Box 1179 TELEPHONE a��/Ol �� Southold, New York 11971 (516)765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL AUGUST 21, 1986 The regular meeting of the Southold Town Conservation Advisory Council was held Thursday, August 21, 1986 at 7:30 P.M. at the Southold Town Hall, Main Road, Southold, New York . Present were: Martin Garrell, Chairman Ralph C. Condit, Member Heather Cusack, Member John Holzapfel, Member John Tuthill,- Member Betty Wells, Member Jeanne Marriner,,Member Linda J. Cooper, Secretary Ellen Larsen, Trustee On a motion made by :John Tuthill, seconded by Heather Cusack, it was RESOLVED to accept the minutes of the regular meeting held Tuesday, July 22, 1986. Vote of Council: Ayes: All NEW BUSINESS Saturday, August 23, 1986, Mini-Environment 2000 will be held at Stony Brook. Heather Cusack will attend the meeting and report on it at the next CAC meeting. Monday, August 25, 1986 a meeting of the Peconic Bay Task Force will be held in Bridgehampton, New York at the office of the Group for the South Fork. Discussions will be about Peconic Bay: data taking, brown tide, and associated problems. Jeanne Marriner and Heather Cusack will represent the CAC at the meeting. Saturday, October 11, 1986 the Long Island Sound Task Force will hold a workshop on a cruise. A research vessel from Project Oceanology will leave Mattituck Inlet at 9:30 A.M. and will retrun at 12:00 noon. Martin Garrell will participate. November 21 through 23, 1986 the New York State Conference on the Environment Page 2 will be held in Albany, New York. Martin Garrell asked the Council to try to plan an appropriate display and would like the members to check their calenders to determine if anyone could attend the conference. RECOMMENDATIONS On a motion made by Martin Garrell, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees disapproval pending Declaration of Significant Impact of Wetland Application NO. 409 sub- mitted by George 0. Guldi on behalf of Douglas Miller to subdivide land adjacent to freshwater wetland. The Council would like the Trustees to declare the project a Significant Impact and have an EIS filed. Items which must be addressed are the exact siting of houses, mitigating measures for runoff, protection given to marshes, nutrient flow into Laurel Lake. The Council feels the marshes are the only thing saving the lake. . Any houses built willhave a sig- nificant effect on that environment. A public hearing would allow a discussion of things to watch out for, not only for proposed projects but also for landowners already living on the lake so corrective measures may be taken. North side of Laurel Lake. Vote of- Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval of: Wetland Application No. 415 submitted by Marlene R. Hash to install a float and gangway an two pilings to secure float. 1700 Deep Hole Drive, Mattituck. Wetland Application No. 416 submitted by Ann Burger to construct deck off existing residence. 2515 Pine Tree Road, Cutchogue. Wetland Application No. 417 submitted by J. H. Geideman on behalf on Doris Sonner to construct a small foot bridge over a tidal stream on owner's property. East side of Inlet Lane, Greenport. Wetland Application No. 422 submitted by En-Consultants, Inc. on behalf of Frank Curran to construct a fixed elevated (3.5' above grade) timber dock consisting of a 4' x 30' main section and 4' x 20' outer "L" section toward the south. Strohson Road, Cutchogue. Wetland Application No. 424 submitted by Wunneweta Pond Association to maintenance dredge entrance to Wunneweta Pond from Cutchogue Harbor to depth of 6' at MLW. Cutchogue. Wetland Application No. 425 submitted by. Glenn E. Just of the Land Use Company on behalf of Bala Pillai to reconstruct within 18" approximately 100' of strom damaged timber bulkhead and to construct an 18' timber return at the western end. Peconic Bay Blvd. , Mattituck Page 3 Vote of Council: Ayes: All Motion carried. On a motion made by John Holzapfel, seconded by Heather Cusack it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 421 submitted by Kenneth Schuler to build a catwalk from deck to water and 4' x 12' float for boat, two spiles. The Council approves if the catwalk is elevated by the standard 4' above the wetlands. 3145 Main Bayview, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by Heather Cusack it was RESOLVED to recommend to the Southold Town Trustees that Wetland Application No. 427 submitted by Ian and Effie Diakos to replace rotted boards and stairs by reconstructing in approximately the same location. The Council recommends the project be declared a Non-Significant Impact but denial of the Wetland Permit until the dispute between the Stars Road poperty owners and applicant is resolved. Aquaview Avenue, East Marion. Vote of Council: Ayes: All Motion carried. On a motion made by Jeanne Marriner, seconded by RAlph Condit, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 408 submitted by The Nature Conservancy to build a boardwalk and observation dock for observing wildfowl on Horton Creek. East side of Peconic Bay Blvd. , Mattituck. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by RAlph Condit it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 418 . submitted by Land Use Company on behalf of William and Dorothy Galati to construct approximately 90 linear feet of timber bulkhead above the spring high tide line with a 20' return running land- ward from teh eastern end and backfilled. The Council strongly urges the applicant to reconsider the project. The project may cause the applicant to lose their beach. The current vegetation and beach system seems to be working well. If the applicant wishes to go ahead with the project the Council approves as.,long as the vegetation is kept in place. Vote of Council: Ayes: All Motion carried. Page 4 On a motion made by RAlph Condit, seconded by Betty Wells, it was RESOLVED to table WEtland Application No. 419 submitted by The Land Use Company on behalf of Cove Properties. The Council requests good quality maps of the property and shoreline showing exactly where applicant intends to place dock. Main Bayview, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit, seconded by Jeanne Mar riner, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 420 submitted by The Land Use Company on behalf of Joseph Duggan to construct approximately 55' of timber bulkhead and to dredge approximately 40c.y, for use as a boat slip. The Council feels approval is moot since the project has been completed without the permit. The Council feels action should be taken to prevent erosion and runoff on the east side of the bulkhead. The recommend the Trustees require the applicant to install fill and put in evergreen ground cover to prevent rain induced runoff from carrying fill into the creek. Snug Harbor Road, Greenport. Vote of Council: Ayes: All Motion carried. On a motion made by Martin GArrell, seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees approval with comments of Wetland Application No. 423 submitted by Lewis L. Edson to build a one family house. The Council feels it should be on the record the the foundation was done without the permit. Accountability should be brought to the Trustess and Building Department to thake appropriate action. The Council approves because they feel it would disturb the environment more to remove the foundation than to let it remain in place. The Council feels certain measures must be taken to protect the wetlands. 1. Locate the cesspool as far as possible from the wetlands. 2. No bulkheading 3. Catwalks over marsh. 4. No lawns on creek side. 5. Leave natural vegetation. 6. Plant vegetation buffer around foundation. 7. Install drywells to contain runoff on site. 2570 Clearview Avenue, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit,seconded by Jeanne Marriner, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 426 submitted by Tidewater Construction on behalf of Alfred Magill to dredge to provide basin to shelter applicant's water recreation craft and to stabilize banks around basin and property. Dredging, dry excavation adn bulkheading required with all fill on upland. Also ten year maintenance dredging required. The Council vehemently recommends disapproval. The applicant proposes to dredge low and high marsh wetlands and to fill high march wetland. Page 5 1145 Fleetwood Road, Cutchogue. Vote of Council: Ayes: All Motion carried. On a motion made by Heather Cusack, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 428 submitted by The Land Use Company for Bayview Development to reconstruct within 18" approximately 1575 l.f. of strom damaged timber bulkhead and fill. The Council recommend approval if the northern end is replaced in kind and the grasses are not disturbed. The Southern end, past the bulge in the bulkhead, may be placed within the 18" allowance. Sage Road, Greenport. Vote of Council: Ayes: All Motion carried. DISCUSSIONS The Council discussed the waiver process used by the Trustees. The Council feels that unless the project is trivial or an emergency situation is presented, all projects should go through the wetland application and permit process. The group will meet at 3:00 P.M. at the Southold Town Hall. The next regular meeting will be Thursday, September 19, 1986 at 8:OOP.M. at the Southold Town Hall.
