold Town Trustees take PUNITIVE ACTION against the
applicant . The Council recommends that either a FINE be imposed or
order the applicant to MOVE THE BULKHEAD BACK. This action should
not go unpunished as it sets a precedent for"fast land" .

RESOLVED to recommend to the Southold Town Trustees approval
of wetland application No . 380 submitted by the Land Use Company
on behalf of Jo.seph Duggan to construct a . 16" x32 ' swimming pool with
5 ' decking around same .

On a motion made by Martin Garrell, seconded by Heather Cusack, it was
RESOLVED to recommend to the Southold Town Trustees that they
declare Nb : 381 ; ecL a SIGNIFICANT ENVIRONMENT IMPACT, siting pages
3 , 4 and 5 which state the successful bid contractor will make
the decision ,regarding. the method used. Hearing procedures should
be followed particularly to find out what methods of marine installa-
tion will be used . The Council feels the excavation is a major one
involving a 5 ' trench, taking about 15 months , and causing a major
disturb.ance. The project is wetland application No . 381 submitted
by John A. Weismantle, Vice President on behalf of the': Long Island
Lighting Co. to trench , bury and backfill to install 69KV electric
cable conduits at submarine crossing.

On a motion made by Ralph Condit , seconded by Heather Cusack, it was
RESOLVED to recommend to the Southold Town Trustees approval
of wetland application No. 382 submitted by the Land Use Company on
behalf of Mary DeMartino to construct a single family dwelling a minimum
of 80 ' above the MHW mark and associated sanitary system approx . 140 '
above the MHW mark. Also to construct approx. 150 ' of rock rip-rap
along the edge of the eroded bank facing Orient Harbor.
The Council suggests applicant do grading on the bayward slope
and planting cover plants to protect property and shoreline. This
should make the rip-rap unneccessary.

On a motion made by Martin Garrell, seconded by RAlph Condit, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of wetland application No. 383 submitted by James H. Small
to build a boat railway for private use, 72' long by 6 ' wide.
The Council feels there is no way the railraod can work without
destroying the marshland.

On a motion made by Heather Cusack, seconded by Martin Garrell, it was
RESOLVED to recommend to the Southold Town Trustees approval
of wetland:;application No . 384 submitted by Costello Marine Con-
tracting on behalf of Joseph Sucher to install 5x5 platform,
40 ' x6 ' floating dock and 16 ' ramp secured by three piling in
front of blukhead.

RESOLVED to recommend to the Southold Town Trustees approval of
wetland application NO . 385 submitted by George D. F. Lamborn
to pump water from spring fed non "wetland" pond to higher level
man made pond.

On a motion made by Jeanne Marriner, seconded by Ralph Condit, it was
RESOLVED to recommend to the Southold Town Trustees approval of
wetland application No. 386 s.ubmitted the Lane Use Company on behalf
of the Marratooka Club toreconstruct within 18" of an existing
storm damaged bulkhead and backfill with approx. 40 c.y . of clean
sand .

On a motion made by. Martin Garrell, seconded by Ralph Condit , it was
RESOLVED to recommend to the Southold Town Trustees approval of the
wetland application No. 387 submitted by the Land Use Company on
behalf. of Henry C . Bornemann Co . , Inc . - to construct a single family
dwelling, sanitary system and 4 ' x 100 ' fixed dock, 3 ' x 15 ' ramp,
and three 6 ' x 20 ' floats . The CAC strongly recommends that the
applicant follw the planting scheme used by the neighbor to the
North and advise a 20 ' buffer of natural vegetation between the
yard and marsh .

On a motion made by Martin Garrell, seconded by Ralph Condit, it was
RESOLVED to table wetland application No. 388 submitted by the
Lane Use Company on behalf of Leonard Schlegal toconstruct a single
family dwelling with sanitary system; 4 ' x 10 ' fixed dock, 3 ' x 15 '
ramp and 6 ' x 20' float secured by two 8" spiles .
The CAC requests a detailed site plan as to ascertain the way
the applicant proposes to buffer the marsh, and a proposed land-
scape scheme. Plans must be made to protect marsh from runoff.

RESOLVED to recommend to the Southold Town Trustees approval
of wetland application No. 389 submitted by the Land Use Company
on behalf of Edward Sayegh to-.-reconstruct within 18" storm damaged
bulkhead .and backfill with approx . 75 c. y . clean sand.

On a motion made by RAlph Condit , seconded by Betty Wells , it was
RESOLVED to recommend to the Southold Town Trustees approval of
wetland application No . ' 390 submitted by Nancy-Jo Cantrell to
Maintenance dredge existing boat slip . The approval is with the
provision that applicant does planting along shoreline to prevent
further erosion. Perennial vegetation on both sides of the boat slip
will prevent the erosion which caused tthe problem in the first place.

Shellfisheries in retrieving collectors placed in local waters
to determin whether there is a scallop "set" .

The regular meetin of the Southold Town Conservation Advisory
Council is scheduled to meet Thursday, June 19 , 1986 at 7 : 30 P .M.
Since Jay Tonski wished to speak to CAG on that date, it was
decided that the meeting would begin after his presentation.
Discussion
Due to large number of sensitive applications being submitted
to th-e Council and the controversial aspects of many applications
the Council decided they would begin carrying a camera on the
inspections to give support and evidence to their recommendations .
On a motion made by Ralph Condit, seconded by Betty 'Wells , it was
RESOLVED to adjourn the meeting at 9 : 55 P .M.
