(516)765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL The Southold Town Conservation Advisory Council held its regular meeting on Tuesday,..7July 22, 1986 at 8 : 00 P .M. at the -Southold Town Hall, Main Road, Southold , New York. Present were: Martin H. Garrell, Chairman Ralph C. Condit , Member . - Heather Cusack, Member Jeanne Marriner, Member John Tuthill, Member Linda Cooper, Secretary Absent were: John Hol zapfel, Member Betty Wells , Member The minutes of the regular meeting held June 19 , 1986 were approved by the membership. The CAC was issued . an invitation to go to Fishers Island, New York, August 65 1986 to attend the Southold Town Board's annual board meeting held there. Martin Garrel, Heather Cusack, and Jeanne Marriner plan to attend. Reports Martin Garrel reported the Long I:slAnd Sound Cruise is to take place in Sentenber or October. He will have further inf_romation at the August meeting . Heather Cusack, who is to. make a survey of run-off areas , has met with Superintendent of Highways , Raymond Jacobs , to . study maps which. were available.. Communications Ruth. Oliva submitted a request for the Southold Town Conservation Advisory Council to pass a resolution calling for immediate action to save th-e Peconic B"ay Estuary. On a motion made by Martin Garrell , seconded by' Jeanne Marriner, it was Page 2 WHEREAS the Peconic Bay Estuary provides essential habitat for many diverse species of shellfish , finfish and water fowl and other important aquatic organisms , WHEREAS the Bay serves as a cornerstone in supporting the region 's economy, WHEREAS the Bay provides unique recreational opportunities and enhances the quality of life on the East End , WHEREAS the environmental integrity of the Bay has suffered serious deterioration in recent years , WHEREAS due to pollution , considerable acres of shellfish grounds continue to be closed each year having a disasterod6' effect on local baymen , WHEREAS over the past two years the brown algae bloom has had a devastating effect on shellfish populations resulting in a direct loss' of over $3 million to the local shellfish industry in 1985 alone , WHEREAS such algae blooms are often associated with pollution from s-ewage effluent, fertilizers, agricultural chemicals, residential waste water , WHEREAS further damage to the Bay may lead to severe reduction of fishing, swimming , boating , and other recreational uses and consequently have a deleterious effect on the tourism/resort and second-home economy, WHEREAS the continual degradation of the Bay may lead to the loss of finfish , crustaceans, eelgrass, and fish-feeding birds resulting, in -the total ecological collapse of marine life, WHEREAS scientific information which wouldprovide a basic understanding of the Bay ecosystem is lacking , WHEREAS there - presently exists no governmental entity specifically dedicated to protect and manage the Bay on a regional level , NOW THEREFORE BE IT RESOLVED that the §outhold -Town Conservation Advisory Council calls upon- all. guhl.i.c officials. to 'aat.ively support. the follo�rin.g- action _to restore th.e Hay, Establish a Bay Management Task Force with representation by State agencies, County health and planning departments, Town government , baymen , research scientists, and citizen groups . The Task Force would be created and provided with adequate funding to develop a comprehensive Management Plan for the Bay from a regional approach. To accomplish this goal , the Task Force shall undertake an in-depth study of the Bay by coordinating research efforts and funding to: _ Page 3 • conduct a complete inventory of Bay resources including adjacent shorelines , wetlands, and tributaries, • identify all significant sources of pollution , especially nutrients and sewage effluent , which may have a harmful effect on the Bay, • construct a meaningful scientific data base through the monitorin.g.',of water , animal, plant , and sediment samples, as well as relevant meteorological information , • evaluate existing regulation and land-us.e . .management plans in terms of their effectiveness in protecting the Bay , 0 recommend policies and legislation to be implemented in order to restore and protect the ecological health of the Bay, • provide continual updating of the Management Plan on a permanent basis. Vote of Council: Ayes: All Motion carried. Recommendations On a motion made by Ralph Condit, seconded by Jeanne Marriner, it was RESOLVED to recommend to the Southold Town Trustees d-i-sapproval of. Wetland Application No. 398 submitted by En=O&.nsultants , Inc . on behalf of Harold Wilsberg to construct 100 ' timber b.u'lkhead generally along line of MHW plus 15' return at west end. Dredge in front out to 15 ' . Approximately 225 cubic yards of spoil will be removed and placed behind the bulkhead as spoil. . Bulk-- head will correct to and be in line with recently constructed bulkhead to eas.t . Ten year maintenance dredging is requested. Th.e Council sees no need for the bulkhead. It recommends a floating dock instead of a bulkhead to allow for the extensive colonization of spartina which 'w-ould stabilize the land and reduce the need for any bulkheading. The Council wishes the natural shoreline to remain as is . Mo.t16n:i7carried, Page 4 On a motion made by Heather Cusack, seconded by Ralph Condit , it wad RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Ap.plication No. 400 submitted by En-Consultants , Inc. on behalf of Sal Caiola to construct a sheet steel retaining wall along tow of bluff and on uphill side of road down face of bluff . A total of 962+ l. f . of retaining wall is proposed. For sections facing Long Island Sound stone armor will be placed. Approximately 400 c. y. of clean sand and loam will be trucked:".in for backfill. Wall will be above MHW. The Council feels it is a natural shoreline with no other bulk- heads adjacent to the property and the structure coulc cause erosion of the adjacent beaches. The Council suggests the applicant plant natural vegetation instead. Greenport, New York. Vote of Council: Ayes : Heather Cusack Ralph Condit Jeanne Marriner Martin Garrell Abstain: John Tuthill On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend tb. the Southold Town Trustees disapproval of Wetland Application No. 402 submitted by Greenport Dock Builders for Gerald Rupp to install upper and lower retaining wall and returns on sound bluff and fill with 350 c. y. and build a 8' x10 ' deck at base of existing stairs . Th.e Council disapproves because the slope is in good conditaion and is holding as is . If the applicant does anything further it could disturb the natrual vegetation which would lead to serious erosion problems . The Council does recommend the repair of the stairs and existing bulkhead. They suggest the applicant either amend or resubmit the application to do the repairs suggested and placing a small deck at the base of the stairs byt proposing no retaining walls . Vote of Council: Ayes : Martin Garrell Ralph Condit Jeanne Marriner Heather Cusack Nay : John Tuthill On a motion made by Martin Garrell, seconded by Jeanne Marriner, it was RESOLVED to recommend to the Southold Town Trustees a request for a full EIS . for Wetland Application 'No .' 319 submitted by Ted Dowd tobuild. a single family residence on pilings. The Council feels this is a signigicant Type I action and a full EIS is neccessary. The project should be discussed publicly and allow imput form interested parties at the hearing . 1 � Page 5 350 Rabbit Lane, East Marion. On a motion made by Jeanne Marriner, seconded by Martin Garrell it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No . 388 submitted by The Land Use Co. on behalf of Leonard Schlegal;_to construct a single family dwelling, sanitary system and 4 ' x10 ' fixed dock, 3 ' x 15 ' ramp and 6 ' x 20' float secured by two 8" spiles . The Council approves with stipulations. The applicant must recognize the sensitivity of the area. Th.ere should be minimal clearing during construction; no lawns on the wetland side of the house (.area between house and marsh) ; plant appropriate vegetation on wetland;,side of h.ouse; and insure nutrient flow (from fertilizers , etc. ) into th-e creek be minimal. S/W corner of East Side Avenue and B.aile Beach. Road, Mattituck. Vote of Council: Ayes : All Motion carried. On a motion made by Jeanne Marriner, seconded by Heath.er Cusack it was RESOLVED to recommend toLth.e Southold Town Trustees :appro'yal with stipulatoris of Wetland Application No'. '394 submitted by Th.e Land Use Company on behalf of 'Fra'nk' *R.' 'Reilly to reconstruct approximately 30 ' of cement retaining wall and to add a 4 ' addition to the northern wall of the southern cabin. Also to construct a 4 ' x 8 ' fixed deck leading to a 3 ' x 20 ' ramp leading to a 6 ' x 10' floating dock. Th.e Council approves the cabin and reta n.;ng wall. The ramp and dock. are dependent upon neighbors approval for access. If the path. is to cross wetland the Council does: not approve. East Side Avenue, Mattituck. vote of Council: Ayes : All Motion carried. Page 6 On a motion made by Jeanne Marriner, seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No . 403 submitted by Encensultants, Inc. on behalf of John Becht. toconstruct a timber dock consisting of a 4 ' x 32 ' fixed elevated (3/5 above grade of marsh) walk; 4 ' x 16 ' ramp ; 6' x 16 ' float secured by two 6" x 6" pilings . The Council approves the plans as sketched with the elevation over th.e spartina. Howard Avenue, Mattituck, NY Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit , seconded by Heather Cusack it was RESOLVED to recommend to the Southold Town Trustees' approval of Wetland Application No . 404 submitted by En-Consultants, Inc. on behalf of Goldsmith' s Boar Shop, Inc. to timainten.ance dredg entrance channel to marina to 4 ' below MLW. Dimensions of channel are 300 ' lond x 45 ' wide ( max. length channel is 25' ) . Approxi- mately 1200-. cubic yards of spoil will be removed and placed on adjacent upland site owned by applicant . Ten year maintenance permit requested. Main Road, Southold, NY Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit, seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees' approval with stipulations of Wetland Application No. '405 submitted by Mark Baxter to construct a single family dwelling, septic system' and well. Th-e Council approves with the following stipulations : the applicant must keep all drainage on property; there must be minimal clearing of vegetation; does not cut down vegetation on water side of house; allow a 10' buffer of vegetation between house and water; and NO LAWN on water side of house. Foot of R. O.W. at Wunneweta Road, Nassua Point , Southold. Vote of Council: Ayes; All Motion carried. On a motion made by Martin Garrell, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application 'No."407 submitted by En-Consultants, Inc . on behalf of Ariiol•d 31air to construct 97 l. f . of timber retaining wall extending previously approved return on west side to existing bulkhead on east side. Backfill with 60 c. y. of clean sand. The Council approves provid:ed;;that the retaining wall is inptall- in a straight line. Vote of Council: Ayes: All Motion carried. On a motion made by Mart-in, -Garrell, seconded by Ralph Condit , it was Resolved to Table Wetland Application 'No'.'4'08 submitted by The Nature Conservancy. Jeanne Marriner will compose a letter to be sent to obtain additional information. Vote of Council: Ayes; All Motion carried. Page 8 On a motion made by Ralph Condit , seconded by John Tuthill , it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No . 410 submitted by Glenn E. Just on behalf of Sal R. Varano toreconstruct with 18" approx- imately 210' of timber bulkhead. The Council approves with the stipulation that the bulkhead is installed in place and not moved out as shown in plans . 6750 Indisn Neck Road, Peconic. Vote of Council':, Ayes: All Motion carried. On a motion made by Jeanne Marriner, seconded b.y John Tuthill , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Ap-pl'i,ca.tion 'No'.' '411 submitted by Angelo Stepnoski on behalf of John Morse to replace in-kind, in-place 118' timber bulkhead and 82 ' timber jetty. Mattituck off Bay Avenue. Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit , seconded by Martin Garrell , it was RESOLVED to recommend to the Southold Town. Trustees , dis'approval of Wetland Application No . 412 submitted by J. H. Geideman on behalf of Nicholas 'J. 'Cutrone to construct a- 75 ' bulkhead with. 8 ' returns: The Council f.e6ls there is no need for a bulkh.ead, the slope is heavily vegetated. There is no erosion. There is a healthy buffer marsh and the area is not subject to extreme storm condi- tions . There isc no other bulkhead,,; on either side, and the Council would like tbo.retain the natural shoreline. Geideman on behalf of Douglas Morris to add a 3 ' x 10 ' ramp and a 6 '. x 20 ' float to end of existing dock. Shore Road, Greenport . Page 9 Vote of Council : Ayes: All Motion carried.
